“8.19”城市公园故意杀人案发案快报
2009年8月19日23时50分许，东城区安定门桥西南侧安定门西大街南侧城市公园内发生一起故意杀人案件。案发后，副分局长田壮立即赶赴现场组织指挥，刑侦支队副支队长郑永刚组织重案队、技术队警力赶赴现场展开工作。
一、接报情况：
2009年8月19日23时50分许，安定门派出所协警员杨建山报案称：在安定门桥西南角的城市花园内一女子趴在地上身上有大量血迹，已经死亡，另有一男子被扎伤，其与其他巡逻的协警员在北锣鼓巷北口北侧主辅路中间将行凶男子抓获。
二、死、伤者基本情况：
（一）死者情况
杨朝媛，女，汉族，出生日期：1987年12月22日，户籍所在地：河北省唐山市路北区缸窑路前后村楼，身份证号：。服务处所：安定门内大街“饭是纲”餐厅服务员
（二）伤者情况
闫军，男，汉族，出生日期：1993年2月27日，户籍所在地：重庆市巫溪县徐家镇窑湾村3组，身份证号：
服务处所：安定内大街“饭是纲”餐厅服务员，现在陆军总院抢救。
三、现场情况：
现场位于北京市东城区安定门桥西南角向西150米安定门西大街城市花园内东西向的休息长廊内。
侦查员在案发现场向西100米的路面上提取一把带血迹的刀。
四、现场访问情况
（一）访问报案人情况
经访报案人杨建山（男，47岁，出生日期：1962年7月21日，户籍所在地：东城区官书院胡同，安定门派出所协警员，联系电话：13910886548）得知：2009年8月19日23时30分许，其与罗振玉、郑强、张学斌、张福建五人在安定门辖区内巡逻，其和张福建从安定门桥西南角的城市花园内前往附近胡同巡逻时，接到协警员罗振玉的电话称有人报抢劫。杨建山与张福建返回城市花园休息长廊时看到罗振玉等人已向西追去，二人便一同骑车向西追赶。当行至安定门桥西第一个过街天桥南侧城市花园内的一个休息亭时，看到一女子趴在亭内地上，女子身上和地上全是血，一名男子蹲在旁边，该男子用衣服捂着前胸，脸上和身上有大量血迹。后杨建山给派出所打电话报警，张福建拨打了“120”急救电话。二人打完电话后又向西追赶其他协警员，途中碰到罗振玉、郑强、张学斌将一名赤裸上身的男子抓获并带着该人返回案发地。

经访问罗振玉（男，52岁，户籍所在地：东城区雍和宫大街，身份证号：，安定门派出所协警员）得知：2009年8月19日23时35分许，其与郑强、张学斌在安定门桥西侧城市花园巡逻时遇到一赤裸着上身，光着脚，且身上有大量血迹的男子向三人求救，该人称有人抢劫并将其和女友扎伤。罗振玉遂与其他两名协警员及报警男子向西走了约二百米时，看到城市花园内的休息亭地上趴着一个人，同时看到一男子向西逃跑。三人立即追赶该男子，并在北锣鼓巷北口北侧主辅路中间的地方将该男子抓获。后将该男子带回到休息亭，其看到趴在地上的是一名女子，身下有大量血迹，“120”医护人员已经到场并称该女子已经死亡。

五、讯问情况
犯罪嫌疑人郭德斌，男，汉族，出生日期：1971年4月15日，户籍所在地：辽宁省黑山县白丁门满族镇郭荒地村，身份证号：，现无业。
前科情况：
1、1993年11月5日郭德斌因“抢劫罪、流氓罪”被辽宁省黑山县人民法院判处有期徒刑11年，2003年3月因减刑一年释放；
2、2005年3月18日郭德斌因犯“伪造企事业单位印章罪”，被北京市海淀区人民法院判处有期徒刑1年6个月，2005年5月刑满释放。
经讯问，犯罪嫌疑人郭德斌供述：其于三年前在北影门口找活时与杨朝媛相识，后二人一直保持联系。期间杨朝媛曾多次向郭德斌借钱，但二人没有明确恋爱关系。今年二、三月份郭德斌向杨朝媛提出交朋友，杨朝媛始终回避此事，并于五、六月份搬离位于北京市石景山区锦绣大地的暂住地，并将手机号更换，再未与郭德斌联系。约七天前郭德斌在安定门内大街“饭是纲”吃饭时看到杨朝媛在该店内当服务员，其跟踪了杨朝媛两天后，找到了杨朝媛并向其索要了手机号码，后其多次给杨打电话约其谈交朋友的事情，杨均以值班等理由拒绝见面。
2009年8月19日晚22时许，郭德斌独自一人在安定门桥西侧路南的城市花园内闲逛，后其遇到杨朝媛与一名男子从东向西走来。郭德斌遂将随身携带的折叠刀掏出并走上前去，杨朝媛看到后问一句“你干什么？”其认为杨朝媛是在护着那名同行的男子，就向该男子头部和胸部扎了几刀，后男子往东跑，郭德斌欲追赶时被杨朝媛拉住了手臂，其认为杨朝媛是在帮助被扎伤男子，更加生气，几次想将杨朝媛推开但其没有松手，其遂回身用刀向杨的头部和面部乱扎乱划了数下，后其看见有人从公园的东面过来，遂逃跑并将刀扔在了路边。后其被追上来的人抓获。

“8.19” City Park Intentional Homicide Case Report
At about 23:50 on August 19, 2009, an intentional homicide occurred in a city park on the south side of Andingmen West Street, southwest of Andingmen Bridge, Dongcheng District. The site is located in the east-west rest corridor in the city garden of Andingmen West Street, 150 meters west of the southwest corner of Andingmen Bridge, Dongcheng District, Beijing.
Investigators extracted a bloodstained knife on the road 100 meters west of the crime scene.

