信访人基本情况：赵桂英，女，1950年出生，身份证号：，户籍地址：北京市东城区朝阳门南小街，现住址：丰台区芳星园三区。
其弟：赵中华，1953年出生，身份证号：，户籍地：西城区横二条，天坛医院工作。
反映问题：
1989年4月，赵桂英从邻居许德欣处借款3万2千元人民币，其将朝阳门内南小街住房（注：该住房为赵中华单位所分的公房，后因赵桂英住房困难，过户给赵桂英）借给许德欣，后将房契改为许德欣的名字（赵桂英称许德欣当时说是借房）。半年后，赵桂英自称曾要求再更改回来，可许德欣称当时赵桂英是卖房，不同意再改回来。当时去法院起诉，法院以无证据不予立案。后来再找证据，再起诉已过时效。该住房已于2002年危改拆迁，许德欣获得拆迁款100余万元。
赵桂英及其弟弟赵中华曾就此事到市人大、市政府、区政府、分局等部门上访，均答复该人到东城法院通过诉讼解决。但二人以当时不是卖房，是假换房，并且许德欣此换房地址（朝外吉市口二条X号）没有房源和户口，是骗取赵桂英的公房为由进行上访。由于该房屋于2002年拆迁，许德欣获得房款，赵桂英、赵中华认为此为诈骗行为，多次找派出所要求立案侦查。
上访情况：
2008年2月20日，赵桂英到北京会议中心（市人大政协会议期间）上访，被民警查获。
2008年7月1日下午15时30分许，赵桂英在东城区北京站东街413车站附近，情绪激动，扬言要到有关部门上访，后被民警查获。
2008年8月16日上午，赵桂英到日坛公园准备游行示威，后被朝阳分局治安处置队有效阻拦。据市局治安总队民警张良反映：赵桂英是受其弟赵中华鼓动而到的日坛公园准备游行，经民警工作其没有与新闻记者接触。经现场民警批评教育，该人保证不会在奥运期间闹事。后被宣武分局接回。
2009年6月1日16时30分许，赵桂英手拿白布（为60×30CM大小，上面写有“房管所假换房，20年无家可归等内容”的黑色字体）在前门楼南侧路边上访，后被查获。
2009年6月3日曾到广场附近准备反映情况，被天安门分局查获。后在市局治总的协调下，移交丰台分局方庄派出所落实现住地管理。（小区民警于实权，电话：13901285254。）
工作情况：
朝阳门派出所针对赵桂英要求按诈骗行为对（1989年其卖房屋一事）许德欣立案侦查的情况，于09年、10年将综合情况上报分局信访办。后按分局要求将此情况汇报刑侦支队经侦队，该队领导认为需报法制部门审理。法制处领导研究后要求开展补充调查工作。
按照要求我所主要做了以下工作：
2009年8月份，民警查找许德欣，发现该人户口迁至东城区东四北大街XXX号，（身份证号：）留有一电话号（86545023），经联系为空号。民警多次上门查找均无人。
2009年8月27日，小区民警谭兆云到住总拆迁办（南竹杆胡同8号楼2单元B02号）了解朝内南小街XXX号当时拆迁情况，据张**反映：2002年拆迁时，当时朝内南小街XXX号房主为许德欣，该处为货币拆迁，没有回迁。
2009年9月17日，小区民警谭兆云到东城区房屋土地经营管理中心朝阳门分中心（原朝阳门房管所，演乐胡同50号）了解情况，据王健（现朝阳门分中心房管处处长，当时南小街房管员）反映：1989年4月7日，赵桂英和许德欣双方来的房管所，因为都同意互换房屋，所以就开了换房协议，赵桂英和许德欣也都在协议上签了字。
2009年10月13日，朝阳门派出所政委吕蒙、小区民警谭兆云到东城区房屋土地经营管理中心朝阳门分中心（原朝阳门房管所，演乐胡同50号）了解情况，据刘志华（该中心副所长）反映：1989年4月7日，朝内南小街104号房主赵桂英同许德欣双方同意互换房屋，并签字开了换房条。房管部门认为双方换房时为自愿行为，并且赵桂英留有文字说明。
由于当事一方的许德欣与其家人长期分居，家人也无法与她联系，故增加查找难度。经走访了解到许德欣患有精神病，我所民警经多方查证于2010年4月取得了许德欣1997年在区残联登记的精神残疾证明。
2010年6月朝阳门派出所政委吕蒙、小区民警谭兆云到东城区人民法院了解赵桂英、赵中华诉讼情况，经查档案：2002—2003年期间，该二人起诉许德欣三次，案号为：（2002）东民字第1566号、（2003）东民字第476号、（2003）东民字第2843号，起诉东城区房屋土地经营管理中心朝阳门分中心（原朝阳门房管所）一次，案号为：（2003）东民字第4532号，在该四次诉讼过程中，赵桂英、赵中华均自行撤诉，法院未判决。
