2011年9月1日6时40分许，我队接城关派出所转杨金山（男，37岁，）报案称：2011年9月1日6时20分许，杨金山在北京市密云县久润东区13号楼北侧平房门口发现一具女尸，身上有大量血迹。接报后，我队立即组织干警对现场进行勘查。                                               

经勘查，该女子系被他人所杀，现特呈请对该女被杀案立案侦查，理由如下：                                                 

经查，报案人杨金山，男，37 岁，身份证号：XXX，住北京市密云县檀营乡宽街西XX号。2011年6时20分许，杨金山准备外出时，发现家门口玉米地旁有一具女尸，随即报警。经勘查，死者为女性，上身穿灰色背心，下身穿绿色短裤，脚穿红色拖鞋。身旁有大量血迹，多处明显锐器伤，经法医鉴定为他杀。经查，被害女尸与2011年9月1日2时28分许，王训合（男，23岁）报其出走女友刘瑞雪的体貌特征相吻合。经查，王训合，男，23岁，身份证号：XXX，户籍地：山东省鄄城县箕山镇王顾庄行政村王顾庄村003号，现住址：北京市密云县梧桐苑小区XX号楼3单元XXX室，职业司机。刘瑞雪，女，23岁，1988年1于3日出生，身份证号：XXX，户籍地：北京市顺义区李遂镇太平庄村平中街二条XX号，现住址：北京市密云县梧桐苑小区XX号楼3单元XXX室。2011年9月1日1时许，因琐事与其男友王训合发生口角后离家出走。出走时上身穿灰色背心，下身穿绿色短裤，脚穿红色拖鞋。走时随身携带一部蓝黑色诺基亚牌直板型手机，手机号：13681642094。后经刘瑞雪哥哥刘金龙对死者进行辨认，确定死者身份为刘瑞雪。                                                 

根据《刑事诉讼法》第八十六条之规定，此案符合立案条件，拟立为故意杀人案件侦查，并从以下方面开展侦查活动：

1、询问发现人。                                        

2、询问死者男友。                                       

3、对案发地周围群众进行走访，查找目击证人。              

4、对死者进一步进行尸体检验。                    

5、调取监控录像。                                

6、对有前科劣迹人员进行摸排。                    

7、对刘瑞雪随身携带物品进行查找。

总队：

2011年9月1日7时45分，我支队接总队值班室布警：密云县城长城环岛向北一菜地内发现一具女尸。副总队长段金辉指示：报隗总。一支队、七支队、八大队到现场。另请十二总队到现场协助工作。接报告后，我支队政委樊宏宇立即带领二中队侦查员赶赴现场，会同市局技术侦察总队、情报信息中心、网络安全保卫处、七支队、八大队、密云县刑侦大队的同志开展工作。刑侦总队副总队长隗甫杰、密云县局副局长杨振宇亲临现场指挥。

一、接报案情况

据报警人杨金山（男，37岁，密云县檀营四村XX号，手机号13161258281）反映：2011年9月1日6时20分许，他母亲告知在密云县久润东区13号楼北侧发现一女尸，杨即拨打110报警。

当日凌晨2时40分，王训合（男，24岁，山东省鄄城县人）到派出所报警称他女友刘瑞雪（女，23岁，顺义区人）走失，并称她可能遇害。

经密云县局民警到现场工作，初步确认死者系刘瑞雪。

二、死者基本情况

刘瑞雪，女，1988年1月3日出生，户籍地：顺义区李遂镇太平辛庄村，身份证号：XXX，暂住密云县梧桐苑小区XX号楼3单元XXX室，无业，手机：13581642094。 

