浅析基层公安机关社会管理综合治理工作中存在的主要问题和改进意见

“三项重点工作”是中央政法委结合我国发展阶段新变化,新特点作出的一项重大战略决策,社会管理创新是解决影响社会和谐稳定的源头性、根本性、基础性问题,是推动政法工作实现科学发展的重要途径。当前,我国正处在重要的战略机遇期和人民内部矛盾凸显期,创新社会管理是更新管理理念,提高管理能力,驾驭治安局势,提升管理水平的一项系统工程。由于刑事犯罪高发和对敌斗争的复杂性,社会管理基础十分薄弱,科技化管理手段和管理方式相对落后,社会管理机制不够健全、运行不够畅通等诸多问题。能否尽快改变这种状况,不仅是对政法机关执法能力的考验,也是对我们党执政能力的考验。对此,我局社会管理综合治理办公室结合基层公安工作实践,通过深入调研,就创新社会管理谈几点粗浅认识和对策思路。
一、当前社会管理工作的现状
(一)对流动人口服务管理不到位。
对流动人口的登记、管理滞后,录入不及时,录入的信息往往滞后于人口的实际流动、鲜活度差,给管理工作带来一定的难度;流动人口管理与服务的综合配套措施不力、社会管理运作机制不协调,表现为公安、劳动、社保、计生、房管等部门之间的信息沟通不畅、未能形成合力,重复劳动多、资源浪费大,信息共享率低,普遍存在“公安一肩挑”现象,尚未形成党政主导,职能部门主抓,相关部门配合,全社会齐抓共管的综合治理格局;在出租房屋管理中“人户一致”的观念尚未完全形成,仍然存在人户分离的“死角”,一些流动人员打擦边球,成为新的治安“乱点”;同时,贴近实战的日常研判工作机制效能尚未发挥最大优势,对暂住人口和旅馆住宿人员信息的日常研判分析不够、高危人群管控滞后、方法措施不力,以致造成管控效果不佳的被动局面。
(二)特殊人群帮教管理不到位。
对刑释解教人员、在押人员未成年子女、社会闲散青少年、吸毒人员、邪教人员等高危人群的帮教制度不健全,管控措施不完善,基本情况掌握不准,缺乏有效的常态化帮教管控机制,导致管理失控和漏管,以致违法犯罪、个人极端事件、恶势力犯罪时有发生。工作中,未能建立对刑释解教人员、高危人群“无缝对接”机制,相关的政策措施落实不到位,不能形成职业化、制度化的帮教管控,导致刑释解教人员不能很好地融入社会。同时,由于社会资源整合控管机制不健全,缺乏轨迹管理,民政与监护人的共管对接失控,导致精神病人肇事惹祸违法、甚至犯罪的事件时有发生。
(三)突出问题治理不到位。
一是群体性事件时有发生。因征地拆迁、医疗纠纷、劳资债务、教师绩效等原因引起的群体性事件不断发生,此类事件突发性强、组织化程度高,历史问题与现实问题、合理因素与无理要求相互交织,给处置工作带来难度,稍有不慎就会酿成较大事端,直接危及社会政治稳定。如“瓮安事件”等近年我国几起影响较大的群体性事件均系由于先期处置不规范,导致出现“易事拖难、小事拖大、大事拖炸”。
二是社会治安形势不容乐观。目前城区盗窃摩托车、电动车、入室盗窃以及砸车玻璃盗窃,乡镇临街店铺被盗,农村盗窃家禽家畜等案件,严重影响了民众的安全感,降低了群众满意度。
三是虚拟社会管理带来了新的挑战。随着社会经济的不断发展,科技信息化步伐的加快,电脑、手机等新兴媒介的普及,网络舆情的出现,被一些别有用心的人、对社会不满的人、甚至黑恶势力、敌对分子利用,无端加以炒作,特别是对敏感问题、负面问题、群体事件等扩大事端、造谣惑众、蛊惑人心、恶毒攻击党委政府、给公安机关施压、企图制造混乱,这些都给我们的管理工作带来了新的挑战。
四是民事纠纷较为突出。其类型主要表现在邻里之间地界划分、散养牲畜、家庭琐事、务工经商为抢占地盘、争夺客户、劳资债务等引起纠纷,有的引发出打架斗殴、故意伤害、诽谤闹事甚至酿成重大刑事案件和群体性突发事件,给社会治安带来严重影响。
二、存在问题原因分析
社会管理创新是一项复杂的系统工程,社会管理中的一些矛盾,是社会消极因素和负面影响的综合反映,既有客观原因,又有主观因素,也有部门联动的误区,它是经济社会发展的必然结果,也是社会问题多年堆积产生的“积弊”,但也有些是我们工作上的经验不足,分析不准、判断失误所致。
(一)主观方面。
在经济全球化和金融危机的影响,一是人们的思想观念发生偏差,教育引导和社会控制力度不够,突发性问题的管控措施还不完善,应对能力比较薄弱。对流动人口服务管理、重点人口帮控、暂住人口登记、常住人口的全面掌握等情况还不完全到位。二是农村基层组织弱化,治保民调组织作用发挥不到位,不能及时引导教育群众,疏导化解矛盾,致使一些民间纠纷处理不及时酿成刑事案件。特别是一些少数边远地方基层干部服务意识弱化,群众观念淡薄,工作责任不强,对群众利益关心不够,山高皇帝远、官僚主义、当方土地、地头蛇思想依然存在,为民理念淡化,对待群众的切身利益看脸色说话,凭关系办事,群众怨声载道,甚至引发上访和群体性事件。三是相关法律、政策相对滞后于经济的快速发展。新兴的担保公司、开锁行业在法规政策上存在管理漏洞,甚至盲区,亟须加以规范和完善。
