各位领导:

    我发言的题目是:《积极担当责任、主动服务大局,以社会矛盾化解打开拘留所工作新局面》。

徐州市铜山区位于江苏省北部,环抱徐州市区,全区人口130万,2011年全国百强县排名53位,并通过小康县验收。受特殊的地理区位、复杂的社情影响,铜山一直是江苏治安复杂地区之一。铜山区拘留所历经2次搬迁,2006年搬迁至现址。全所现民警9名,标准化拘室10间,年收拘量1700余人。随着经济社会的不断发展,各类社会矛盾也愈发突出,对公安工作提出了更高的要求、更新的课题。近年来,特别是今年4月份省厅总队《关于在全省拘留所积极开展社会矛盾化解工作的通知》下发后,我所主动围绕公安中心工作,积极服务社会稳定大局,进一步创新理念,强化措施,积极开展社会矛盾化解工作,用真诚融化对抗、用真心化解矛盾、用真情感召良知,有效化解了一批社会矛盾纠纷,教育转化了一大批违法人员,取得了良好的法律效果和社会效果,为维护社会和谐稳定作出了积极贡献。省厅监管总队陈旭总队长视察工作时对我所社会矛盾化解的做法予以充分肯定。公安部监管理局赵春光局长在《江苏公安监管工作》第6期刊登的《善于组织谋划 善于组织推动 ——铜山区拘留所开展社会矛盾化解工作成效显著》上批示:“徐州市铜山区拘留所在对被拘留人员进行教育感化工作中,十分重视化解社会矛盾工作,取得良好效果,可学习借鉴我们的工作成效还得到区委区政府的充分肯定,区政府给拘留所记集体三等功一次,区政法委以简报的形式编发了我们的事迹。我们的主要做法是:

一、从人民群众需要和拘留所工作实际出发,以全新的理念做好矛盾纠纷化解工作

随着《拘留所条例》颁布实施,今年初,省厅提出在全省拘留所积极开展社会矛盾化解的新要求。我们深切感到拘留所工作模式、职能和任务均发生了深刻的变化。必须要以全新的理念做好拘留所工作,才能提升人民群众对公安工作的满意度、才能顺应时代发展的要求。

一是提升认识高度。

铜山区拘留所日均关押量30余人,高峰期70余人。被拘留人员中,有相当一部分是因矛盾纠纷激化而违反法律的。对2011年以来我所拘留的2980人中,我们作了粗略统计,因各种矛盾纠纷激化而违法被拘的约占总数的20%。 这些人入所后,有的对抗情绪激烈、有的消极沮丧,人被拘留了,问题还没有解决,矛盾还未化解,长期累积,势必影响社会和谐、影响警民关系。拘留是违法与犯罪之间的一道警戒线,教育转化好被拘留人员对减少违法犯罪有着特别重要作用。由于受到法律的惩戒,被拘留人员入所后,心理处于震动变化时期,加之相对充裕的时间空间,为拘留所做好被拘留人员的教育转化、矛盾化解工作提供了有利时机和条件,我们必须充分利用这些有利条件,坚持“管教结合,以教为先”,更新理念,发挥优势,积极作为,为维护社会稳定,促进社会和谐,作出拘留所应有的贡献。

二是提高能力水平。

我们把社会矛盾化解工作作为拘留所重点工作抓紧抓实,所里成立了“社会矛盾化解工作领导小组”。通过组织学习讨论,进一步提高民警对开展社会矛盾化解工作重要意义的认识和理解。只有带着真诚关爱之心,掌握沟通、调解技巧,善于分析解决问题,才能做好矛盾化解工作。我们要求民警既要当好管教民警,又要当好被拘留人员的朋友、亲人和老师。并邀请有着丰富调解经验的派出所民警讲授调解技巧,邀请心理咨询师讲解心理疏导技巧,提高民警调处矛盾纠纷的能力。

三是抓住主要矛盾。

从维护全区稳定大局和建设和谐警民关系出发,我们对被拘留人员逐人进行分析研判,将重点人员划分为四类。即对党委政府及社会严重不满的人;矛盾突出,可能引发新的问题的人;弱势群体、心理有疾病需要特别关注的人;与公安机关有对立情绪的人。根据对案情的分析,将重点案件分为六类。即群体事件中违法维权案件,非法上访被拘留案件,民间纠纷引发打架斗殴案件,民事、债务纠纷引发的案件,因家庭矛盾激化引发案件及青少年因亲情缺失导致违法案件,因受行政处罚对公安机关不满的案件。