三、现场勘查及法医检验情况

现场位于密云县城关镇久润花园东区13号楼北侧的檀营乡四村西宽街43号院东侧空地。死者头南脚北右侧卧于院内南北向的土路上，西侧为报案人杨金山住宅，东侧为一菜园。

死者上穿灰色吊带背心、红色胸衣，下穿灰色和绿色相间的条格短裤，脚穿红色拖鞋，左手紧握一串钥匙。头颈部地面形成10×10cm大小的血泊。在尸体东侧菜园内发现一趟往返的滴落血迹，血迹延伸到菜园东侧围墙前。在尸体北侧土路上也发现单趟滴落血迹，延伸到北侧东西向的土路边。在土路边发现与死者所穿拖鞋鞋底花纹同种的足迹。尸体北侧土路上发现一盒“将军”牌香烟，内有17支香烟。

死者项背部发现多处刺创，一刺创内遗留有一刀的刃部。在死者头发下发现一金属刀把，二者系整体分离的两个部分。刀上印有“金洪”、“广东阳江”字样。

经法医初步检验，尸体项背部共有刺创伤12处。下唇有出血。颜面部、右下额、右肩背等处有皮下出血。左额、颞部、双肘后、双膝盖前、左大腿内侧等处有擦划伤。左乳上、右大腿内侧有片状皮下出血。左脚趾间夹有杂草，双足底较脏。死亡时间在9月1日凌晨2时左右，死因系失血性休克。

四、现场访问情况

据死者男友王训合（男，24岁，户籍地：山东省鄄城县萁山镇王顾庄行政村王顾庄村XXX号 ，暂住密云县梧桐苑小区XX号楼3单元XXX室，个体司机，手机：18710222030）反映：2011年3月和女友刘瑞雪同居于暂住地。同时租住此暂住地的还有李长乐（男，1991年1月25日出生，密云县人，手机：13910791190）、何锋（男，1985年11月19日出生，河北省张家口市人，手机：15810461008）及王乐龙（男，1988年11月12日出生，山东省鄄城县人，手机：18610383363）。9月1日凌晨0时30分许，王训合、刘瑞雪二人因琐事产生口角，二人先后两次离家外出。刘瑞雪在寻找王训合未果后负气不归，二人在多次电话中继续争吵。王训合在通话中听见有一男子和刘瑞雪对话，称要送刘回家，刘拒绝。1时20分许，刘瑞雪四次拨打王训合电话，王未接。回想起电话中听到的男子声音，预感可能要出事。回拨电话时，刘瑞雪重复三次称自己在梧桐苑东侧，声音急切，便挂断电话。王立即到梧桐苑附近寻找刘未果。2时30分许，王训合再拨打刘电话无人接听，随即拨打110报案。

据何锋（男，25岁，河北省张家口市人，手机：15810461008）、李长乐（男，21岁，密云县人，手机：13910791190）反映： 2011年9月1日0时许，王训合、刘瑞雪二人因琐事产生口角先后离家外出。0时30分许，刘瑞雪先回到家并将房门反锁。王训合回来后未敲开房门便再次外出，刘瑞雪随即追赶王训合外出。3时30分许，王训合给何锋打电话询问刘瑞雪是否回家，何峰告知她未见刘瑞雪回来。

