——江苏徐州市铜山区公安局创建一级拘留所工作汇报

铜山区位于江苏省北部,苏鲁豫皖四省结合部,向内环抱徐州市区,属于典型的省际结合、城乡结合区域。全区总面积2010平方公里,总人口130万,主要经济指标保持苏北第一,连续5年进入全国县域经济百强,在2011年第十一届百强县评比中位列第53位。受特殊的地理区位、复杂的社情影响,铜山一直是江苏治安复杂地区之一,全区每年立刑事案件5000多起,查处受理治安案件1万多起,处置群众集访闹事事件100多起,铜山区拘留所年均收拘人员1700人左右,比之2005年以前,年收拘量增加了2倍。
面对复杂的社会治安形势和居高不下的收拘量,贯彻执行好《拘留所条例》,全面推进管理教育新模式,充分发挥拘留所对被拘留人员的惩戒和教育作用,发挥拘留所的独特优势开展社会矛盾化解,对于维护社会长治久安,促进和谐社会建设有着极为重要的作用。铜山区拘留所按照“做区局党委放心的安全监所、做人民群众满意的服务窗口、做被拘人员教育的亲情学校”的工作目标,高标准、高定位、高水平地全力创建全国一级拘留所。
一、领导高度重视,建设提档升级,打造规范化、科技化、人性化的拘留所
实现一级拘留所的创建目标,是区局近年来的重点工作,铜山区拘留所点点滴滴的进步,离不开全所民警的奉献和付出,更离不开各级领导的关心支持。局党委多次召开专题会议,研究解决创建过程中的难点问题,副区长、公安局长刘刚多次亲临拘留所现场办公,解决创建工作中的难题;公安部监管局朱伟芳处长、省厅监管总队陈旭总队长、傅强副总队长及市局周涛副局长、宋刚支队长等有关领导更是全程跟进、强化指导,不遗余力地推进创建工作的开展。
一是配强班子优选民警。
区局党委根据拘留所原有民警队伍年龄层次偏大、战斗力不强的实际,及时调整了我所的领导班子、增加了相应的警力配备,在全局优选管教标兵、素质过硬的军转干部、有丰富的执法办案、群众工作经验的派出所民警充实到拘留所队伍中,全所现有民警9名,全部是党员,其中7名同志有派出所工作经历,5名同志是军转干部,平均年龄40岁。5名军转民警将军事化管理方法融入日常管理之中,取得了良好效果。
二是硬件建设跨上新台阶。
创建伊始,铜山区拘留所硬件设施相对不足,距离上级的要求有一定差距。区局党委按照一级所的硬件标准逐条落实完善,给予最大限度的支持,先后投入200余万元,对拘留所进行系统改造。去年对拘留所用电、用水设施进行改造,对所内功能用房进行改造,监控室、集体就餐厅、集体教育室、严管室、谈话室、询问室、会见室等功能用房全部达到部颁标准。高标准设立“社会矛盾化解工作室”和“心理疏导室”,增配警车、电脑、电视等办公装备,办公桌椅全部更新,开通远程会见系统和电化教学系统。今年再次投资一百余万元扩建办公楼和多功能集体教育室,整修拘留所食堂,并对拘室进行人性化改造,把拘留所合理划分为工作、拘留、生活、劳动等四个相对独立的区域。
三是科技投入提升工作效能。
区公安局投入20多万元,在升级监控系统的同时,完善门禁装置,增加防护网罩和广播系统,达到照明供水自动化,电教系统智能化。对在拘人员的一日作息制度进行电脑编程,使开灯、熄灯、起床、午休、做操、播放教育片和进行文体活动都实现智能化。智能化的管理系统规范了在拘人员的日常行为,也把有限的警力资源最大化地放在安全监管和教育转化工作上,大大提升了监管工作的安全系数和教育转化成效。拘留所自行研制的监室专用饮水系统不断得到改进,并在全省推广。
四是监所文化亮点纷呈。
区局对拘留所环境进行整体美化,拘留所邀请专业设计公司,对拘留所监所文化进行整体设计制作,民警还自己创作了拘留所民警之歌。所内精心制作了人生的启迪系列读本,建设了文化走廊,建立图书室,进一步丰富被拘留人员的精神文化生活,让他们学习到对自己有用的知识,树立起生活的勇气;开辟室外活动场地,筹措资金配备体能训练器材,安装室外健身器材,购置乒乓球桌、羽毛球等,根据时间、场地、气候条件,组织被拘留人员开展队列训练和广播操、拔河、羽毛球、跳绳比赛及趣味知识竞赛活动,以增长知识,丰富生活,增强身体素质和集体荣誉感,强化行为养成;印制带有“和谐社会 你我共建”文字图案的纸杯,增进与被拘留人员的交流;为方便期满出所人员携带衣物,精心制作了印有公民道德行为规范的手提袋,时刻提醒他们做一名爱国守法的公民。
二、加强制度规范化建设,充分发挥惩戒与教育作用,全力推进管理教育新模式
制度是银,落实是金。铜山区拘留所依据省厅拘留所执法细则要求,结合自身实际,将收拘谈话、安全检查、安全风险评估、管理教育、矛盾化解、提询会见、对外开放、警务公开等各个岗位、每个环节全部制度化,并不断修改完善,以制度化、标准化、流程化实现拘留所工作的规范化。
一是优选勤务模式,评估风险规范管理。
铜山拘留所设置了所领导带班、主协管教、巡视监控、收拘提询、内勤共五个岗位。按照省厅监管总队关于安全风险评估方面的要求,探索拘留所安全风险评估制度,将被拘留人员划分为普管、严管和特管三类,实行分级分类管理。在每日安全检查后,把对被拘留人员安全风险评估列入每天交接班的内容,按照风险类别,在拘人员分着红黄蓝三色号服予以标识,将拘室划分为过渡拘室、普管拘室、严管拘室和特护拘室,分别管教。每周召开一次所务会议,根据在拘人员的现实表现、案件性质、身体健康状况以及心理和精神健康状况等情况进行安全风险评估,分析一周安全风险变化情况,及时调整安全风险级别。为杜绝安全漏洞,所里制定了岗位职责标准,固化工作程序,从登记、收拘、提询、出所、会见、送物、谈话、回访等都纳入制度严格执行,提高民警的工作责任心。勤务模式改革和安全检查制度、安全风险评估制度的无缝落实,铜山区拘留所连续 6 年无安全事故发生,在全市拘留所绩效考核中连续3年位居全市前列。
二是注重实效,提高教育矫治工作针对性。