(二)客观方面。
一是人、财、物的大流动带来了新的社会问题。由于经济社会的快速发展,人流、物流、信息流等前所未有的规模和速度加剧,相对封闭和静态社会结构日益为开放的动态社会构架所代替,带来了流动人口管理等一系列新的社会问题;当前我国正处于政治转型、经济转轨的关键期,根据发达国家的历史经验,人均GDP在3000美元左右时,社会财富不断增加,贫富悬殊不断拉大,这个时期是刑事案件高发、人民内部矛盾凸显的关键时期。二是人们的思想价值观念出现偏颇。随着科技和信息化步伐的加快,互联网的普及,人们的理想信念、价值标准和道德观念等受西方思想文化中消极、腐朽方面以及我国封建残余思想的影响,利益取向、价值取向、文化取向出现偏差;三是受经济因素的制约,基层公安机关科技化建设水平滞后。软件方面,由于基层公安机关警力不足,非警务活动增多,对一些治安问题难以集中精力加以解决。硬件方面,由于经费短缺,装备落后,科技化手段不能适应新形势下社会管理的客观需要。
(三)联动方面。
政法部门和相关职能部门对社会管理创新的作用发挥不明显,联动机制不够健全,未能形成党委政府主导、政法部门主抓、相关职能部门联动的社会管理创新格局,形成了由政法部门搭台、公安机关唱戏,后台管理脱节的局面,没有真正形成整体格局。相关职能部门和基层党政在思想观念及组织工作上出现偏差,认为社会管理创新是政法部门和公安机关的工作,因此,缺乏社会管理创新以治本为目标的基础性工作,如何化解社会矛盾、协调服务工作、疏导教育工作、群防群治工作、违青帮教工作、宣传政策工作等大量涉及维护稳定工作都应该由职能部门和各级党政干部共同实施。但由于观念上的差别,导致相关职能部门措施不到位、服务管理不同步、创新效果不理想的被动局面。
三、深化公安工作与社会管理创新的对策思考
(一)建立健全流动人口系统管理工程。
加强流动人口管理,是一项艰巨复杂的社会工程,需要各部门齐心协力,切实承担起管理、服务的责任。一要从战略的高度重视流动人口的管理,通过加强社会治安综合治理,整合社会资源最大限度地发挥其积极作用,减少和消除负面因素。二要充分发挥乡镇街道和社区居(村)委会作用。由政府统一领导,公安牵头,乡镇街道、社区居(村)委会建立外来流动人口(出租房屋)管理机构,负责流动人口信息采集、录入工作,公安、综治部门要建立切实有效的绩效考核机制,强化日常监督,通过各级综治部门和公安机关的倒查、考查、抽查,进一步提高对流动人口的管理。三要实施流动人口融入工程。按照“以证管人、以房管人、以业管人”的要求,积极推进流动人员社会化管理工作,采取在大型企业内部和有条件的社区、建立流动人员旅馆式信息化管理系统、办理一卡通和依托房屋出租中介等社会力量采集流动人员信息,进一步加强流动人员信息化管理。把寓管理于服务之中,对流动人员广泛开展法制宣传,积极帮助其解决问题,增强认同感和归属感。四要充分依托信息化“大平台”应用,坚持向科技要警力、向信息化要效益,依托应用系统,深入开展大情报综合研判、警种专业研判、全警实时研判,挖掘违法犯罪线索,严厉打击犯罪行为。
(二)精心打造维稳保障工程。
一要建立和完善信息预警机制。牢固确立情报信息主导警务工作的理念,坚持把加强情报信息体系建设作为维护社会稳定的龙头工程来抓,充分发挥情报信息支持决策、预警和引导“打、防、控、管”功能,提高公安工作的针对性和实效性。要坚持公秘结合,大力加强秘密力量建设,不断壮大治安信息员队伍,延伸和拓宽情报信息的触角和渠道,努力获取预警性、深层次、内幕性的情报信息,及时准确地提供维护稳定的可靠资料。
二要进一步健全风险评估、公调对接、应急处置机制。围绕“大事不出乡(镇),小事不出村(社区)、邻里纠纷不过夜”的“三不”目标,依托乡镇综治部门和村委会、居委会、街道,建立三级调解组织,将纠纷及时处理在当地、化解基层,消灭在萌芽状态,努力减少民转刑案件和群体事件,进一步拓展公调对接领域,主动邀请村居干部、律师介入疑难矛盾纠纷化解,不断夯实维稳工作根基。