五、案情分析及工作部署

结合现场勘查、法医检验及现场访问等情况，专案组分析认为刘瑞雪极有可能路遇他人遇害，不排除由性因素引发的故意杀人案。王训合的排查工作应全面开展，主要工作如下：

（一）技术、法医工作

1、加强现场周边的勘查，力争发现其他痕迹物证。

2、法医部门对尸体进一步检验，重点加强生物检材的发现及提取。

（二）关系人访问工作

1、对死者关系人及知情人进行深入访问，了解死者性格特点、活动规律、矛盾因素等情况，从中发现可疑线索。

2、对现场周边住户、保安、夜间从业人员等进行访问，发现案件线索。

（三）对王训合进行专项调查

1、对其同住人员进行访问，印证其活动轨迹情况。

2、对他驾驶车辆进行勘查。

3、调取相关监控录像，核实他当晚活动经过。

4、调取他手机机存信息及话单进行相关工作。

5、对目击者及其他关系人进行访问。

（四）地区工作

对案发现场周边的黑车司机及相关人员进行摸排，力争发现案件线索。

（五）监控录像工作

对现场地区的监控录像进行全面的保全，确定重点时段注意发现可疑人员、车辆。

（六）技侦工作

对死者及其关系人开展通讯信息的排查。

对案件相关数据进行采集，比对碰撞，发现可疑人员及线索。

（七）情报部门工作

1、对死者关系人进行全网查询，获取相关信息。

2、梳理近年来同类案件，辖区内存在前科劣迹尤其是性犯罪的人员。

（八）网安部门

1、对死者及其关系人的网络聊天记录及相关内容进行梳理，发现可疑线索。

2、梳理现场周边符合作案时间段的上网及下网人员，发现可疑情况。

（九）调取现场周边符合作案时间的车辆违章记录，从中发现线索。

• 简要案情

（一）、尸体发现情况

据报警人杨金山（男，37岁，密云县檀营四村XX号，手机号13161258281）反映：2011年9月1日6时20分许，他母亲告知在密云县久润东区13号楼北侧发现一女尸，杨金山即拨打110报警。

（二）、现场勘查及法医鉴定情况

二、工作情况

• 王训合的排查情况

据死者男友王训合（男，24岁，户籍地：山东省鄄城县萁山镇王顾庄行政村王顾庄村XXX号，暂住密云县梧桐苑小区XX号楼3单元XXX室，个体司机，手机：18710222030）反映：2011年3月和女友刘瑞雪同居于暂住地。同时租住此暂住地的还有李长乐（男，1991年1月25日出生，密云县人，手机：13910791190）、何锋（男，1985年11月19日出生，河北省张家口市人，手机：15810461008）及王乐龙（男，1988年11月12日出生，山东省鄄城县人，手机：18610383363）。9月1日凌晨0时30分许，王训合、刘瑞雪二人因琐事产生口角。二人先后两次离家外出，刘瑞雪在寻找王训合未果后负气不归。二人在多次电话中继续争吵。王训合在通话中听见有一男子和刘瑞雪对话，称要送刘回家，刘拒绝。2时30分许，王训合再拨打刘电话无人接听，随即拨打110报案。

1、我队经走访与王训合同租住人员李长乐（男，1991年1月25日出生，密云县人，手机：13910791190）、何锋（男，1985年11月19日出生，河北省张家口市人，手机：15810461008）及王乐龙（男，1988年11月12日出生，山东省鄄城县人，手机：18610383363），三人能够证实案发前王训合与刘瑞雪有过争吵，二人先后两次离家外出。

2、我队调取了王训合通话记录，证实案发时，王训合与刘瑞雪有过多次通话。

3、我队调取了案发现场及梧桐苑周围监控录像，证实了王训合驾驶奥迪轿车寻找刘瑞雪情况。

4、我队调取的监控录像中显示，刘瑞雪跑出梧桐苑大门后，与一推自行车男子交谈行走至案发现场附近。

综合上述情况，王训合不应具备作案的时机。

• 死者刘瑞雪携带物品情况

死者走时随身携带一部蓝黑色诺基亚牌直板型手机，手机号：13681642094。我队经工作未在案发现场周围找到该手机。

2011年9月1日20时许，李辉（男，30岁，户口所在地：密云县宾阳里XX甲号楼4单元XXX室，联系电话13701161575）到密云县城关派出所反映情况，称2011年9月1日早上5点至6点之间，在密云县檀营村村里的路边草地里捡到一部蓝色的诺基亚牌直板手机。后听说当日密云县一女子被杀害，死者叫刘瑞雪。李辉打开手机后发现手机中一条短信里提到刘瑞雪的名字，随即将该手机交到密云县城关派出所。