铜山拘留所把被拘留人员是否受到教育,是否知错悔改,作为衡量教育转化工作成效的首要标准。坚持每周两次大课教育,有针对性地开展法制、道德和时政等方面的教育;每周两次电化教育,讲解《治安处罚法》、《道路交通法》等法律法规,播放法制教育片,定时收看法制方面的电视节目;坚持邀请法制、禁毒、交巡警等有关单位民警根据违法类别进行分类教育。被拘留人员接受集体教育后,以拘室为单位,就“我的行为错在哪里”、“我违反了哪一条法律法规”、“我的行为对社会造成了什么危害”、“我的行为对家庭及自己造成了什么影响”等问题组织学习讨论,民警从中指导,通过倡导被拘留人员自我教育,提升认识,促进改错教育转化工作效果。拘留所还充分运用监区文化、文体活动等辅助教育,营造良好教育氛围。在被拘留人员所到之处悬挂名言警句、书画作品,时时给被拘留人员思想上的启迪。精心制作法制宣传系列读本,内容以法律法规、警示案例和心理疏导文章为主,按照在拘人员违法类型进行分发,人手一册,起到对症下药的效果。对重点人员,进行有针对性的回访教育,在传统走访的基础上,开通QQ群和远程视频会见,用信息化设备提升回访效率,巩固教育转化成果。
三是打开窗口,监管工作在“阳光”下运行。
拘留所是窗口服务单位,每天要收拘一批违法人员,要接待大量的在拘人员家属和办案民警。铜山拘留所在要求民警严格执法的同时,制定了服务社会八项承诺和服务一线办案民警八条措施。要警容严整、诚挚热情、耐心细致地对待群众的咨询和求助。定期向办案单位征求意见建议,尽可能为一线办案民警解决困难。所内设立警务公开栏,将各项制度和服务承诺等公布于众,一方面希望在拘人员及亲属严格遵守所里的规定达到统一规范管理,另一方面希望在拘人员及亲属能大胆主动监督拘留所及民警的工作。聘请人大代表、政协委员、警风监督员等为义务监督员,就监所管理和队伍管理进行监督、提出意见和建议。每月第一周举办社会开放日活动,组织人大代表、政协委员、机关企事业单位、学校、新闻媒体及被拘留人员家属参加,报告工作,征求意见。
四是积极作为,开辟第二战场惩治违法犯罪。
在确保拘留所安全稳定的前提下,铜山区拘留所不断转变观念,充分利用拘留所收拘量大,信息面广的优势,扭转拘留所深挖犯罪无作为的思想,把深挖犯罪工作作为一项重要任务融入到日常管理教育工作之中。今年以来,通过深挖犯罪获取各类线索5条,协助茅村、伊庄、吴邵等派出所查破案件4起,协助区局刑警大队打掉一个贩毒及组织卖淫团伙。其中行政拘留9人、被采取刑事强制措施7人。
三、积极担当维稳责任,主动服务发展大局,精心组织开展社会矛盾化解工作
被拘留人员中,有相当一部分是因矛盾纠纷激化而违反法律的。近年来,铜山区拘留所始终坚持在推进管理教育新模式中以社会矛盾化解工作为重点,真情感召、真心化解,切实把拘留所办成教育人、感化人、挽救人的“特殊学校”,把拘留所打造成社会矛盾化解的前沿阵地。
一是排查梳理矛盾化解重点。
把矛盾化解的重点人员划分为四类:即对党委政府及社会严重不满的人;矛盾突出,可能引发新的问题的人;弱势群体、身体心理有疾病需要特别关注的人;与公安机关有对立情绪的人。在具体实施中,采取“查、看、问、听、访”五种方法排查梳理各类入所人员。查:即查看案由,收教民警了解被拘留人员基本案情。看:即观察被拘留人员精神状况,是否有敌视、对抗等极端情绪。问:即入所谈话,了解是否有突出矛盾。听:即从同拘室人员、安全信息员中发现了解情况。访:即访问知情人、当事人,深度了解被拘留人的矛盾纠纷情况。对排查出牵涉到各类社会矛盾纠纷的被拘人员,实施综合评估、分析研判,制定矛盾化解策略、方案,真正做到了“一把钥匙开一把锁”。
二是分级包挂化解矛盾。
把重点化解的案件分为六类案件:即群体事件中违法维权案件;非法上访被拘留案件;民间纠纷引发打架斗殴案件;民事、债务纠纷引发的案件;因家庭矛盾激化引发案件及青少年因亲情缺失导致违法案件;因受处罚对公安机关不满的案件。在案件分类的基础上对社会矛盾依照对抗程度和轻重缓急进行等级划分,主要分成三个等级,一级由所领导包挂,二级由调解矛盾经验丰富的民警包挂;三级由其他民警包挂。如铜山区高某因承包山林补偿款问题与镇政府未能达成协议,先后四次进京滞留非法上访,2012年2月1日因侮辱、诽谤他人被处行政拘留10日,入所后拒绝饮食。管教民警迅速启动化解预案,经过多次谈话教育,高某的思想逐渐转变,表示要理性客观地看待自己遇到的问题,出所后将按照合法途径维护自己的利益,绝不会再发生违法行为。开展矛盾纠纷化解工作以来,49名因非法集访、上访被拘留人员,均得到有效教育转化,没有发生复访行为。
三是总结提炼矛盾化解技战法。
在开展社会矛盾化解的具体实践中,拘留所总结了矛盾化解六法。即说理式疏导化解法;亲情式教育感化法;组织同拘人员互相帮教法;请进来、走出去式帮教法;聘请公益律师提供法律服务、配合教育转化法;开展心理健康辅导法等。铜山区拘留所细划了矛盾化解工作流程,形成制度,主要分为九步:
一是排查梳理矛盾;
二是确定矛盾化解重点对象;
三是明确责任民警;
四是制定矛盾化解方案;
五是开展矛盾化解工作;
六是研究出现问题;
七是评估化解效果;
八是跟踪了解情况;
九是总结经验不足。
去年11月以来,共调解各类矛盾纠纷146起,调处成功139起,化解成功率达到了95%以上。
四、加强队伍建设,着力培育争先创优的团队精神,强力实施“素质保障工程”
围绕争创一级拘留所的目标,铜山区拘留所着力在队伍中培育创先争优的团队精神,激发了全体民警的使命感、责任感和自我提升的动力,形成了心往一处想、劲往一处使的工作氛围。
一是拘所班子以身作则。
工作成败关键看班子,没有一个团结协作、开拓创新、齐抓共管、率先垂范、凝聚力强的班子,做好工作是一句空话。铜山拘留所班子带头遵纪守法、廉洁自律,带头执行制度、规范行为,带头参加练兵培训,提升自己。做到工作在前、难事在前,出勤加班所领导多,所长最多。坚持公平正直,不徇私情,对民警队伍严管敢管,以模范带头作用,示范引导民警自觉规范自己的警务行为,不断提升队伍的管理能力。