四是注重考评激励。我所制作《社会矛盾化解登记表》,每次例会上对典型案例进行分析讲评,工作中倡导“说理执法”和教育疏导,化解被拘留人员的对抗情绪和心理压力,并把化解矛盾成效列入民警执法档案,与年底评奖立功挂钩,调动民警工作积极性和创造性。去年11月以来,共调解各类矛盾纠纷146起,调处成功139起,化解成功率达到了95%以上。全体民警深刻体会到“转化一个人,救了一家人,和谐一群人”的成功与自豪,纷纷表示将投入更多精力做好社会矛盾化解工作,力争以家庭和谐、邻里和谐、警民和谐促进社会和谐。

二、在实践中探索规律、总结方法,最大限度地提升教育转化率和矛盾化解率

在矛盾纠纷的化解工作中,我们始终坚持“一把钥匙开一把锁”,对被拘人员进行分析研判、综合评估,量身定做有针对性的矛盾化解工作措施,打一仗,总结一次。不断提高调解效率,提升调解的成功率

一是采取“查、看、问、听、访”五种方法,详细排查梳理矛盾。

查,即查看案由,了解被拘留人员基本案情。

看,即观察被拘留人员精神状况,是否有敌视、对抗等极端情绪。

问,即入所谈话时,了解是否有突出矛盾。

听,即从同拘室人员、信息员中发现了解情况。

访,即访问知情人、当事人,深度了解被拘人员的矛盾纠纷情况。

被拘留人员杨淑华,因自家门口的鱼塘要被村委建房占用,认为新建房将影响自家房屋采光及视线,在心存不满的情况下于2012年5月23日晚上进京上访,因扰乱公共场所秩序被拘留5日。入所后思想压力大,以胃不好为由拒绝进食,想不通自己一生勤劳本分,老来却被关进拘留所是件丢人的事,以后没脸见人了。在她绝食的第二天,我给她买来了山楂片、健胃消食片等物品,并给她冲好奶粉,经过拉家常式的耐心疏导及对《信访条例》的宣讲,终于解开了她的心里疙瘩,心情也愉快起来,并表示进京非访并不是自己的初衷而是受他人诱使,表示再也不钻牛角尖了,本本分分的生活。

这件事告诉我们:爱是沟通心灵的最好语言,化解创伤的最好良药。

对于失去自由的在拘人员来说,亲人是他们的牵挂和希望,更是激发他们教育转化的力量源泉。今年中秋节,我所特意安排每个在拘人员都和家人打个亲情电话,并适当延长了通话时间。当天晚上,所里专门采购了月饼和水果,我和所里民警和14名在拘人员一起度过了一个别样的中秋节。饭桌上,有泪水、有欢笑、有掌声。在拘人员对所里的民警在这样一个重大的节日里心系他们而舍小家顾大家感到万分感动。每名在拘人员都主动现身说法,剖析自己。我故意安排因邻里纠纷斗殴被拘留的杜某、胡某坐在对面,结果两个人争着向对方承认自己的错误,当掌声响起来,两人都笑着向对方伸出了手。

二是按照重点人员、案件分类,有针对性地开展教育管理工作。

我们根据拘留人员的违法性质和矛盾类别,有侧重点地开展教育管理工作,如对扰乱公共秩序的,着重开展社会公德教育;对卖淫、嫖娼、传播淫秽物品的,着重进行伦理性道德教育;对违反道路交通管理的,着重进行交通安全知识教育等。

因故意损坏其婆婆财物的被拘留人员李某,长期因琐事殴打、辱骂其婆婆,入所后恶气未消、发誓出所后要对婆婆进行报复。管教民警多次和她进行拉家常式谈话,与她探讨“百善孝为先 ”等做人的道理,并为她播放《弟子规》之恶媳妇的故事,使她逐渐有了惭愧心理,同时将她的爱人请进所里进行矛盾调解。今年3月3日是星期六,管教民警从谈心中得知,这一天是李某的生日,全所干警放弃休息,为李某定制一个蛋糕,精心设计了一场感人的生日祝福,李某深受感动,三十多年来从来没有人提过她的生日,面对民警的用心良苦,她流着泪主动要求给婆婆打电话道歉赔罪,发誓出所后改过自新,遵守孝道,重新做人。