• 破案经过

1、嫌疑人身份的确定

我队经工作，确认李辉所捡手机为死者刘瑞雪生前随身携带并使用的手机。通过对该手机内的通话记录进行分析，发现已拨电话中在2011年9月1日1时23分，显示一个号码为15910520527，未有通话时间。2011年9月1日2时13分，显示一个叫刘磊的名字，号码为15910520527，未有通话时间。通过分析，发现两次拨出电话时间在案发时间段内，死者可能在死前将该手机号码存入手机中。死者应与15910520527的持机人有一定的关系。经工作，确认15910520527的手机号机主为刘磊，男，身份证号：XXX，密云县顺翾舸饭店服务生，户籍地址：河北省河间市卧佛堂镇孙村XX号。据顺翾舸饭店老板师海涛反映，刘磊于2011年8月初到该饭店上班，工作稳定。2011年9月1日上午9时左右，刘磊突然到饭店请假，称他父亲在老家出车祸了，要立即回家奔丧。刘磊离开饭店一直未归，行为异常。

• 嫌疑人审查情况

2011年9月6日1时许，我队在河北省河间市卧佛堂镇孙村郭占山家中，将犯罪嫌疑人刘磊抓获。2011年9月6日4时，我队将他带回密云县公安局刑侦大队接受讯问。经审讯，犯罪嫌疑人刘磊如实供述于2011年9月1日凌晨1时许，在密云县梧桐苑小区门口遇见独身一人的刘瑞雪。刘磊主动搭讪与她攀谈，后欲强行与刘瑞雪发生性关系。因刘瑞雪反抗，刘磊在密云县久润东区13号楼北侧空地用随身携带刀将刘瑞雪杀害后逃离现场。刘磊将作案时所穿上衣丢弃在密云县檀营村村北的玉米地中，次日将自己所骑自行车以20元的价格卖给西大桥村一卖煎饼的老太太。2011年9月6日上午，刑侦大队在犯罪嫌疑人刘磊的指认下在密云县檀营村村北的玉米地中找到了刘磊作案时所穿白色带血迹上衣。同时我队找到了西大桥村一卖煎饼的老太太张素琴（女，52岁，13522976001）。经她对照片辨认，准确指认卖给她自行车的人员刘磊，并交出所收自行车。

犯罪嫌疑人刘磊所供作案过程，与现场勘查及所获赃，证物情况基本一致，至此，全案真相大白。

After investigation, the reporter Yang Jinshan, male, 37 years old, ID number: XXX, lives at No. XX West Kuan Street, Tanying Township, Miyun County, Beijing. At about 6:20 in 2011, when Yang Jinshan was about to go out, he found a female corpse next to the cornfield in front of his house, and immediately called the police. At about 1 o’clock on September 1, 2011, he ran away from home after having an argument with his boyfriend Wang Xunhe over trivial matters. The scene of Liu Ruixue’s murder in the fourth village of Tanying Township, Miyun County
Team:

At 7:45 on September 1, 2011, our detachment received the police from the duty room of the general team: a female body was found in a vegetable field north of the Great Wall Roundabout in Miyun County. Duan Jinhui, the deputy captain, instructed: Report to President Kui. Team One, Team Seven, and Team Eight arrived at the scene. Also invite the 12th Corps to assist the work on site. After receiving the report, Fan Hongyu, the political commissar of our detachment, immediately led the investigators of the Second Squadron to the scene, and worked together with comrades from the Technical Reconnaissance Corps of the Municipal Bureau, the Intelligence Information Center, the Network Security Division, the Seventh Detachment, the Eighth Brigade, and the Criminal Investigation Brigade of Miyun County. Kui Fujie, deputy head of the criminal investigation team, and Yang Zhenyu, deputy director of the Miyun County Bureau, came to the scene to direct.

1. The situation of receiving reports
   According to the caller Yang Jinshan (male, 37 years old, No. XX, Tanying 4th Village, Miyun County, mobile phone number 13161258281): At about 6:20 on September 1, 2011, his mother informed that he was in Building 13, Jiurun East District, Miyun County. A female body was found on the north side, and Yang called 110 to call the police.