三要关注社会热点问题。重点加强对涉及群众切身利益的问题研究,如职工下岗分流、征地拆迁补偿、土地承包合同等热点问题,以及伴随市场经济建立和城市化进程而出现的焦点问题,要加强对人们心态、群众心理的分析把握,有针对性地加强对群众的引导、教育,特别要加强法制宣传,促使他们用合法的方式和途径表达自己的利益诉求,自觉维护发展稳定大局,对发生的各类突发性事件,要坚持快速反应,迅速查明情况,确定性质,在党委、政府的领导下,积极配合有关部门,依法妥善处置,防止事态扩大和发展蔓延。
(三)实施重点人员关爱工程。
一要深入扎实开展“春风行动”工程。对辖区违法犯罪青少年、在押人员未成年子女、吸扎毒人员、社会闲散青少年等进行全面调查摸底,以属地派出所为主,其他相关部门配合,与违法犯罪青少年结对,定期上门走访,了解思想动态,积极协调有关部门,帮助解决上学、就业等问题,严防其重新走上违法犯罪道路,对肇事惹祸精神病人和特殊高危群体,要积极与民政部门和精神病院协调联系,努力从根本上消除隐患。
二要大力实施刑释解教人员转化工程。加强与司法部门协调配合,依托社会力量,对全县刑释解教人员逐一登记造册,落实管理责任和措施,帮助其解决实际困难,使其回归社会,最大限度地减少社会对立面。同时,对刑释解教中的重点人员进行分层管控,及时、准确将人员信息录入“大平台”,实施网上动态管控,重点关注扬言报复社会、可能铤而走险的人员,严密管控措施,防止发生突发问题和群体事件。
三要对重点信访人员实施关爱工程。以“大调解为契机”,深入基层、深入群众,掌握了解涉法人员思想动态,着力解决具体问题和困难,要真正从解决实际问题上着手,从群众切身利益上关心,从帮助生活困难上关爱。有效杜绝和减少涉法进京赴蓉案件。
(四)大力实施立体打防工程。
一要建立全时候、网络式、动态化巡防体系,最大限度的囤警街面,囤警重点地段、重点区域,提高群众的见警率,开展全时空、动态武装巡逻,通过面上防范控制、重点单位巡查守护、强化盘查检查、加大打击力度,全面挤压犯罪空间,以公安为主,社会力量为辅,借助各种社会资源,发挥单位保卫、大型超市、小区保安力量和社区“红袖标”义务巡防队的作用,不断完善治安防控体系建设,努力构建立体式防控网络。
二要建立和完善常态化“严打”工作机制。坚定不移地贯彻“严打”方针,始终保持对刑事犯罪活动的主动进攻、持续打击的高压态势。在打击的重点上,要以杀人、强奸、抢劫、爆炸、绑架等严重刑事犯罪,以及黑恶势力犯罪、经济犯罪为主攻方向,努力多破案、快破案、破大案。在打击方式上,要坚持“什么犯罪突出,就重点打击什么犯罪,什么方式更为有效,就采取什么方式”的原则,因地制宜地开展有针对性的、区域性的、短平快式的专项打击,以点带面解决问题。在打击的手段上,要大力加强刑事情报、刑事技术等基础工作和专门手段建设,不断拓展由人到案、由线到案、由物到案的侦破工作新途径,切实提高整体效能。
三要严厉打击网络犯罪。进一步强化虚拟社会管理,进一步加大对网上赌博、网上诈骗、网络淫秽色情等新型网络违法犯罪的打击力度,做到深入研究、依法惩治、综合治理。对一些别有用心的人通过网络来抨击政府,散布谣言等违法行为,要敏锐反应、追根溯源、依法惩治。
(五)全力推进队伍规范管理工程。
坚持政治建警、科技强警、素质兴警、从严治警和从优待警的方针,全面加强队伍思想建设、组织建设、作风建设、廉政建设,确保公安队伍“效率最高、业绩最佳、服务最优、形象最好”,全面建立和谐的警民关系。
一要通过专项教育活动、轮值轮训、学习专栏、自学等多种形式,开展“读书明志”和每月学法活动,在学习中拓宽视野、增强本领、开阔胸襟、提高修养,建设学习型警营。
二要紧紧围绕加快发展这个大局,以行业评议为载体,不断改进和加强公安行政管理工作,建设效能型机关。
三要以典型引导、提高待遇等方式,激励队伍适应时代发展、勇于接受挑战、善于开拓创新,用新理念来提出新思路、用新举措来应对新情况、用新办法来解决新问题,建设创新型集体。
四要以完善惩防体系为重点,严格落实党风廉政建设责任制,深入开展反腐倡廉宣传教育,强化权力运行监督,毫不动摇地抓好“五条禁令”等制度的执行,进一步严肃警纪、整顿警风,建设纪律型队伍。以规范化管理为目标,全面提升公安民警社会管理创新的能力和水平。