2010年8月20日，经朝阳门派出所民警多次、大量的走访做工作，最终查找到该事件的另一方当事人许德欣，经询问，许德欣反映：就南小街XXX号住房问题，当时是从赵桂英处买的，因为是公房，当时不允许买卖，所以在房管所就以换房的名义过的户，并且过户时是双方一起去的房管所，换房地址是赵桂英提供的，换房时双方都在换房条上签的字。（已对许德欣做笔录）
2010年9月25日，朝阳门派出所政委吕蒙、小区民警谭兆云到朝阳区房屋管理局第二管理所（原朝外大街房管所），了解朝外吉市口二条X号的情况，据所长刘楠反映：89年时朝外吉市口二条的房管员是崔玉敏，无张姓房管员；朝外吉市口二条X号是私房，并不归房管所管理。另外根据赵中华的相关证明材料，朝外吉市口二条X号无许德欣承租的房屋。
以上是我所针对此事的工作情况。2010年此事由分局信访协调后上报分局法制处，法制处领导阅卷后提出的补充材料意见我所已遵照完成。并按照分局工作意见再次向刑侦支队经侦队进行汇报，经侦队同志认为此案经法院受理，即属民事案件，不存在立案问题。如有刑事立案可能法院会有司法建议。
2011年全国“两会”前赵中华多次找朝阳门派出所要立案的答复，并称“两会”期间要去相关部门和找相关领导反映情况。我所本着维护稳定的目的做了一系列劝解工作，确保了“两会”期间的稳定。“两会”结束后，我所吕蒙、谭兆云同志与赵中华再次进行谈话，将工作情况和分局相关部门的工作意见告知赵中华。赵中华不满意我所的答复，坚持要见分局法制部门领导说明情况，并表示要继续上访。
以上是赵桂英、赵中华信访的全部情况。朝阳门派出所的答复赵桂英是不接受的，我所已经多次将材料报送分局。分局也协调相关部门审阅过材料，但没有安排相关部门明确接待并答复赵桂英，

In April 1989, Zhao Guiying borrowed 32,000 yuan from his neighbor Xu Dexin, and he transferred the house in Nanxiao Street, Chaoyangmen Inner (Note: This house is a public house allocated by Zhao Zhonghua’s work unit, and later transferred to Zhao Guiying due to Zhao Guiying’s housing difficulties) Lent it to Xu Dexin, and later changed the deed to Xu Dexin’s name (Zhao Guiying said that Xu Dexin said it was a loan at the time). Half a year later, Zhao Guiying claimed that she had requested to change it back, but Xu Dexin said that Zhao Guiying was selling the house at that time and did not agree to change it back. At that time, I went to court to sue, but the court dismissed the case because there was no evidence. Find evidence later, and then the statute of limitations has expired. The house was rebuilt and demolished in 2002, and Xu Dexin received more than 1 million yuan in demolition funds.
