2010年8月28日延庆县北关小区吕强故意杀人未遂案件情况
2010年8月28日10时许，我队接延庆派出所转来吕强故意伤害前妻许晓灵一案。接报告后，刑侦大队大队长封晓源、副队长刘洪武、四队队长刘希文立即组织侦查员对该案经行深入调查访问工作。
一、接报情况：
2010年8月28日1时许，事主许晓灵（女，32岁，1978年出生，汉族，身份证号，户籍地：北京市延庆县延庆镇北关散户，现住：延庆县延庆镇北关小区）报警称：2010年8月27日21时许，她与前夫吕强因房屋抵押问题发生矛盾，前夫吕强要用被子将她捂死。
二、现场情况：
现场位于北京市延庆县延庆镇北关小区6号楼406室。
三、嫌疑人情况
吕强，男、33岁，1977年，汉族，身份证号，户籍地：北京市延庆县延庆镇北关散户，现住：延庆县延庆镇北关小区，联系电话13716664908。
四、初步调查访问情况：
1、事主许晓灵讲：2010年7月30日，自己和丈夫吕强协议离婚。北关小区X号楼XXX室房产归许晓灵所有，儿子吕瑶楠归吕强抚养，许晓灵帮助吕强归还吕强所欠外债15万元。在未归还外债期间，吕强可以在北关小区居住。2010年8月期间，吕强提出要将北关小区的房产抵押借高利贷，许晓灵并未同意。2010年8月27日，吕强给许晓灵打电话继续说抵押房产的事，许晓灵仍未同意。20时许晓灵在家中吃饭，吕强回来说：吃饱点，我做了什么事，你别怪我。自己也不明白吕强说的什么意思。大约21时许，自己回到房间换好睡衣准备休息，吕强来到房间，坐在床边说：对不起你。之后吕强用被子蒙住许晓灵的面部，隔着被子用手捂住许晓灵的嘴并掐许晓灵脖子。许晓灵挣扎着露出眼睛和嘴说：临死前想见见儿子。后吕强松开手，许晓灵趁吕强不注意跑出楼道，后又跑到楼下。吕强拉着不让走，后吕强给他的朋友杨勇打电话，杨勇来劝我说什么事上楼说，我就上楼了。我提出要给家人打电话，他们不打。我又要走，杨勇就让我走了，后我就打电话报警了。
2、杨勇（男，39岁，身份证号，户籍地河北省张家口市怀来县瑞云观乡瑞云观村，现住延庆县延庆镇小营村，联系电话13718083603）讲：2010年8月27日22时40分许，接到朋友吕强电话。吕强电话中讲与前妻许晓灵吵架了，许晓灵跑到楼下不上楼，要自己来帮助劝劝。杨勇来到吕强家楼下（北关小区），看见许晓灵穿着睡衣光着脚和吕强都站在楼下。许晓灵哭，吕强不说话。杨勇帮着劝让许晓灵上楼，许晓灵就哭着说要给姑姑打电话。杨勇同意并将许晓灵劝上楼，让吕强去找他父亲帮着说说这事，吕强出去回来后说没有找到。自己怕离开后他们两个再打架，就让许晓灵去她姑姑家，自己也就回家了。具体吕强和许晓灵因为什么事吵架不清楚。
3、吕强讲：2010年8月27日21时许，自己在外喝了三四两白酒回到前妻许晓灵家（北关小区）。和前妻许晓灵商量将此处房产抵押自己在外欠下的外债，前妻许晓灵不同意将房产抵押，就回卧室休息。自己跟着来到卧室床边，继续和她商量将房产抵押，许晓灵仍不同意。自己非常生气，就用床上的被子捂住许晓灵的头和嘴想捂死她。大约捂了大约五六秒钟，许晓灵说儿子的事，自己就心软了松开被子。许晓灵趁机跑出家门跑到楼下，自己便给朋友杨勇打电话，要杨勇来帮助劝劝让许晓灵回家。一会杨勇来了，帮着将许晓灵劝上楼了。杨勇帮着说了一会，许晓灵就走了，杨勇也走了。
五、案情分析和工作部署
根据前期调查访问情况，项目组初步分析认为此案系一起因矛盾引发的故意杀人未遂案件，综合以上情况，制定工作如下：
（一）专项调查工作
1、继续讯问嫌疑人吕强用被子捂住许晓灵头部和嘴的真实目的。
2、继续询问被害人许晓灵当时二人在室内挣吵全过程。
（二）调查访问工作
1、在现场周边邻居进行调查访问范围，注意发现可疑情况。
2、了解吕强在外所欠外债情况。
3、提取吕强、许晓灵离婚协议书。
（三）技术工作
1、由刑事部门对现场进行勘查，提取现场被子等其他痕迹物证，进行进一步检验鉴定。
2、由法医部门对被害人许晓灵身体是否造成伤害经行检验，提取的检材进行检验鉴定。
六、嫌疑人交代情况
嫌疑人吕强交代：2010年8月27日上午和父亲吕金河（男，66岁）商量，让父亲帮助自己还赌债，但父亲不同意。后自己在外面和了三四两白酒。后到前妻许晓灵家（北关小区）和许晓灵商量用房产抵押还赌债，但许晓灵不同意签字。自己实在没办法，也对她感到失望。想到自杀的同时，想让许晓灵一起死，先将许晓灵杀死自己再喝毒药自杀的想法。经多次劝说，许晓灵将房产抵押无效的情况下，看许晓灵回床上休息就用床上的被子捂住许晓灵的头和嘴想捂死她。大约捂了大约五六秒钟，许晓灵说想见见儿子的事，自己就心软了松开被子。许晓灵趁机跑出家门跑到楼下，许晓灵死死抓住一楼护栏不肯上楼。自己便给朋友杨勇打电话，要杨勇来帮助劝劝让许晓灵回家。一会杨勇来了帮着将许晓灵劝上楼了。杨勇帮着说了一会，让许晓灵先走了，后杨勇也走了。2010年8月28日将吕强刑事拘留。