Due to the high incidence of criminal crimes and the complexity of the struggle against the enemy, the social management foundation is very weak, the technological management methods and management methods are relatively backward, the social management mechanism is not perfect, and the operation is not smooth enough, and many other problems. Whether this situation can be changed as soon as possible is not only a test of the law enforcement capabilities of political and legal organs, but also a test of our party’s ability to govern. In this regard, the Social Management Comprehensive Management Office of our bureau combines the practice of grassroots public security work, and through in-depth research, discusses some superficial understandings and countermeasures on innovative social management.
- Current status of social management work
(1) Inadequate management of floating population services.
The registration and management of the floating population lag behind, and the input is not timely. The information entered often lags behind the actual flow of the population, and the freshness is poor, which brings certain difficulties to the management work; The management and operation mechanism is uncoordinated, which is manifested in the poor communication of information among the departments of public security, labor, social security, family planning, housing management, etc. The phenomenon of shoulder-to-shoulder” has not yet formed a comprehensive governance pattern in which the party and the government lead, functional departments take the lead, relevant departments cooperate, and the whole society jointly manages; Separation of “dead corners”, some migrants have become a new “disorder” of public security; at the same time, the efficiency of the daily research and judgment working mechanism close to actual combat has not yet exerted its maximum advantage, and the daily research and judgment of the information of temporary residents and hotel occupants is not enough. , The management and control of high-risk groups lags behind, and the methods and measures are ineffective, resulting in a passive situation of poor control effects.