二是培育创先争优的团队精神。
铜山拘留所班子充分发挥模范带头作用和战斗堡垒作用,充分激发和调动大家崇尚荣誉心理,鼓励民警对所内工作提建议、出主意,积极采纳并迅速落实有建设性的意见和建议,对民警取得的每次进步、每处亮点都及时表扬鼓励,业绩突出的积极向区局呈报表彰奖励,让大家看到自身的价值,在所内形成比学赶超、创先争优的浓厚氛围。坚持每周由所负责人通报民警的工作情况,每月对照考评办法对民警进行考核,并把考核的情况与奖惩挂钩,奖优罚劣,充分调动民警的工作积极性。
三是学习培训提升能力。
为切实提升队伍的战斗力,铜山拘留所围绕工作中常用、必会的技能,有针对性地开展岗位练兵、技能比武活动,以练促战。坚持每周一进行政治业务学习,邀请相关专家进行系统培训,定期对民警进行监管知识培训、测试,对传统的监管理念进行更新。为每位民警购买相关法律、心理学、国学等书籍,拓展民警的知识面,陶冶民警的情操,也为做好被拘留人员教育转化工作做好知识储备。今年是《拘留所条例》实施的第一年,《拘留所条例》是铜山区拘留所今年的重点学习内容,学习中采取了集中学习、专题讲座、以考促学等形式,并对照老的规章制度,逐条进行解析、讨论,研究制定新的规章制度,保证学习效果,全面提升规范执法水平。
四是从优待警激发队伍活力。
及时掌握民警思想动态,了解民警家庭、生活和学习等情况,对民警个人工作和生活中遇到的困难及时解决。落实民警休假制度,定期组织民警体检和外出学习考察,舒缓民警压力。民警生日送上一束鲜花、一个蛋糕和一声祝福。民警因病住院、婚丧嫁娶,拘所班子集体看望、慰问。今年三八妇女节,所里为每名男民警妻子精心订购一束鲜花,要求把向妻子献花作为一项任务完成,并要求第二天汇报任务完成情况,这种方式得到民警的一致拥护,并将此作为制度固定下来。

Computer programming is carried out on the day-to-day work and rest system of detainees, so that turning on and off the lights, getting up, taking a lunch break, doing exercises, playing educational films, and performing cultural and sports activities are all realized intelligently. The intelligent management system regulates the daily behavior of detainees, and also maximizes the limited police resources on safety supervision and education transformation work, which greatly improves the safety factor of supervision work and the effectiveness of education transformation. The special drinking water system developed by the detention center has been continuously improved and promoted throughout the province.
Fourth, there are many bright spots in prison culture.

One is to optimize the service mode, evaluate the risk and standardize the management.
The Tongshan Detention Center has set up a total of five positions for the leader to lead the shift, the chief assistant to the discipline, the inspection and monitoring, the detention and inquiry, and the back office. In accordance with the requirements of the Provincial Supervision Team on safety risk assessment, explore the safety risk assessment system of detention centers, divide detainees into three categories: general management, strict management and special management, and implement hierarchical and classified management. After the daily security inspection, the safety risk assessment of the detainees is included in the content of the daily shift shift. According to the risk category, the detainees are marked with