东城公安分局关于吴军信访要求工作情况的报告

分局接到市局转办的吴军信访要求后，分局领导高度重，立即责成朝阳门派出所开展工作，主要情况如下：
一、信访人的主要情况
吴军，男，41岁，身份证号：，户籍地址：江苏省涟水县红尧镇朱集村河东组，职业：原江苏建设集团公司正和广场工地塔吊信号员，电话：13240715470。
二、信访人的主要要求
朝阳门派出所在处理其与同事向林因琐事互殴一事中限制其人身自由、不调查取证、强令其单位扣其工资。
三、分局开展的主要工作
2010年7月25日9时许，朝阳门派出所民警接到北京市东城区史家胡同正和广场工地电话报警称：有人打架。民警及时赶赴现场将当事双方当事人吴军、向林口头传唤至朝阳门派出所审查。经调查：史家胡同正和广场工地塔吊信号员吴军与工地塔吊司机向林（男，1972年出生，四川省旺苍县人）在工地宿舍内因琐事发生口角，后双方互殴，吴军用肘部将向林两颗门牙打掉，经分局伤情鉴定为轻伤。事发后，朝阳门派出所民警分别对双方当事人吴军、向林进行了询问，并制作了询问笔录，同时走访现场目击者，工地工人郭飞飞、朱建成，制作了旁证材料，从走访的情况和双方当事人陈述的情况均证实吴军与向林因琐事发生口角后互殴，吴军用肘部将向林牙齿打掉的事实。后史家胡同正和广场工地负责人李强、旋岳来朝阳门派出所，提出了希望对工地工人打架一事单位自行调解处理的请求。鉴于吴军、向林均是史家胡同正和广场工地工人，此前也没有什么矛盾，事发时互殴也是一时情绪激动所致，派出所如简单处理，极有可能使矛盾升级，日后引发恶性冲突，为此，朝阳门派出所从矛盾化解和消除社会不安定因素的角度出发，同意了正和广场工地负责人就此事由单位自行调解处理的请求。随后，在工地负责人李强、旋岳的见证下当事人吴军、向林达成赔偿共识，即：由吴军一次性赔偿向林人民币8O00元作为补偿并赔礼道歉；向林写出书面保证，不再追究吴军对其殴打的法律责任。由于吴军当时所带现金不多，工地负责人旋岳当场替吴军垫付8000元人民币交给向林。上述过程双方当事人吴军、向林及工地负责人李强、旋岳均在场见证。 对于吴军在信访材料里面提出的朝阳门接警后不进行调查、限制人身自由、强令单位扣其工资等情况，经核实均与实际情况不符。

At about 9:00 on July 25, 2010, the police from the Chaoyangmen Police Station received a call from the Zhenghe Square construction site in Shijia Hutong, Dongcheng District, Beijing, saying that there was a fight. The police rushed to the scene in time and verbally summoned both parties Wu Jun and Xiang Lin to Chaoyangmen Police Station for review. After investigation: Wu Jun, signalman of the tower crane at the Zhenghe Square construction site in Shijia Hutong, and Xiang Lin (male, born in 1972, from Wangcang County, Sichuan Province), the tower crane driver at the construction site, had an argument over trivial matters in the dormitory on the construction site. Xiang Lin’s two front teeth were knocked out, which was identified as a minor injury by the branch office. After the incident, the police from the Chaoyangmen Police Station questioned both parties, Wu Jun and Xiang Lin, and produced transcripts of the interrogation. At the same time, they interviewed witnesses at the scene, construction site workers Guo Feifei and Zhu Jiancheng, and produced circumstantial evidence. The facts stated by the parties confirmed the fact that Wu Jun and Xiang Lin had an altercation over trivial matters and then fought each other, and Wu Jun knocked Xiang Lin’s teeth out with his elbow. Li Qiang and Xuan Yue, who are in charge of the Zhenghe Square construction site in Houshijia Hutong, came to the Chaoyangmen Police Station and requested that the unit mediate and handle the fight between the workers on the construction site. Given that Wu Jun and Xiang Lin are both workers at the construction site of Zhenghe Square in Shijia Hutong, there was no conflict before. Therefore, from the perspective of resolving conflicts and eliminating factors of social instability, Chaoyangmen Police Station agreed to the request of the person in charge of the construction site of Zhenghe Plaza to mediate and handle the matter on its own. Later, under the witness of Li Qiang and Xuan Yue, the persons in charge of the construction site, the parties Wu Jun and Xiang Lin reached a consensus on compensation, that is, Wu Jun should pay Lin RMB 8,000 in one lump sum as compensation and make an apology; write a written guarantee to Lin that he will not be held accountable. Wu Jun’s legal responsibility for his beating. Since Wu Jun didn’t have much cash at the time, Xuan Yue, the person in charge of the construction site, paid 8,000 yuan in advance for Wu Jun on the spot and handed it over to Xiang Lin.
