“1.03”房山区大安山乡元港村许德印被杀案破案报告

2012年1月3日15时49分，我支队接分局勤务指挥处布警：15时47分，许红喜（男，37岁，户籍地：北京市房山区大安山乡元港村，身份证号：，在北京市通州区工作，电话：13801164269）报案称，其父亲许德印（65岁，北京市房山区大安山煤矿退休工人）在北京市房山区大安山乡元港村柳树涧家中死亡，屋内满地是血。接报后，刑侦总队副总队长隗甫杰，房山分局副分局长安宏志、刑侦支队支队长刘如赞，刑侦总队一支队副支队长高延庆等领导亲临现场指挥案件侦破工作。我支队立即会同市局情报中心，刑侦总队一支队、七支队，网安总队等部门组成项目组共同开展工作。经工作，项目组于2012年1月5日13时许，在北京市房山区大安山乡樵煤涧村将犯罪嫌疑人刘洪杰（别名“刘杰”，男，25岁，北京市房山区大安山乡大安山村人）、刘俊（别名“小云”，女，23岁，中国内蒙古自治区赤峰市人）抓获。经突审，刘洪杰对杀害徐德印并实施抢劫的犯罪行为供认不讳。至此，案件成功告破。现将具体情况汇报如下：

一、发案情况

（一）接报案情况

2012年1月3日15时47分，许红喜（男，37岁，户籍地：北京市房山区大安山乡元港村，电话：13801164269）报案称，其父亲许德印（65岁，北京市房山区大安山煤矿退休工人）在北京市房山区大安山乡元港村柳树涧家中死亡，屋内满地是血，遂拨打110报警。

（二）死者基本情况

死者许德印：男，户籍地：北京市房山区大安山乡元港村，身份证号：，北京市房山区大安山矿退休工人，电话15910376784、13247288669（该手机号于案发半个月前启用）。

（三）现场勘查及法医检验情况

1、现场勘查情况

现场位于北京市房山区大安山乡元港村。该院坐北朝南，院落北侧为五间平房。中心现场位于死者卧室（五间平房中东起第三间屋）。案发现场房间北墙东侧有一张双人床，床上被子呈打开状。现场靠西墙有一张茶几，茶几上有电磁炉一台、火锅一个（内有白菜、豆腐等食物）、碗两只（其中一只碗内有火锅蘸料）、筷子一双。茶几东侧有一倒置板凳（可见少量血迹及毛发）。死者位于卧室地面，头东北脚西南，呈右侧卧状。上身衣着完好，下身腰带呈解开状。外裤拉链、秋裤内侧自制暗兜拉链拉开，双脚赤足，尸体有被挪动痕迹。现场喷溅血迹分布在死者头部周边，均为低位形成。现场有简单处理痕迹，未发现搏斗迹象。在死者右裤兜内及卧室门后衣架上所挂大衣内分别发现现金两千元和一千九百元，在盖房东侧厨房内发现并提取菜刀（有明显清洗痕迹）一把，菜刀刀刃卷曲，从刀刃缺口处提取到少量毛发。现场共提取生物检材43处，未发现其它可疑痕迹物品。

2、法医检验情况

经法医初步检验，尸体头左颞部及颈部可见条形砍创20余处，尸体未发现其他伤情。死者死因系颅脑损伤合并失血性休克。死者胃内容500毫升，内有米饭、菜叶、肉片等，推断死亡时间3天左右，饭后1小时左右。

3、访问情况

（1）据报案人许红喜反映：自2011年12月31日开始给其父亲许德印手机连续多日呈关机状态。2012年1月3日15时40分许，许红喜及姐姐许红玲从北京市通州赶到现场家中，发现现场院门上锁。将院门锁砸开后，发现堂屋大门未锁，其父亲所居住卧室房门上锁，遂用门外放置钥匙将屋门打开。后发现父亲许德印躺在地上，周围地面有大量血迹，遂即拨打110报警。