Zhao Guiying and her younger brother Zhao Zhonghua petitioned the Municipal People’s Congress, Municipal Government, District Government, Sub-bureau and other departments on this matter, and they all replied that the person should go to Dongcheng Court to resolve the matter through litigation. However, the two petitioned on the grounds that they did not sell the house at the time, but exchanged houses for a fake, and that Xu Dexin’s address (No. X, Ertiao, Chaowaijishikou) did not have a house and registered permanent residence, and that they defrauded Zhao Guiying of public housing. Since the house was demolished in 2002 and Xu Dexin got the house payment, Zhao Guiying and Zhao Zhonghua thought it was a fraudulent act and approached the police station many times to file a case for investigation.
Petition situation:
On February 20, 2008, Zhao Guiying went to the Beijing Convention Center (during the meeting of the Municipal People’s Congress and the Chinese People’s Political Consultative Conference) to appeal and was seized by the police.
At about 15:30 on July 1, 2008, Zhao Guiying was agitated near Station 413, Beijing Railway Station East Street, Dongcheng District, and threatened to appeal to the relevant departments, but was seized by the police.
On the morning of August 16, 2008, Zhao Guiying went to Ritan Park to prepare for a demonstration, but was effectively stopped by the security disposal team of Chaoyang Branch. According to Zhang Liang, a policeman from the Public Security Corps of the Municipal Bureau: Zhao Guiying was instigated by his younger brother Zhao Zhonghua to prepare for a parade in Ritan Park, but he had no contact with journalists after work by the police. In response to Zhao Guiying’s request to investigate Xu Dexin’s fraudulent behavior (in 1989 when he sold the house), the Chaoyangmen Police Station reported the overall situation to the Sub-bureau’s Letters and Calls Office in 2009 and 2010. Afterwards, the situation was reported to the Economic Investigation Team of the Criminal Investigation Detachment according to the requirements of the sub-bureau. After the research, the leaders of the Legal Affairs Department requested to carry out supplementary investigation work.
According to the requirements, I mainly did the following work:
In August 2009, the police searched for Xu Dexin and found that his household registration had been moved to No. XXX, Dongsi North Street, Dongcheng District. (ID number: ) had left a phone number (86545023), which was found to be empty after contact. The police visited the house several times but found no one.
On August 27, 2009, Tan Zhaoyun, a policeman from the community, went to the General Residential Demolition Office (No. B02, Unit 2, Building 8, Nanzhugan Hutong) to learn about the demolition situation at No. XXX, Chaonei Nanxiao Street. According to Zhang **, during the demolition in 2002, At that time, Xu Dexin was the owner of No. XXX on Chaonei South Street, and the place was demolished for currency, and there was no relocation.
On September 17, 2009, Tan Zhaoyun, a policeman from the community, went to Chaoyangmen Sub-center of Dongcheng District Housing and Land Management Center (formerly Chaoyangmen Housing Management Office, No. 50 Yanle Hutong) to learn about the situation. The above is what I am working on for this matter. In 2010, the matter was reported to the Legal Affairs Division of the Sub-bureau after the coordination of letters and visits by the branch. In accordance with the work opinions of the sub-bureau, they reported to the Economic Investigation Team of the Criminal Investigation Detachment again. The comrades of the Economic Investigation Team believed that the case was accepted by the court, which was a civil case, and there was no problem of filing the case. If a criminal case is filed, the court may have judicial advice.
Before the national “two sessions” in 2011, Zhao Zhonghua approached the Chaoyangmen police station many times to file a case, and said that during the “two sessions” he would go to relevant departments and seek relevant leaders to report the situation. My institute has done a series of persuasion work for the purpose of maintaining stability, ensuring the stability during the “two sessions”. After the “two sessions”, Comrades Lu Meng and Tan Zhaoyun of our institute had a conversation with Zhao Zhonghua again, and informed Zhao Zhonghua of the work situation and the work opinions of the relevant departments of the sub-bureau. Zhao Zhonghua was dissatisfied with our firm’s answer, and insisted on seeing the leader of the branch’s legal affairs department to explain the situation, and expressed that he would continue to appeal.
