体育馆路派出所关于胡志刚信访情况的回复

2011年4月2日,我派出所接到胡志刚信访件,称我派出所警长郭宇办事不公。他强行对治安案件进行私了,并对当事人胡志刚进行谩骂等人身攻击。接此信访后,我派出所高度重视,政委王人一亲自对此事进行处理。经询问当日值班所长王健及警长郭宇,现将情况回复如下。
一、事情基本情况
2011年3月5日9时许,胡志刚(男,1966年出生,户籍地:朝阳区磨房南里,身份证号码为:)到体育馆西路投手商店门前的便道上,看到安成才(男,吉林人,身份证:)与李三强(男,河北人,身份证:)因占道无照经营摆摊的位置问题争吵。胡志刚为帮助安成才,拿出随身携带的警用金属甩棍上前对李三强进行殴打。李三强在反抗中用拳将胡志刚的左眼部打伤。后双方被带到派出所接受调查。
3月17日,派出所民警带胡志刚与李三强到北京市法医鉴定中心进行伤检。法医认为胡志刚所带的诊断证明中证明其鼻骨的骨折为陈旧性骨折,故建议胡志刚进行相关检查。现在还未出鉴定结论,故此案还未结案。
二、关于信访情况的答复
综上,目前此案中胡志刚伤情鉴定未做出。根据治安案件办理程序,在此情况下派出所根本不可能对案件进行调解。这是办案基本常识性问题。因此我所认为,胡志刚所述不是事实。

4月17日,经北京市公安司法鉴定中心鉴定:胡志刚身体所受损伤程度为轻伤,李三强明确表示放弃伤情鉴定。双方均要求派出所调解处理此事。后民警多次为双方进行调解,但双方均未达成协议。后改为要求公安机关依法处理对方。5月19日,派出所根据案情请示分局,给予胡志刚行政拘留五日,李三强刑事拘留的处罚。
综上,当时双方伤情鉴定未作出。在此情况下,派出所不可能强行对治安案件进行私了,这是常识性问题。至于来信反映对当事人胡志刚进行谩骂等人身攻击行为,经政委王人一多方了解,未发现上述情况。

- Basic situation
At around 9 o’clock on March 5, 2011, Hu Zhigang (male, born in 1966, household registration: Mofang Nanli, Chaoyang District, ID number: ) went to the sidewalk in front of the pitcher’s store on West Gymnasium Road, and saw An Chengcai ( Male, from Jilin, ID:) quarreled with Li Sanqiang (male, from Hebei, ID:) over the location of a stall that was operating without a license. In order to help An Chengcai, Hu Zhigang took out the police metal swing stick he carried with him and beat Li Sanqiang. During the resistance, Li Sanqiang punched Hu Zhigang’s left eye. Both parties were taken to the police station for investigation.
On March 17, the police from the police station took Hu Zhigang and Li Sanqiang to the Beijing Forensic Medicine Center for injury examination. The forensic doctor believed that the diagnosis certificate brought by Hu Zhigang proved that the fracture of his nasal bone was an old fracture, so he suggested that Hu Zhigang undergo relevant examinations. The appraisal conclusion has not yet come out, so the case is not yet closed.

To sum up, Hu Zhigang’s injury assessment has not been made in this case so far. According to the procedures for handling public security cases, it is impossible for the police station to mediate the case under such circumstances. On April 17, the Beijing Public Security Judicial Appraisal Center appraised that Hu Zhigang’s body was slightly injured, and Li Sanqiang made it clear that he would give up the appraisal of the injury. Both parties asked the police station to mediate and handle the matter. Later, the police conducted mediation for the two parties many times, but neither party reached an agreement. Later, it was changed to require the public security organs to deal with the other party in accordance with the law. On May 19, the police station asked the sub-bureau for instructions based on the circumstances of the case, and imposed administrative detention on Hu Zhigang for five days and criminal detention on Li Sanqiang.
To sum up, no appraisal of the injuries of both parties was made at that time. Under such circumstances, it is impossible for the police station to forcibly conduct private investigations on public security cases. This is a matter of common sense. As for the letter reporting insults and other personal attacks on the party involved, Hu Zhigang, the political commissar Wang Renyi learned from many sources, and the above situation was not found.
