关于对《拘留所法律文书（式样）（试行）》

的修改意见

公安部监管局：

《拘留所法律文书（式样）（试行）》收悉后，总队向各拘留所征求意见，并结合本市拘留所工作实际进行认真研究，现提出如下修改意见：

一、关于对《被拘留人登记表》(式样一)的意见

建议在此表中增加“主要社会关系和家庭成员姓名、住址及联系方式”栏目，便于被拘留人在拘期间突发情况后的及时联系。

二、关于对《被拘留人入所健康检查表》（式样二）的意见

建议在此表“被拘留人自述病史”栏目中增加被拘留人签名及日期；在“体表检查情况”栏目中增加检查民警签名及日期，以便明确相关管理责任。

三、关于对《被拘留人暂存物品、现金收据》（式样四）的意见

建议在此表中增加发还被拘留人暂存物品、现金时的发还人的签名及日期，便于出所时的返还工作。

四、关于《使用警械审批表》（式样十一）的修改意见

建议此表“使用械具的种类”栏目中的“脚镣”予以删除。

About the “Detention House Legal Documents (Style) (Trial Implementation)”

Amendments to

Ministry of Public Security Supervision Bureau:

After the “Detention House Legal Documents (Style) (Trial)” was received, the corps solicited opinions from each detention center, and conducted serious research in light of the actual work of the city’s detention centers, and hereby propose the following amendments:

1. Opinions on the “Registration Form for Detainees” (Form 1)
   It is suggested to add the column of “main social relations and family members’ names, addresses and contact information” to this table, so as to facilitate the timely contact of detainees in case of emergencies during their detention.
2. Opinions on the “Health Checklist for Detainees Entering the Camp” (Form 2)

It is suggested to add the signature and date of the detainee in the column of “Detainee’s self-reported medical history” in this form; add the signature and date of the inspection police in the column of “Physical Examination” to clarify the relevant management responsibilities.

3. Opinions on the “Temporarily Stored Items and Cash Receipts for Detainees” (Form 4)

It is recommended to add the signature and date of the sender when the temporarily stored items and cash are returned to the detainee in this form, so as to facilitate the return work when leaving the prison.

4. Comments on the revision of the “Approval Form for the Use of Police Equipment” (Form 11)

It is suggested that the “shackles” in the column “Types of equipment used” in this table be deleted.

The above opinions are for discretion.