我至今忘不掉一个6岁男孩的眼神。今年7月初,所里收拘了一名拟转收教的45岁卖淫妇女李翠侠,我了解到她家中有个六岁大的儿子和七十多岁的丈夫,一家人靠捡破烂为生,孩子到了上学的年龄,丈夫需要买药治病,犯错误只是生活所迫。这一情况深深触动了我的心,如果她被收教了,丈夫年老体弱,她的儿子谁来照顾啊?那幼小的心灵将要承受多大的创伤!我立即将她的情况向局领导汇报,申请为她变更收教措施。并专程带着米面、文具、玩具到她家走访,眼前的这个家破烂不堪,一件像样的家具都没有,当看到到访的我们和围观的人群,她儿子怯怯地直往大人身后躲,我们给他食品和玩具,他拧着身子说啥都不要,眼神中流露出恐惧、屈辱、无助甚至仇恨,说明这个孩子的自尊心在受到严重伤害。我立即驱散了围观的人群,单独和孩子聊起来,他的情绪慢慢平复下来,纯真无邪的笑容又回到了脸上。同时我们也走访了部分村民,对他们适时进行了法律知识的宣传,劝说群众不仅不要对李某家庭歧视,还要主动献爱心帮其解决困难。回去的时候,走出很远了,我还觉着背后有一双眼睛在看着我,一回头,远远看到孩子扭过了小脸。我心头一酸,眼泪禁不住夺眶而出……我虽然没有看到他的眼神,但我知道那眼神中隐含着的渴望,渴望理解、尊重、爱护,渴望阳光一样的童年。

   在我们的积极协调下,有关部门给这个家庭办理了低保、为孩子上报了户口。出所回家的日子,李翠侠止不住的流泪,紧紧握着民警的捐款,哽咽着连连向我们鞠躬致谢,她没想到自己一个违了法的人,还能够受到拘留所如此关爱,当即表示:今后一定遵纪守法,靠自己双手劳动,改善生活。

  给弱者以温暖,给失足者以信心和希望,激发社会正能量,不正是我们人民警察的职责所在吗!孩子的眼神时刻提醒着我,要用爱心、真心唤醒被拘留人员,让他们看到生活的美好和希望,做一个遵纪守法公民。

三是根据矛盾纠纷轻重缓急程度,及时开展分级分类化解。

我们把梳理出来的矛盾纠纷划分为家庭矛盾、社会矛盾等类别,并划分为三个等级,一级由所领导包挂,二级由具有丰富调解矛盾经验的民警包挂,三级由管教民警包挂。通过专人负责、建卡归档等措施,进一步明确民警在矛盾化解中的职责和任务,有效调动全所民警做好矛盾化解工作的积极性和主动性。因卖淫被二次拘留的周某,拟裁定收教,入所后精神恍惚、拒绝进餐。经谈话了解,周某祖籍四川,家境贫寒,嫁入本地后,丈夫又因病去世,生活所迫才误入歧途,被拘留后家中只剩下一双年幼的子女,已经有一天多无人照顾,担心儿女安危。管教民警了解这一情况后,及时向所领导报告。所里经研究认定该矛盾为一级矛盾,立即向局领导汇报周某的情况,同时组织民警赶往周某家中查看。在破旧不堪的出租房中,周某一双四、五岁大的儿女挂着满脸的泪珠趴在床沿,眼中满是饥饿和恐惧。民警们含泪抱起孩子,带着他们到所内与周某会见,并安排食堂为两天未吃饭的孩子做了可口的饭菜,当周某看到孩子狼吞虎咽的样子,终于露出了久违的笑容。同时一方面积极协调有关部门变更收教措施,一方面与当地村委联系安排专人照顾孩子。这一系列人性化措施使周某感动万分,感激政府的宽大处理和拘留所的亲情关爱,并主动向管教检举揭发了一起涉娼案件,并保证出所后振作精神、重新做人。