（2）据死者女儿许红玲（41岁，户籍地：北京市丰台区卢沟桥小郭庄，手机号码：13910574372）反映：2011年12月初，许德印因心脏病在北京市通州区潞河住院7天，出院后在弟弟许红喜家居住了6天养病。12月15日左右，许红玲将其父亲许德印送回大安山家中。许德印发现自己的手机遗忘在许红喜家中，许红玲便将自己的一部手机（手机号码：13247288669）交给许德印使用。许德印回家时随身携带有7000多元现金及邮政储蓄的存折一本（内有存款2万元）。

（3）据晋宝利（男，42岁，中国河北省保定市涞水县九龙镇北边桥下街人，暂住地：北京市房山区大安山乡元港村，电话号码：15801457597）反映：死者许德印经常在当地找卖淫女嫖娼。2011年12月底，死者在与晋宝利聊天时曾提起在2011年12月中旬，刘俊（别名“小云”，女，22岁，卖淫女，中国内蒙古自治区赤峰市人，曾多次与死者从事卖淫活动）与其男友刘洪杰（男，24岁，北京市房山区大安山乡大安山村人）曾到死者家中借钱。同时据晋宝利反映：2011年12月29日左右，死者称三四天前，刘洪杰和刘俊曾带两名卖淫女到死者家中，想占用死者家组织妇女卖淫，死者未同意。

二、案情分析及工作部署

综合上述情况，项目组分析认为此案系一起以图财为目的的抢劫杀人案。同时拟定如下工作部署：

（一）技术、法医部门工作

1、技术部门对现场提取的痕迹物证进行检验鉴定。

2、法医部门对尸体进行解剖检验，并对现场提取的生物检材进行检验鉴定。

（二）侦查工作

1、对现场周边住户进行走访，了解案发前后可疑情况。

2、深入访问死者家属，了解死者生前生活规律、社会交往等情况。

3、调取并查看现场周边地区监控录像。

4、调取死者银行账户情况，核实案发前后交易情况。

三、破案情况

（一）线索来源

经工作，刘洪杰和刘俊近期经济拮据，案发前几日曾多次找死者借钱未果。

经工作：刘洪杰手机（号码为18801426503）于2011年12月31日9时48分曾与死者联系，经调取18801426503手机通话记录反映，另一手机号码15110024598曾多次短息联系该手机，并与该手机先后到达中国内蒙古赤峰市。据此项目组分析认为刘洪杰、刘俊具有重大作案嫌疑，并重点开展相关工作。

（二）到案经过

专案组于2012年1月5日13时许，在途径北京市房山区大安山乡樵煤涧村的“房22路”公交车上将犯罪嫌疑人刘洪杰、刘俊抓获。

（三）犯罪嫌疑人基本情况

刘洪杰，男，24岁，户籍地：北京市房山区大安山乡大安山村，身份证号：，手机号：18801426503、15110024598。

刘俊，女，22岁，户籍所在地：中国内蒙古自治区赤峰市宁城县大城子镇下五村，身份证号码：。

（四）供述情况

经突审，犯罪嫌疑人刘洪杰交代：2011年12月25日左右，刘洪杰曾向刘俊表示死者徐德印具有一定经济基础想对死者进行抢劫。12月26日前后，刘俊为租用死者房屋组织卖淫一事来到死者家中与死者商量，谈妥后又因死者家中条件太差准备退租。12月31日，刘俊离开北京市房山区大安山乡返回中国内蒙古赤峰老家。2012年1月1日上午9时许，刘洪杰独自来到死者家中，与死者商量撤租一事。期间刘洪杰突起歹意，再起抢劫死者之心。刘洪杰趁死者吃饭之时，顺手拿起死者厨房内菜刀头趁死者不备向颈部砍击数刀，死者随即倒地。后刘洪杰发现死者还未死亡，遂再次用菜刀及板凳向死者头部砍砸，直至死者停止呼吸。刘洪杰将菜刀简单清洗后放回厨房。后经刘洪杰对死者衣服进行翻找，从死者秋裤内侧自制暗兜内找到一万元现金，后刘洪杰用死者家的锁将卧室门及院门锁上后逃离现场。当日上午11时许，刘洪杰到北京市房山区城关镇购买了新手机及手机号（号码为15110024598），后赶赴中国内蒙古赤峰找刘俊躲避，直至1月5日13时许，刘洪杰在与刘俊一同返回房山区大安山途中被抓获。

