朝阳门派出所关于丽食员工信访问题工作报告

2012年2月20日,我所接京崇公信2012003894号信访批阅单,批阅单内容为朝内大街192号东单明珠受损餐饮店员工致北京市市长的一封公开信,反应该餐厅员工被打,物品受损,要求政府惩治肇事者。经联系丽食餐厅副经理王彦,其称餐厅员工没有向市长信箱发过公开信。我所现将了解详情报告如下:

位于北京市东城区朝内大街192号东单明珠中外名酒商城是一座六层长方形建筑,总建筑面积26000平方米。该建筑设有两部直梯和两部滚梯,消防通道两处分别设在东西两侧。物业经营方为北京东单明珠中外酒商城有限公司,资产所有权属东城区国资委。该建筑正门向北面临大街,丽食餐厅位于其六层,全称北京鱼为先餐饮有限公司丽食餐厅,经营面积3000余平米,经营以山东海鲜类菜品为主。

一、双方矛盾

2009年北京鱼为先餐饮有限公司在朝内大街192号开办丽食餐厅,餐厅开办之初,朝内大街东单名酒商城商户较少,酒城方为此按照投资方要求提供一些便利,其中包括租金方面的优惠,使用专用电梯,停车场停车位使用等项目,双方签订5年期合同,后由于各种原因,如租金方面、及随着商城客户增加等原因,尤其是物业领导与丽食现经营者出现矛盾,双方关系比较僵。2011年物业与丽食餐厅协商,要求丽食开放其使用的专梯,遭到丽食方面拒绝。物业将原直达6层专梯,改为公用梯。此引发丽食餐厅不满,其员工将电梯控制台破坏,致使该电梯不能使用。1月29日 物业方下达通知,要求与丽食法人倪岩对话,但未得到对方回复,物业与丽食多次谈判未果,双方越谈越僵,物业方准备维修电梯(电梯控制室在六层),丽食方不让物业人员维修,丽食方还用方钢将楼梯消防通道封闭,于是,物业对6层实施停水停电,双方处于僵持状态。

二、27日双方冲突情况

今年2月7日17时许,物业工作人员及外请40余名保安人员,携带消防检查监督检查记录单和消防责令改正通知书,要求拆除消防通道内丽食设置隔离护栏,丽食方面拒绝拆除,丽食员工与物业及保安发生冲突,丽食员工用酒瓶和消防水龙头隔着护栏向楼梯内物业人员投掷喷洒,物业使用干粉灭火器向里喷射,后物业人员从另外入口进入丽食六楼,双方发生部分肢体冲突,据事后双方负责人讲各有受伤情况(后经核实丽食餐厅3人头部受伤缝合,物业1人手骨骨折),经民警询问双方受伤情况并不是很重但均未来派出所报案。民警接双方人员报警,迅速赶往现场,并迅速控制住局面,将双方人员分离,目前丽食方面有76人(男45、女31)均在经营场所内,当事双方又回到事发前状态。

三、处理情况

此情况发生后,我所高度重视此事件,并将事态进展上报分局和街道工委,对于现场相关人员带回派出所进行详细询问,同时开展相关取证工作

   2月7日,东单明珠物业员工与丽食餐厅员工发生冲突后,派出所值班所长立即带领民警到现场进行处置,朝阳门街道办事处主任陈志坚、派出所所长王毅均到现场工作。现场民警将冲突双方隔离,对现场进行录像取证,并将现场部分人员带回派出所审查。冲突双方受伤人员均自行到医院就诊。民警通知受伤人员救治诊断后到派出所接受询问调查,但均未来派出所。派出所对双方单位负责人进行告诫,不得发生治安问题,纠纷一事可通过法律途径解决。民警让丽食餐厅店长通知其法人到派出所接受调查,但该餐厅的店长及法人均未来派出所。民警对带回派出所的13名当事人进行了逐一询问,物业负责人在接受调查中明确表示:愿意承担在此次冲突中受伤的双方员工(丽食餐厅有3名员工头部缝针,物业方受伤人员未来派出所)的医疗费用。东单明珠物业员工与丽食餐厅此前在纠纷过程中,派出所将了解掌握的情况均已及时上报。丽食餐厅在经营场所内的私搭乱建及用焊接方钢将消防通道封堵的情况仍未解决。丽食餐厅员工10余人在其店长的带领下也曾两次到区政府反映情况,区信访办及办事处领导给双方开过协调会,但双方仍坚持自身观点,调解工作无法进行。

2月9日,分局组织消防支队、治安支队、朝阳门街道办事处及派出所依照《中华人民共和国消防法》责令当事双方拆除消防通道内障碍物,打通消防通道,消除消防隐患,同时,责令物业供水供电。

2月10日,市局组成项目组对东单明珠中外名酒商城与丽食餐厅冲突事件进行立案调查,现市局项目组已控制相关涉案人员,案件目前正在全面审查过程中。

The main entrance of the building faces the street to the north, and the Lishi Restaurant is located on the sixth floor. Its full name is Beijing Yuweixian Catering Co., Ltd. Lishi Restaurant, with an operating area of more than 3,000 square meters. It mainly operates Shandong seafood dishes.