四是根据成功做法和经验,总结了矛盾化解六技法。

即说理式疏导化解法,亲情式教育感化法,组织同拘人员朋友式互相帮教法,请进来、走出去式帮教法,聘请公益律师配合教育转化法,开展心理健康辅导法等。提起高修峰,各级信访部门无人不晓,为了上访引起注意,四十来岁的他特意留满长长的胡须,人称“大胡子”。因承包山林补偿款问题与镇政府未能达成协议,“大胡子”十多年间先后六次进京滞留非法上访,无数次对当地政府纠缠不休,并多次被拘留。2012年2月1日因对当地政府人员侮辱、诽谤他人被处行政拘留10日,入所后拒绝饮食。管教民警向所领导汇报后,迅速启动化解预案,进行“说理式”化解。一方面对高某进行法律法规的教育,另一方面在日常生活上对其给予适当照顾,落实人性化管理措施。我们苦口婆心的劝解他:“40来岁的你看上去像是70多岁了,一个男人最好的年龄都浪费在了一口气上,到底累不累,值不值?靠你的执着劲、坚韧劲,做企业可能早成大老板了,这十几年一家人都被你拖累苦了吧…”经过动之以情,晓之以理的针对性疏导教育,他眼圈发红,低下头,半天不说一句话。我趁热打铁,接着和他一起探讨如何通过法律途径解决问题。聊了几个小时,“大胡子”说饿了,民警赶紧把热乎乎的饭菜端进来,看着他狼吞虎咽的样子,虽然我们自己也没吃饭,但感觉心里轻松极了。同时邀请律师及信访、当地政府、派出所等部门领导进所与其心平气和地面对面沟通,协商彻底解决问题的办法。这一举措使高某感受到了政府和公安机关的关怀,想到多年的上访给自己和家庭带来的负担和伤害,第一次有了惭愧之心,他没想到这次被拘留的短短几天能解开自己十几年的心结,表示出所后将理性客观地看待自己的问题,以阳光、平和的心态好好生活,绝不会再发生违法行为。

后来,通过电话回访,知道大胡子的问题已圆满解决了,只是到现在还不知道他的胡子剃了没有。

近两年,我所共收拘了高修峰这类人员40多名,通过我们的教育转化,实现了百分百息访,为社会和谐稳定作出了应有贡献。

三、调动各方力量、加大内外宣传,努力形成社会矛盾化解工作合力

开展被拘人员的教育管理是法律赋予监管场所的一项重要任务,做好被拘人员教育转化和矛盾化解工作,必须整合多种资源、吸纳社会力量,才能收到最佳的法律效果和社会效果。

一是加强软硬件建设 。

近年来,铜山区局党委高度重视拘留所工作,先后投入30余万元,设立了“社会矛盾化解工作室”和“心理疏导室”,增配了警车、电脑、电视等装备,开通了远程会见系统和电化教学系统,大大改善了被拘留人员的生活、学习环境。同时调整充实警力,全所现有干警9名,民警平均年龄不到40岁,为做好被拘人员的教育感化和社会矛盾化解工作打下坚实基础。根据被拘人员文化普遍偏低的实际,我们对集中教育课程进行精心编排,把道德伦理、文明礼仪知识讲座,感动中国人物、道德模范事迹报告,治安处罚法,心理健康知识辅导作为必修课,根据违法类别,编写被拘留人员系列教育读本,提高教育的针对性。我们对拘室内环境进行人性化改造,每天利用广播系统定时播放轻音乐,努力营造有利于教育转化的人文环境,收到很好效果。近期,区政府投入200余万元,为拘留所扩建了高标准的办公区和多功能集体教育室,本底前将投入使用。

二是形成联动力量。

我们与办案单位携手,共同做好被拘人员矛盾纠纷化解工作,每周利用区局研判例会,及时与办案单位沟通教育转化工作情况。在矛盾纠纷化解中,我们邀请请其亲人、当事人、社区、村组负责人、单位领导、信访部门参与调解工作,增强解决问题能力和说服化解能力。我们还建起拘留所网上QQ群,开通法律咨询热线,并聘请了律师提供法律服务。在所内及所外聘请心理疏导医生4人,在多起案件的调处中,我们采取监所管教与心理医生共同教育疏导,所内被拘人员与所外另一方当事人员同步劝说的方式,形成强大合力,大幅度提高了矛盾化解的成功率,同时提升了公安机关在人民群众中的形象与威信。

三是做好内外宣传。

以宣传来促进工作、争取支持和营造拘留所发展环境十分重要。2011年以来,《人民公安报》、《江苏法制报》、《徐州日报》等媒体先后刊发铜山区拘留所先进事迹稿件9篇,在区局以上公安网站发表信息简报40余篇。我们开展社会矛盾化解工作得到各级领导的重视,得到区委区政府的肯定和支持,公安部监所管理局赵春光局长两次批示肯定我们的做法。宣传也使拘留所民警感到作为一名监管民警而光荣和自豪,从而激发出更高工作热情,更加坚定做好工作的信心。2010年以来,有两名同志各荣立三等功一次,一名同志被授予徐州市三八红旗手,专职管教苏海洋同志被市局评为标兵民警。