- The victim, Xu Xiaoling, said: On July 30, 2010, she and her husband Lu Qiang agreed to divorce. The property in Room XXX, Building X, Beiguan Community was owned by Xu Xiaoling, and her son Lu Yaonan was brought up by Lu Qiang. Xu Xiaoling helped Lu Qiang repay the foreign debt of 150,000 yuan owed by Lu Qiang. During the non-repayment of foreign debts, Lu Qiang can live in Beiguan Community. V. Case analysis and work deployment
According to the preliminary investigation and visits, the project team preliminarily analyzed that this case was an attempted homicide case caused by conflicts. Based on the above circumstances, the formulation work is as follows:
(1) Special investigation work
- Continue to interrogate the real purpose of the suspect Lu Qiang covering Xu Xiaoling’s head and mouth with a quilt.
- Continue to question the victim, Xu Xiaoling, about the whole process of the two of them arguing indoors.
(2) Investigation and visit work
- Investigate and visit the neighbors around the scene, and pay attention to suspicious situations.
- Understand the foreign debts owed by Lu Qiang abroad.
- Extract the divorce agreement of Lu Qiang and Xu Xiaoling.
(3) Technical work
- The criminal department will investigate the scene, extract quilts and other traces and evidence from the scene, and conduct further inspection and identification.
- The forensic department inspected whether the victim Xu Xiaoling had caused physical injuries, and the extracted materials were inspected and identified.
- The suspect’s confession
Suspect Lu Qiang confessed: On the morning of August 27, 2010, he discussed with his father Lu Jinhe (male, 66 years old) to ask his father to help him repay his gambling debts, but his father disagreed. Then I made three or four taels of white wine outside. Later, I went to the home of ex-wife Xu Xiaoling (Beiguan Community) and discussed with Xu Xiaoling to use the real estate mortgage to repay the gambling debt, but Xu Xiaoling did not agree to sign.