（五）处理结果

目前，犯罪嫌疑人刘洪杰已被房山分局刑事拘留，进一步审查取证工作正在进行中。

1. The incident
   (1) The situation of receiving reports
   At 15:47 on January 3, 2012, Xu Hongxi (male, 37 years old, domicile: Yuangang Village, Daanshan Township, Fangshan District, Beijing, telephone: 13801164269) reported that his father Xu Deyin (65 years old, Fangshan District, Beijing) A retired worker from the Da’anshan Coal Mine) died at his home in Liushujian, Yuangang Village, Da’anshan Township, Fangshan District, Beijing. (2) Basic information of the deceased

(3) On-site investigation and forensic examination

1. On-site investigation
   The scene is located in Yuangang Village, Daanshan Township, Fangshan District, Beijing. The courtyard faces south, and there are five bungalows on the north side of the courtyard. The central scene is located in the bedroom of the deceased (the third house from the middle of the five bungalows). There is a double bed on the east side of the north wall of the room at the scene of the crime, and the quilt on the bed is open. There was a coffee table near the west wall, and on the coffee table was an induction cooker, a hot pot (with cabbage, tofu and other food in it), two bowls (one of which contained hot pot dipping sauce), and a pair of chopsticks. There is an inverted bench on the east side of the coffee table (a small amount of blood and hair can be seen). The deceased was located on the floor of the bedroom, with his head northeast and feet southwest, lying on his right side. The upper body is fully clothed, and the lower body belt is untied. The zipper of the outer pants and the zipper of the self-made concealed pocket on the inside of the long johns were unzipped, the feet were barefoot, and the body showed signs of being moved. Blood splatters at the scene were distributed around the head of the deceased, all of which were formed at low positions. There were traces of simple handling at the scene, but no signs of struggle were found. Cash of 2,000 yuan and 1,900 yuan were found in the right trouser pocket of the deceased and in the coat hanging on the hanger behind the bedroom door. Curly, with a few hairs extracted from the notch of the blade. A total of 43 biological samples were extracted at the scene, and no other suspicious traces were found.
2. Forensic examination
   After a preliminary forensic examination, more than 20 strip-shaped cut wounds were seen on the left temporal part of the head and neck of the corpse, and no other injuries were found on the corpse. The cause of death of the deceased was traumatic brain injury combined with hemorrhagic shock. The stomach content of the deceased was 500ml, which contained rice, vegetable leaves, sliced meat, etc. It is estimated that the time of death was about 3 days, about 1 hour after the meal.
3. Access
   (1) Reporter Xu Hongxi reported that since December 31, 2011, the mobile phone given to her father Xu Deyin has been turned off for several consecutive days. At about 15:40 on January 3, 2012, Xu Hongxi and her sister Xu Hongling rushed to the scene’s home from Tongzhou, Beijing, and found that the gate of the scene was locked. After breaking the courtyard door lock, he found that the main house door was unlocked, and the bedroom door where his father lived was locked, so he opened the door with a key placed outside the door. Later, he found his father Xu Deyin lying on the ground with a lot of blood on the ground around him, so he called 110 to call the police.

(2) According to the deceased’s daughter Xu Hongling (41 years old, household registration: Xiaoguozhuang, Lugouqiao, Fengtai District, Beijing, mobile phone number: 13910574372): In early December 2011, Xu Deyin was hospitalized in Luhe, Tongzhou District, Beijing for 7 days due to heart disease. After being discharged from the hospital, he stayed at the home of his younger brother Xu Hongxi for 6 days to recuperate. Around December 15, Xu Hongling sent her father Xu Deyin back to his home in Da’an Mountain. Xu Deyin found that her mobile phone was forgotten at Xu Hongxi’s home, so Xu Hongling gave Xu Deyin one of her mobile phones (mobile phone number: 13247288669) for use. When Xu Deyin returned home, he carried more than 7,000 yuan in cash and a postal savings passbook (with a deposit of 20,000 yuan).