(2) The management of help and education for special groups is not in place.
The system of assistance and education for high-risk groups such as released prisoners, minor children of detainees, socially idle youths, drug addicts, cult members, etc. is not perfect, the control measures are not perfect, the basic situation is not accurately grasped, and there is a lack of effective normalized assistance and education control mechanism , leading to loss of control and leakage of management, resulting in illegal crimes, extreme personal incidents, and crimes committed by evil forces. In the work, it failed to establish a “seamless docking” mechanism for prisoners released from prison and high-risk groups. The relevant policies and measures were not implemented in place, and professional and institutionalized help and education management and control could not be formed. integrate into society. At the same time, due to the imperfect control mechanism for the integration and control of social resources and the lack of track management, the co-management of civil affairs and guardians is out of control, resulting in frequent incidents of mental patients causing troubles, breaking the law, and even committing crimes.
(3) Insufficient management of prominent problems.
One is that mass incidents occur from time to time. Mass incidents caused by land expropriation and demolition, medical disputes, labor debts, teacher performance, etc. continue to occur. Such incidents are sudden and highly organized. Historical issues and practical issues are intertwined, reasonable factors and unreasonable demands. Handling the work brings difficulties, and a little carelessness will lead to major incidents, directly endangering social and political stability. For example, the “Weng’an incident” and several large-scale mass incidents in my country in recent years were all due to irregular early handling, resulting in “easy things procrastinated, small things protracted, and major events procrastinated.” Second, the social security situation is not optimistic. At present, the theft of motorcycles, electric vehicles, burglary and car glass theft in urban areas, the theft of shops facing the streets in towns, and the theft of poultry and livestock in rural areas have seriously affected the public’s sense of security and reduced their satisfaction. Third, virtual society management brings new challenges. With the continuous development of social economy, the acceleration of the pace of information technology, the popularization of new media such as computers and mobile phones, and the emergence of Internet public opinion, it is used by people with ulterior motives, people who are dissatisfied with society, and even evil forces and hostile elements. Unwarranted hype, especially sensitive issues, negative issues, mass incidents, etc., to expand incidents, spread rumors to confuse the public, deceive people, viciously attack the party committee and the government, put pressure on the public security organs, and attempt to create chaos. new challenges. Fourth, civil disputes are more prominent. Its types are mainly manifested in disputes caused by the division of boundaries between neighbors, free-range livestock, household chores, occupation of land for work and business, competition for customers, and labor and capital debts. Cases and mass emergencies have seriously affected social security.
- Analysis of the cause of the problem
Social management innovation is a complex systematic project. Some contradictions in social management are a comprehensive reflection of negative social factors and negative impacts. There are both objective reasons and subjective factors, as well as misunderstandings of departmental linkage. The inevitable result of social problems is also the “accumulated disadvantages” caused by the accumulation of social problems for many years, but some of them are caused by our lack of work experience, inaccurate analysis, and wrong judgments.
(1) Subjective aspect.
Influenced by economic globalization and the financial crisis, firstly, people’s ideology has deviated, education guidance and social control are not strong enough, management and control measures for emergencies are not perfect, and the ability to deal with them is relatively weak. The management of floating population services, the assistance and control of key populations, the registration of temporary residents, and a comprehensive grasp of the permanent population are not yet fully in place. The second is the weakening of grassroots organizations in rural areas, and the role of public opinion polls on governance and security is not fully played. They cannot guide and educate the masses in a timely manner, and resolve conflicts. As a result, some civil disputes are not handled in a timely manner and lead to criminal cases. In particular, grassroots cadres in some remote areas have weakened service awareness, weak concept of the masses, weak work responsibilities, and insufficient concern for the interests of the masses. Vital interests speak according to face and act on the basis of relationships, the masses complained, and even led to petitions and mass incidents. Third, relevant laws and policies lag behind the rapid economic development. There are management loopholes and even blind spots in the regulations and policies of the emerging guarantee companies and the lock-picking industry, which urgently need to be standardized and improved.
(2) Objective aspect.