各位领导、各位同行,我们在社会矛盾化解工作中做了一些工作,取得一点成绩,但与兄弟单位相比,我们还存在很多不足。我们将以这次培训会为契机,认真学习会议精神,学习兄弟单位好的经验,把我们的工作做好。

Tongshan District, Xuzhou City is located in the north of Jiangsu Province, surrounded by Xuzhou City, with a population of 1.3 million. In 2011, it ranked 53rd among the top 100 counties in the country, and passed the acceptance of Xiaokang County. Affected by the special geographical location and complex social conditions, Tongshan has always been one of the complex areas in Jiangsu. The Tongshan District Detention Center has undergone two relocations, and was relocated to its current location in 2006. There are 9 policemen in the whole institute, 10 standardized detention rooms, and more than 1,700 people are detained annually. With the continuous development of economy and society, all kinds of social contradictions have become more and more prominent, which put forward higher requirements and newer topics for public security work. In recent years, especially after the “Notice on Actively Carrying out Social Conflict Resolution Work in the Provincial Detention Centers” issued by the provincial and departmental teams in April this year, our institute has actively worked around the public security center, actively serving the overall situation of social stability, further innovating concepts, and strengthening Measures to actively carry out the work of resolving social contradictions, melting confrontation with sincerity, resolving contradictions with sincerity, and appealing to conscience with sincerity, effectively resolved a number of social contradictions and disputes, educated and transformed a large number of lawbreakers, and achieved good legal and social effects , and made positive contributions to maintaining social harmony and stability.   1. Proceeding from the needs of the people and the reality of the work of the detention center, use a brand-new concept to do a good job in resolving conflicts and disputes
    With the promulgation and implementation of the “Regulations on Detention Houses”, at the beginning of this year, the provincial department put forward new requirements to actively carry out social conflict resolution in the detention centers of the whole province. We deeply feel that the working mode, functions and tasks of the detention center have undergone profound changes. It is necessary to do a good job in the work of the detention center with a brand-new concept in order to improve the people’s satisfaction with the public security work and to comply with the requirements of the development of the times.

One is to raise awareness.
Tongshan District Detention Center detains more than 30 people per day, and more than 70 people in the peak period. Among the detainees, quite a few violated the law due to intensified conflicts and disputes. Among the 2,980 detainees we have detained since 2011, we have made rough statistics, and those detained illegally due to the intensification of various conflicts and disputes accounted for about 20% of the total. After these people entered the prison, some had fierce confrontational emotions, some were negative and depressed, and some were detained. The problems and conflicts have not yet been resolved. The long-term accumulation will inevitably affect social harmony and affect the relationship between the police and the public. Detention is a warning line between violations and crimes. Educating and transforming detainees plays a particularly important role in reducing violations and crimes. Due to the legal punishment, the detainees are in a period of psychological shock and change after entering the prison, and the relatively abundant time and space provide a favorable opportunity and conditions for the detention center to do a good job in the education and transformation of the detainees and the resolution of conflicts. We must fully Taking advantage of these favorable conditions, adhere to the principle of “integrating discipline and education, and putting education first”, renew ideas, give full play to advantages, and actively act, in order to maintain social stability and promote social harmony, and make due contributions to detention.

The second is to improve the level of ability.
We regard the work of resolving social conflicts as the key work of the detention center, and we have set up a “leading group for resolving social conflicts” in the detention center. Through the organization of study and discussion, the police will further improve their awareness and understanding of the significance of carrying out social conflict resolution work. Only with a sincere heart of caring, mastering communication and mediation skills, and being good at analyzing and solving problems, can we do a good job in resolving conflicts. We require the police not only to be a good discipline policeman, but also to be a good friend, relative and teacher of the detainees. In addition, police officers from police stations with rich mediation experience are invited to teach mediation skills, and psychological counselors are invited to explain psychological counseling skills, so as to improve the police’s ability to mediate conflicts and disputes.

The third is to grasp the main contradiction.
From the perspective of maintaining the overall stability of the region and building a harmonious relationship between the police and the public, we analyzed and judged the detainees one by one, and divided key personnel into four categories. That is, people who are seriously dissatisfied with the party committee, the government and the society; people who have prominent contradictions and may cause new problems; people who need special attention from vulnerable groups and mental illnesses; people who have antagonism with the public security organs. According to the analysis of the case, the key cases are divided into six categories. That is, illegal rights protection cases in mass incidents, illegal petitioning and detention cases, civil disputes caused by fighting cases, civil and debt disputes caused cases, cases caused by intensified family conflicts, and cases of youths breaking the law due to lack of family affection. Cases of agency dissatisfaction.