(3) According to Jin Baoli (male, 42 years old, from Qiaoxia Street, Beibian, Jiulong Town, Laishui County, Baoding City, Hebei Province, China, temporary residence: Yuangang Village, Da’anshan Township, Fangshan District, Beijing, phone number: 15801457597) : The deceased Xu Deyin often found prostitutes in the local area. At the end of December 2011, while chatting with Jin Baoli, the deceased mentioned that in mid-December 2011, Liu Jun (alias “Xiaoyun”, female, 22 years old, a prostitute, from Chifeng City, Inner Mongolia Autonomous Region, China, had repeatedly contacted The deceased engaged in prostitution) and her boyfriend Liu Hongjie (male, 24 years old, from Da’anshan Village, Da’anshan Township, Fangshan District, Beijing) had gone to the deceased’s home to borrow money. At the same time, Jin Baoli reported that around December 29, 2011, the deceased claimed that three or four days earlier, Liu Hongjie and Liu Jun had brought two prostitutes to the deceased’s home, intending to occupy the deceased’s home and organize women for prostitution, but the deceased did not agree.

2. Case analysis and work deployment
   Based on the above situation, the project team analyzed that this case was a robbery and homicide for the purpose of making money. At the same time, the following work deployment is planned:

(1) Work in technical and forensic departments

1. The technical department inspects and appraises the traces and physical evidence extracted at the scene.
2. The forensic department conducts autopsy on the corpse, and conducts inspection and identification on the biological samples extracted from the scene.

(2) Investigative work

1. Visit the residents around the scene to understand the suspicious situation before and after the incident.
2. In-depth interviews with the family members of the deceased to learn about the life patterns and social interactions of the deceased.
3. Retrieve and check the surveillance video of the surrounding area of the scene.
4. Obtain the bank account information of the deceased and verify the transaction status before and after the incident.
5. Case solving
   (1) Sources of clues
   After work, Liu Hongjie and Liu Jun have been in financial difficulties recently, and they tried to borrow money from the deceased several times before the incident but failed.

Work experience: Liu Hongjie’s mobile phone (number 18801426503) contacted the deceased at 9:48 on December 31, 2011. According to the call records of 18801426503 mobile phone, another mobile phone number 15110024598 had repeatedly contacted the mobile phone by short message, and The mobile phone has arrived in Chifeng City, Inner Mongolia, China. Based on this analysis, the project team believes that Liu Hongjie and Liu Jun are suspected of major crimes, and will focus on related work.

(2) Appearance process
At about 13:00 on January 5, 2012, the task force arrested suspects Liu Hongjie and Liu Jun on the “Fang 22 Road” bus passing through Qiaomeijian Village, Da’anshan Township, Fangshan District, Beijing.

(3) Basic information of the criminal suspect

(4) Confessions
After a sudden interrogation, the criminal suspect Liu Hongjie confessed: Around December 25, 2011, Liu Hongjie told Liu Jun that the deceased Xu Deyin had a certain financial foundation and wanted to rob the deceased. Around December 26, Liu Jun came to the deceased’s home to discuss with the deceased about renting the deceased’s house to organize prostitution. On December 31, Liu Jun left Da’anshan Township, Fangshan District, Beijing, and returned to his hometown in Chifeng, Inner Mongolia, China. At about 9:00 am on January 1, 2012, Liu Hongjie came to the deceased’s home alone and discussed with the deceased about the withdrawal of the rent. During this period, Liu Hongjie suddenly became malicious and regained his desire to rob the dead. While the deceased was eating, Liu Hongjie picked up the head of the kitchen knife in the deceased’s kitchen and slashed at the neck several times while the deceased was not prepared, and the deceased fell to the ground immediately. Later, Liu Hongjie found that the deceased was still alive, so he chopped the head of the deceased again with a kitchen knife and a bench until the deceased stopped breathing. Liu Hongjie cleaned the kitchen knife and put it back in the kitchen. Later, Liu Hongjie rummaged through the deceased’s clothes and found 10,000 yuan in cash from a self-made hidden pocket inside the deceased’s long johns. Later, Liu Hongjie locked the bedroom door and courtyard door with the lock of the deceased’s house and fled the scene.