First, the large flow of people, money, and goods has brought new social problems. Due to the rapid development of the economy and society, the unprecedented scale and speed of the flow of people, goods, and information has intensified. The relatively closed and static social structure is increasingly replaced by an open and dynamic social structure, which brings a series of new social problems such as the management of floating population. At present, our country is in a critical period of political transition and economic transition. According to the historical experience of developed countries, when the per capita GDP is around 3,000 US dollars, social wealth continues to increase and the gap between rich and poor continues to widen. A critical period in which contradictions emerge. The second is that people’s ideological values are biased. With the acceleration of the pace of technology and informationization, and the popularization of the Internet, people’s ideals, beliefs, value standards, and moral concepts are influenced by the negative and decadent aspects of Western ideology and culture, as well as the remnants of feudalism in my country. The interest orientation, value orientation, and cultural orientation There are deviations; the third is restricted by economic factors, and the level of scientific and technological construction of grassroots public security organs lags behind. In terms of software, due to the lack of police force in grass-roots public security organs and the increase in non-police activities, it is difficult to concentrate on solving some public security issues. In terms of hardware, due to the shortage of funds and backward equipment, technological means cannot meet the objective needs of social management under the new situation.
(3) Linkage aspect.
The role of political and legal departments and related functional departments in social management innovation is not obvious, and the linkage mechanism is not perfect enough, failing to form a social management innovation pattern led by the party committee and government, led by political and legal departments, and linked by related functional departments, forming a platform set up by political and legal departments , The public security organs are singing operas, and the background management is out of touch, and the overall pattern has not really been formed. Relevant functional departments and grassroots party and government have deviations in their ideological concepts and organizational work, believing that social management innovation is the work of political and legal departments and public security organs. A large number of work related to maintaining stability, such as coordination and service work, guidance and education work, mass prevention and mass governance work, youth assistance and education work, and policy propaganda work, should be jointly implemented by functional departments and party and government cadres at all levels. However, due to the differences in concepts, the measures of relevant functional departments are not in place, the service management is not synchronized, and the innovation effect is not ideal.
- Countermeasures for deepening public security work and social management innovation
(1) Establish and improve the floating population system management project.
Strengthening the management of floating population is a arduous and complicated social project, which requires the concerted efforts of all departments to effectively assume the responsibility of management and service. Firstly, we must attach great importance to the management of floating population from a strategic point of view. By strengthening the comprehensive management of social security and integrating social resources, we should maximize its positive effects and reduce and eliminate negative factors. Second, we must give full play to the role of township streets and community (village) committees. Under the unified leadership of the government and the leadership of the public security, township streets and community (village) committees establish management agencies for floating population (rental housing) to be responsible for the collection and entry of floating population information. The public security and comprehensive management departments must establish effective performance appraisals mechanism, strengthen daily supervision, and further improve the management of floating population through back-checking, inspection, and spot checks by comprehensive management departments at all levels and public security organs. The third is to implement the floating population integration project. In accordance with the requirements of “manage people with certificates, manage people with housing, and manage people with business”, actively promote the socialized management of floating personnel, adopt the establishment of a hotel-style information management system for floating personnel within large enterprises and in communities where conditions permit, and handle One-card and relying on social forces such as housing rental agencies to collect information on migrants, and further strengthen the information management of migrants. Integrate management into services, extensively carry out legal publicity to migrants, actively help them solve problems, and enhance their sense of identity and belonging. Fourth, we must fully rely on the application of the “big platform” of informatization, insist on relying on science and technology for police power and informatization for benefits, and rely on application systems to carry out in-depth comprehensive research and judgment of big intelligence, professional research and judgment of police types, real-time research and judgment of the whole police, and dig out clues to illegal crimes. Fight crime.
(2) Elaborately create a stability maintenance project.
First, we must establish and improve the information early warning mechanism. Firmly establish the concept that intelligence and information dominate police work, insist on strengthening the construction of intelligence and information systems as a leading project for maintaining social stability, give full play to the functions of intelligence and information to support decision-making, early warning, and guide “fighting, prevention, control, and management” to improve The pertinence and effectiveness of public security work.