The fourth is to pay attention to evaluation and incentives. Our Institute produced the “Registration Form for Resolving Social Conflicts”. At each regular meeting, we analyze and comment on typical cases, advocate “reasoning and law enforcement” and education and counseling in our work, and resolve the confrontational emotions and psychological pressure of detainees, and list the results of resolving conflicts. Into the police law enforcement files, linked with the awards at the end of the year, to mobilize the enthusiasm and creativity of the police. Since November last year, a total of 146 conflicts and disputes of various types have been mediated, and 139 cases have been successfully mediated, with a success rate of over 95%. Listening, that is, discovering and understanding the situation from the personnel in the same cell and the information staff.

Interviews, that is, interviewing insiders and parties involved, to gain an in-depth understanding of the conflicts and disputes of the detainees.

Detainee Yang Shuhua went to Beijing to appeal on the evening of May 23, 2012, feeling dissatisfied because the fish pond in front of her house was going to be occupied by the village committee to build a house. Disturbing public order was detained for 5 days. After entering the prison, I was under a lot of mental stress, and refused to eat because of my bad stomach. I couldn’t figure out that I had worked hard all my life, but it was a shame to be locked up in the detention center when I was old, and I would lose face in the future. On the second day of her hunger strike, I bought her hawthorn slices, Jianweixiaoshi tablets and other items, and prepared milk powder for her. After getting rid of the knot in her heart, she felt happy, and said that it was not her original intention to visit Beijing but was induced by others, and said that she would no longer be on the edge of the horns, and live a life of duty.

This incident tells us that love is the best language to communicate with the soul and the best medicine to resolve trauma.

For the detainees who have lost their freedom, their relatives are their concern and hope, and they are also the source of strength to stimulate their education and transformation. This year’s Mid-Autumn Festival, our institute specially arranged for each detainee to make a family call with his family, and extended the call time appropriately. That night, the institute purchased mooncakes and fruits, and I spent a special Mid-Autumn Festival with the police and 14 detainees. At the dinner table, there were tears, laughter, and applause. The detainees were very touched by the fact that the police in the prison cared about them and left their families to take care of everyone on such a major festival. Every detainee took the initiative to speak out and analyze himself. I deliberately arranged for Du and Hu, who were detained because of neighborhood disputes and fights, to sit opposite each other. As a result, the two rushed to admit their mistakes to each other. When the applause rang out, they both smiled and extended their hands to each other.

The second is to carry out education and management work in a targeted manner according to the classification of key personnel and cases.

According to the nature of the detainees’ violations and the types of conflicts, we carry out education and management work in a focused manner. For example, for those who disturb public order, we focus on social morality education; For those who violate road traffic management, focus on education on traffic safety knowledge.

Detainee Li Mou, who deliberately damaged his mother-in-law’s property, beat and insulted her mother-in-law for trivial matters for a long time. The correctional police had many family-style conversations with her, discussed with her the principles of life, such as “filial piety first”, and played her the story of the evil daughter-in-law in “Disciples Regulations”, which gradually made her feel ashamed. Her lover invited her into the clinic for conflict mediation. March 3 this year is Saturday, and the correctional police learned from the conversation that this day is Li’s birthday. Touched, no one had mentioned her birthday for more than 30 years. Facing the well-intentioned police, she shed tears and asked to call her mother-in-law to apologize and apologize. .

I still can’t forget the look in the eyes of a 6-year-old boy. At the beginning of July this year, Li Cuixia, a 45-year-old prostitute who was about to be transferred to a higher education institution, was detained. I learned that her family has a six-year-old son and a husband in his seventies. The family lives by picking up trash. The child is at school age, and the husband needs to buy medicine to treat illnesses. Making mistakes is only forced by life. This situation deeply touched my heart. If she is sent to reeducation and her husband is old and weak, who will take care of her son? What trauma that young heart will endure! I immediately reported her situation to the bureau leader and applied to change the reeducation measures for her. And made a special trip to visit her home with rice noodles, stationery, and toys. The house in front of me was dilapidated, with no decent furniture. When she saw us visiting and the crowd of onlookers, her son timidly went straight behind the adults. To hide, we gave him food and toys, but he twisted his body and said that he didn’t want anything. Fear, humiliation, helplessness and even hatred appeared in his eyes, which showed that the child’s self-esteem was seriously hurt. I immediately dispersed the crowd and chatted with the child alone. His emotions gradually calmed down, and the innocent smile returned to his face. At the same time, we also visited some villagers to publicize their legal knowledge in a timely manner, and persuaded the masses not only not to discriminate against Li’s family, but also to offer love to help them solve their difficulties. When I went back, I had walked a long way, and I still felt a pair of eyes looking at me from behind. When I turned around, I saw the child’s face turned from afar. My heart was sour, and tears burst out of my eyes… Although I didn’t see his eyes, I knew the desire hidden in those eyes, longing for understanding, respect, love, and a sunny childhood.