  1. Contradictions between the two sides
    In 2009, Beijing Yuweixian Catering Co., Ltd. opened a Lishi restaurant at No. 192 Chaonei Street. At the beginning of the restaurant, there were few merchants in the Dongdan Famous Wine Mall on Chaonei Street. For this reason, the wine city provided some conveniences according to the requirements of the investors, including The preferential rent, the use of special elevators, the use of parking spaces in the parking lot, etc., the two parties signed a 5-year contract. Later, due to various reasons, such as rent, and the increase in customers in the mall, especially the property management and Lishi Now there is a contradiction between the operators, and the relationship between the two parties is relatively stiff. In 2011, the property management negotiated with Lishi Restaurant and asked Lishi Restaurant to open the special elevator used by Lishi Restaurant, but Lishi Restaurant refused. This caused dissatisfaction at Lishi Restaurant, and its employees destroyed the elevator console, making the elevator unusable. On January 29, the property owner issued a notice requesting a dialogue with Ni Yan, a legal person of Lishi, but did not receive a reply from the other party.   2. The conflict between the two sides on February 7
    At about 17:00 on February 7 this year, the property staff and more than 40 security personnel invited from outside, brought the fire inspection supervision and inspection record sheet and the fire order correction notice, and asked to remove the isolation fence set up by Lishi in the fire exit. Lishi refused. During the demolition, there was a conflict between the employees of Lishi and the property and security. The employees of Lishi used wine bottles and fire hydrants to throw spray at the property personnel in the stairs through the guardrail. Building, some physical conflicts occurred between the two parties. According to the person in charge of both parties after the incident, each of them was injured (it was verified that 3 people in Lishi Restaurant had their heads injured and stitched up, and 1 person in the property had a fractured hand bone). After the police asked, the injuries of both parties were not serious but Report to the police station in the future. The police received the alarm from both parties, rushed to the scene, quickly controlled the situation, and separated the two parties. At present, there are 76 people (45 males and 31 females) from Lishi in the business premises, and the two parties have returned to the incident. previous state.
  3. Processing situation
    After this situation happened, our firm attached great importance to this incident, and reported the progress of the situation to the sub-bureau and the street work committee, and carried out detailed inquiries on the relevant personnel on the scene back to the police station, and at the same time carried out relevant evidence collection work On February 7, after the conflict between the employees of Dongdan Mingzhu Property and Lishi restaurant, the on-duty director of the police station immediately led the police to the scene to deal with it. The police at the scene isolated the conflicting parties, videotaped the scene to collect evidence, and brought some people on the scene back to the police station for review. The injured persons from both sides of the conflict went to the hospital by themselves. The police informed the injured persons to go to the police station for questioning and investigation after treatment and diagnosis, but none of them came to the police station. The police station warned the persons in charge of both units that there should be no public security issues, and the dispute can be resolved through legal channels. The police asked the manager of Lishi Restaurant to notify the legal person to go to the police station for investigation, but neither the manager nor the legal person of the restaurant will go to the police station. The police interrogated the 13 parties brought back to the police station one by one. The person in charge of the property made it clear during the investigation that he was willing to bear the responsibility of the employees of both parties who were injured in this conflict (3 employees in Lishi Restaurant had stitches on their heads, The medical expenses of the injured person in the future police station). During the dispute between the employees of Dongdan Mingzhu Property and Lishi Restaurant, the police station will understand and report the situation in time. Lishi Restaurant’s illegal construction in the business premises and the use of welded square steel to block the fire exits have not yet been resolved. More than 10 employees of Lishi Restaurant, under the leadership of the store manager, also went to the district government twice to report the situation. The district petition office and office leaders held a coordination meeting for both parties, but both parties still insisted on their own views, and the mediation work could not proceed.

On February 9, the sub-bureau organized the fire brigade, public security brigade, Chaoyangmen sub-district office and police station to order both parties concerned to remove the obstacles in the fire exits, open up the fire exits, and eliminate fire hazards in accordance with the “Fire Law of the People’s Republic of China”. The property is supplied with water and electricity.

On February 10, the Municipal Bureau formed a project team to investigate the conflict between Dongdan Mingzhu Chinese and Foreign Wine Mall and Lishi Restaurant. Now the Municipal Bureau project team has controlled the relevant personnel involved in the case, and the case is currently in the process of comprehensive review.