red, yellow and blue uniforms, and the detainees are divided into transitional detainees. , general management detention room, strict management detention room and special care detention room, respectively. An office meeting is held once a week to conduct safety risk assessments based on the actual performance of detainees, the nature of the case, physical health, and psychological and mental health conditions, analyze the changes in safety risks during the week, and adjust the safety risk level in a timely manner. In order to eliminate security loopholes, the office has formulated job responsibility standards and solidified work procedures. Registration, arrest, inquiry, exit, meeting, delivery, conversation, and return visits are all included in the system and strictly implemented to improve the responsibility of the police. With the reform of service mode and the seamless implementation of the safety inspection system and safety risk assessment system, the Tongshan Detention Center has had no safety accidents for 6 consecutive years, and has been ranked among the top in the city for 3 consecutive years in the performance evaluation of the city’s detention centers.
The second is to focus on actual results and improve the pertinence of education and correction work.
The Tongshan Detention Center regards whether the detainees have been educated, and whether they have realized their mistakes and repented, as the primary criteria for measuring the effectiveness of education and transformation work. Adhere to the big class education twice a week, and carry out targeted education on the legal system, morality, and current politics; Regularly watch TV programs on the legal system; insist on inviting police from relevant units such as the legal system, drug control, traffic and patrol police to conduct classified education according to the category of violations. After receiving collective education, the detainees will use the detention room as a unit to discuss “what is wrong with my behavior”, “which laws and regulations I have violated”, “what harm my behavior has caused to society”, “what is wrong with my behavior?” What impact has it had on the family and oneself” and other issues organized study and discussion, and the police guided them to promote the self-education of detainees, improve their understanding, and promote the transformation of error-correcting education into work effects.