With our active coordination, the relevant departments have applied for the minimum living allowance for the family and registered the household registration for the child. On the day of leaving the prison and returning home, Li Cuixia couldn't stop crying, holding on to the donation from the police, and bowed to us with sobs. She never thought that a person who violated the law could receive such care from the detention center. : In the future, I must obey the law and work with my own hands to improve my life.

Isn’t it the duty of our people’s police to give warmth to the weak, give confidence and hope to those who have lost their feet, and stimulate positive energy in society! The eyes of the children always remind me to wake up the detainees with love and sincerity, let them see the beauty and hope of life, and be a law-abiding citizen.

The third is to timely carry out hierarchical and classified resolutions according to the priority of conflicts and disputes.

We divide the conflicts and disputes sorted out into categories such as family conflicts and social conflicts, and divide them into three levels. bag hanging. Through measures such as special person in charge, card establishment and archiving, the responsibilities and tasks of the police in conflict resolution are further clarified, and the enthusiasm and initiative of the police in the whole station are effectively mobilized to do a good job in conflict resolution. Zhou, who was detained for the second time for prostitution, planned to be sentenced to education. After entering the prison, he was in a trance and refused to eat. Through conversations, we learned that Zhou’s ancestral home was in Sichuan, and his family was poor. After marrying into the local area, her husband died of illness, and life forced her to go astray. After being detained, only a pair of young children were left at home. Take care of and worry about the safety of their children. After the correctional police learned about the situation, they reported it to the leaders in time. After research, the Institute determined that the contradiction was a first-level contradiction, and immediately reported Zhou’s situation to the bureau leader, and at the same time organized the police to rush to Zhou’s home to check. In the dilapidated rental house, Zhou’s four- and five-year-old sons and daughters were lying on the edge of the bed with tears on their faces, and their eyes were full of hunger and fear. The policemen picked up the children in tears, took them to the institute to meet with Zhou, and arranged for the cafeteria to cook delicious meals for the children who had not eaten for two days. When Zhou saw the child wolfing down, he finally showed a long-lost smile. . At the same time, on the one hand, he actively coordinated with the relevant departments to change the education admission measures, and on the other hand, he contacted the local village committee to arrange special personnel to take care of the children. Zhou was deeply moved by this series of humane measures. He was grateful for the leniency of the government and the family love of the detention center. He took the initiative to report a prostitution case to the prison guards, and promised to cheer up and be a new person after leaving the prison.

Fourth, based on successful practices and experiences, six techniques for resolving conflicts were summarized.

That is to say, the reason-based counseling and resolution method, the family-friendly education and probation method, the mutual help and teaching method of organizing fellow detainees and friends, the inviting in and out method of helping and teaching, the hiring of public welfare lawyers to cooperate with the education transformation method, and the development of mental health counseling methods, etc. Speaking of Gao Xiufeng, everyone in the petition departments at all levels is familiar with it. In order to attract attention to petitions, he deliberately grew a long beard in his forties, known as “big beard”. Due to the failure to reach an agreement with the township government on the issue of compensation for contracting forests, “Big Beard” went to Beijing six times to appeal illegally in more than ten years, entangled the local government countless times, and was detained many times. On February 1, 2012, he was sentenced to administrative detention for 10 days for insulting and slandering local government officials. After entering the camp, he refused to eat or drink. After the correctional police reported to the leaders of the institute, they quickly launched the resolution plan and carried out “reasonable” resolution. On the one hand, Gao Mou is educated in laws and regulations, on the other hand, he is given proper care in his daily life and implements humanized management measures. We tried our best to persuade him: “You look like you are in your 70s when you are in your 40s. A man’s best age is wasted on one breath. Are you tired? Is it worth it? Depends on your persistence, With tenacity, you may have become a big boss by running a business, and the family has been dragged down by you for more than ten years…” After targeted counseling and education with emotion and understanding, his eyes turned red and he lowered his head , Not saying a word for a long time. I struck while the iron was hot, and then discussed with him how to solve the problem through legal channels. After chatting for several hours, “Big Beard” said that he was hungry, and the police quickly brought in the hot food. Seeing him gobbling it up, although we didn’t eat ourselves, we felt extremely relaxed. At the same time, lawyers, petitioners, local government, police station and other department leaders were invited to communicate with them calmly and face-to-face, and negotiate a thorough solution to the problem. This move made Gao feel the care of the government and the public security organs. Thinking of the burden and harm that years of petitioning had brought to himself and his family, he felt ashamed for the first time. Tianneng untied his knots of more than ten years, expressing that he will look at his problems rationally and objectively after being released, live a good life with a sunny and peaceful mind, and will never commit illegal acts again.