At 2:40 a.m. that day, Wang Xunhe (male, 24 years old, from Juancheng County, Shandong Province) went to the police station to report to the police that his girlfriend Liu Ruixue (female, 23 years old, from Shunyi District) was missing and that she might have been killed.

After Miyun County Bureau police went to the scene to work, it was initially confirmed that the deceased was Liu Ruixue.

2. Basic situation of the deceased
   Liu Ruixue, female, born on January 3, 1988, household registration: Taiping Xinzhuang Village, Lisui Town, Shunyi District, ID number: XXX, temporarily living in Room XXX, Unit 3, Building XX, Wutongyuan Community, Miyun County, unemployed, mobile phone: 13581642094 .
3. On-site investigation and forensic examination
   The site is located in the open space on the east side of courtyard 43, Xikuan Street, Si Village, Tanying Township, on the north side of Building 13, Jiurun Garden East District, Chengguan Town, Miyun County. The deceased was lying on the north-south dirt road with his head in the south, feet in the north and the right side in the courtyard. The reporter Yang Jinshan’s residence was on the west side, and a vegetable garden was on the east side.

The deceased was wearing a gray camisole, a red corset, gray and green checked shorts, red slippers, and a bunch of keys in his left hand. A pool of blood with a size of 10×10 cm was formed on the ground of the head and neck. A back and forth dripping blood was found in the vegetable garden on the east side of the corpse, and the blood stains extended to the wall on the east side of the vegetable garden. A single drip of blood was also found on the dirt road on the north side of the corpse, extending to the east-west side of the dirt road on the north side. Footprints of the same type as the sole pattern of the slippers worn by the deceased were found on the side of the dirt road. A pack of “General” brand cigarettes containing 17 cigarettes was found on the dirt road to the north of the corpse.

Multiple stab wounds were found on the back of the neck of the deceased, and a blade of a knife was left in one stab wound. A metal knife handle was found under the hair of the deceased, and the two were two separate parts. The words “Jinhong” and “Guangdong Yangjiang” are printed on the knife.

According to preliminary forensic examination, there were 12 stab wounds on the nape of the corpse. There is bleeding on the lower lip. There were subcutaneous hemorrhages on the face, lower right forehead, right shoulder and back. There were scratches on the left forehead, temple, behind both elbows, in front of both knees, and inner left thigh. There were subcutaneous hemorrhages on the upper left breast and inner right thigh. There are weeds between the left toes, and the soles of both feet are dirty. The time of death was around 2 am on September 1, and the cause of death was hemorrhagic shock.

4. On-site visits
   According to the deceased’s boyfriend Wang Xunhe (male, 24 years old, household registration: No. XXX, Wangguzhuang Village, Wangguzhuang Administrative Village, Jishan Town, Juancheng County, Shandong Province, temporarily living in Room XXX, Unit 3, Building XX, Wutongyuan Community, Miyun County, an individual driver, Mobile phone: 18710222030) Reflection: In March 2011, he lived with his girlfriend Liu Ruixue in a temporary residence. At the same time, Li Changle (male, born on January 25, 1991, from Miyun County, mobile phone: 13910791190), He Feng (male, born on November 19, 1985, from Zhangjiakou City, Hebei Province, mobile phone) also rented this temporary residence : 15810461008) and Wang Lelong (male, born on November 12, 1988, from Juancheng County, Shandong Province, mobile phone: 18610383363). At about 0:30 am on September 1, Wang Xunhe and Liu Ruixue had an argument over trivial matters, and they left home twice. After Liu Ruixue failed to find Wang Xunhe, she lost her temper, and the two continued to quarrel on the phone many times. During the call, Wang Xunhe heard a man talking to Liu Ruixue, saying that he wanted to send Liu home, but Liu refused. At about 1:20, Liu Ruixue called Wang Xunhe four times, but Wang did not answer. Recalling the man’s voice heard on the phone, I had a hunch that something might happen. When calling back, Liu Ruixue repeated three times that she was on the east side of Wutong Garden, and hung up the phone with an urgent voice. Wang immediately went to Wutong Garden to look for Liu Weiguo. At about 2:30, Wang Xunhe called Liu again, but no one answered, and then called 110 to report the crime.