Later, through a telephone call back, I found out that the problem of the beard had been satisfactorily resolved, but I still don’t know whether he has shaved his beard or not.

In the past two years, our institute has detained more than 40 people like Gao Xiufeng. Through our education and transformation, we have achieved 100% intermission and made due contributions to social harmony and stability.

  1. Mobilize the forces of all parties, increase internal and external publicity, and strive to form a joint force to resolve social conflicts

Carrying out the education and management of detainees is an important task entrusted by law to supervision places. To do a good job in the work of education transformation and conflict resolution of detainees, it is necessary to integrate various resources and absorb social forces in order to receive the best legal effect and social support. Effect.

One is to strengthen the construction of software and hardware.

In recent years, the Party Committee of the Tongshan District Bureau has attached great importance to the work of the detention center. It has successively invested more than 300,000 yuan to set up a “social conflict resolution studio” and a “psychological counseling room”, equipped with police cars, computers, TVs and other equipment, and opened a remote meeting system. And the audio-visual teaching system has greatly improved the living and learning environment of the detainees. At the same time, the police force has been adjusted and enriched. There are currently 9 police officers in the whole institute, and the average age of the policemen is less than 40 years old, laying a solid foundation for the education of detained persons and the resolution of social conflicts. According to the fact that the culture of detainees is generally low, we carefully arrange the intensive education courses, including lectures on moral ethics, civilized etiquette, touching Chinese characters, reports on moral model deeds, public security punishment laws, and mental health knowledge counseling as compulsory courses. According to the category of violations, a series of educational books for detainees were compiled to improve the pertinence of education. We have carried out a humanized transformation of the indoor environment, using the broadcast system to play light music regularly every day, and strive to create a humanistic environment conducive to educational transformation, which has received very good results. Recently, the district government invested more than 2 million yuan to expand the high-standard office area and multi-functional collective education room for the detention center, which will be put into use before the initial stage.

The second is to form a linkage force.

We work hand in hand with the case-handling unit to do a good job in resolving the conflicts and disputes of the detained persons, and use the regular meeting of the district bureau to communicate with the case-handling unit in a timely manner about the work of education and transformation. In the resolution of conflicts and disputes, we invite their relatives, parties, community, village group leaders, unit leaders, and petition departments to participate in the mediation work to enhance problem-solving and persuasion capabilities. We also set up an online QQ group in the detention center, opened a hotline for legal consultation, and hired lawyers to provide legal services. We hired 4 psychological counseling doctors inside and outside the institute. In the mediation of many cases, we adopted the joint education and counseling of prison discipline and psychologists, and the method of synchronous persuasion of detainees in the institute and the other parties outside the institute, forming a powerful Working together, the success rate of conflict resolution has been greatly improved, and at the same time, the image and prestige of the public security organs among the people have been enhanced.

The third is to do a good job of internal and external publicity.

Advocacy is important to promote work, build support and create an environment for detention facilities to develop. Since 2011, “People’s Public Security Daily”, “Jiangsu Legal News”, “Xuzhou Daily” and other media have successively published 9 manuscripts on the advanced deeds of the Tongshan Detention Center, and published more than 40 information briefings on the public security website above the district bureau. Our work of resolving social conflicts has attracted the attention of leaders at all levels, and the affirmation and support of the district committee and district government. Zhao Chunguang, Director of the Prison Administration Bureau of the Ministry of Public Security, gave two instructions to affirm our approach. The publicity also makes the policeman of the detention center feel honored and proud as a supervisory policeman, thus arousing higher enthusiasm for work and more confidence in doing a good job. Since 2010, two comrades have been awarded third-class merit once each, one comrade was awarded the March 8th Red Banner Bearer in Xuzhou City, and Comrade Su Haiyang, a full-time supervisor, was named a model policeman by the Municipal Bureau.