According to He Feng (male, 25 years old, from Zhangjiakou City, Hebei Province, mobile phone: 15810461008) and Li Changle (male, 21 years old, from Miyun County, mobile phone: 13910791190): At about 0:00 on September 1, 2011, Wang Xunhe, Liu Ruixue and Liu Ruixue had quarrels over trivial matters and left home one after another. At about 6:40 on September 1, 2011, our team picked up Chengguan Police Station and transferred Yang Jinshan (male, 37 years old, from Tanying Village, Miyun County) to report that: at about 6:20 on September 1, 2011, Yang Jinshan was in A female body was found at the door of the bungalow on the north side of Building 13 in Jiurun East District, Miyun County, Beijing, with a lot of blood on her body. The deceased was wearing a gray camisole, a red corset, gray and green checked shorts, red slippers, and a bunch of keys in his left hand. A pool of blood with a size of 10×10 cm was formed on the ground of the head and neck. A back and forth dripping blood was found in the vegetable garden on the east side of the corpse, and the blood stains extended to the wall on the east side of the vegetable garden. A single drip of blood was also found on the dirt road on the north side of the corpse, extending to the east-west side of the dirt road on the north side. At 2:13 on September 1, 2011, a name named Liu Lei was displayed, the number was 15910520527, and there was no call time. Through analysis, it was found that the two outgoing calls were within the time period of the incident, and the deceased may have stored the mobile phone number in the mobile phone before his death. The deceased should have a certain relationship with the person holding the plane of 15910520527. After work, it was confirmed that the owner of the mobile phone number 15910520527 is Liu Lei, male, ID number: XXX, waiter at Shunhonge Hotel in Miyun County, household registration address: No. XX, Sun Village, Wofotang Town, Hejian City, Hebei Province. According to Shi Haitao, the owner of Shunlongge Hotel, Liu Lei went to work at the hotel in early August 2011 and his job was stable. At around 9 am on September 1, 2011, Liu Lei suddenly went to the hotel to ask for leave, saying that his father had a car accident in his hometown and he wanted to go home immediately for the funeral. Liu Lei left the hotel and never returned, behaving abnormally.

Situation of the suspect

At about 1 o’clock on September 6, 2011, our team arrested the suspect Liu Lei at the home of Guo Zhanshan, Sun Village, Wofotang Town, Hejian City, Hebei Province. At 4 o’clock on September 6, 2011, our team took him back to the Criminal Investigation Brigade of Miyun County Public Security Bureau for interrogation. After interrogation, the suspect Liu Lei truthfully confessed that he met Liu Ruixue, who was single, at the gate of Wutongyuan Community in Miyun County at about 1 am on September 1, 2011. Liu Lei took the initiative to strike up a conversation with her, and then wanted to forcefully have sex with Liu Ruixue. Because of Liu Ruixue’s resistance, Liu Lei killed Liu Ruixue with a knife in the open space north of Building 13 in Jiurun East District, Miyun County, and then fled the scene. Liu Lei discarded the jacket he was wearing when committing the crime in the cornfield north of Tanying Village, Miyun County, and sold the bicycle he was riding the next day to an old lady selling pancakes in Xidaqiao Village for 20 yuan. On the morning of September 6, 2011, under the identification of the criminal suspect Liu Lei, the Criminal Investigation Brigade found the white blood-stained shirt that Liu Lei was wearing when he committed the crime in the corn field in the north of Tanying Village, Miyun County.