(1) Interview with the informant
The reporter Yang Jianshan (male, 47 years old, date of birth: July 21, 1962, registered residence: Guanshuyuan Hutong, Dongcheng District, police officer of Andingmen Police Station, contact number: 13910886548) learned that: August 19, 2009 At about 23:30 on the same day, he, Luo Zhenyu, Zheng Qiang, Zhang Xuebin, and Zhang Fujian were patrolling in the Andingmen area. Police officer Luo Zhenyu’s phone call said that someone had reported a robbery. When Yang Jianshan and Zhang Fujian returned to the rest corridor of the city garden, they saw that Luo Zhenyu and others were chasing westward, so they rode bicycles to chase westward together. When I walked to a rest pavilion in the city garden on the south side of the first overpass on the west side of the Andingmen Bridge, I saw a woman lying on the ground in the pavilion. The woman’s body and the ground were covered with blood. A man was squatting beside him. Holding his chest, there was a lot of blood on his face and body. Later, Yang Jianshan called the police station to call the police, and Zhang Fujian dialed the “120” emergency number. After the two made the phone call, they chased other police officers westward. On the way, they encountered Luo Zhenyu, Zheng Qiang, and Zhang Xuebin who captured a shirtless man and took him back to the scene of the crime.
(2) Circumstantial Evidence Interviews
After interviewing Luo Zhenyu (male, 52 years old, domicile location: Lama Temple Street, Dongcheng District, ID number:, police officer of Andingmen Police Station), it was learned that at about 23:35 on August 19, 2009, he and Zheng Qiang, When Zhang Xuebin was patrolling the city garden on the west side of the Andingmen Bridge, he encountered a shirtless, barefoot man with a lot of blood on his body and called for help from three people. When Luo Zhenyu walked westward for about 200 meters with the other two police officers and the man who called the police, he saw a person lying on the ground in the rest pavilion in the city garden, and at the same time saw a man running away to the west. The three immediately chased the man and arrested him in the middle of the main and auxiliary roads on the north side of the north entrance of Beiluogu Lane. After taking the man back to the rest booth, he saw a woman lying on the ground with a lot of blood under her body. “120” medical staff had arrived and said the woman had died.

V. Interrogation
Criminal suspect Guo Debin, male, Han nationality, date of birth: April 15, 1971, domicile: Guohuangdi Village, Baidingmen Manchu Town, Heishan County, Liaoning Province, ID number: , currently unemployed.
Previous convictions:
- On November 5, 1993, Guo Debin was sentenced to 11 years in prison by the People’s Court of Heishan County, Liaoning Province for “robbery and hooliganism”. He was released in March 2003 with a one-year commutation of sentence;
- On March 18, 2005, Guo Debin was sentenced to 1 year and 6 months in prison by the Beijing Haidian District People’s Court for the crime of “forging the seals of enterprises and institutions”. He was released after serving his sentence in May 2005.
After interrogation, the suspect Guo Debin confessed: He met Yang Chaoyuan three years ago when he was looking for a job at the gate of Beiying, and the two have kept in touch since then. During this period, Yang Chaoyuan borrowed money from Guo Debin many times, but the two did not have a clear relationship. In February and March of this year, Guo Debin proposed to Yang Chaoyuan to make friends. Yang Chaoyuan always avoided the matter. In May and June, she moved out of her temporary residence in Jinxiu Dadi, Shijingshan District, Beijing, and changed her mobile phone number. She never contacted Guo Debin again. About seven days ago, Guo Debin saw Yang Chaoyuan working as a waiter in the restaurant “Fan Shi Gang” in Andingmen Inner Street. After following Yang Chaoyuan for two days, he found Yang Chaoyuan and asked her for her cell phone number. Afterwards, he called Yang Chaoyuan several times. Called him to talk about making friends, but Yang Jun refused to meet him because he was on duty.
At about 22:00 on the evening of August 19, 2009, Guo Debin was wandering alone in the city garden on the south side of the road on the west side of the Andingmen Bridge. Later, he met Yang Chaoyuan and a man walking from east to west. Guo Debin then took out the folding knife he was carrying and walked forward. Yang Chaoyuan saw it and asked, “What are you doing?” Thinking that Yang Chaoyuan was protecting the man who was traveling with him, he stabbed the man in the head and chest. After a few knives, the man ran eastward. When Guo Debin wanted to chase after him, Yang Chaoyuan grabbed his arm. He thought that Yang Chaoyuan was helping the stabbed man, and became even more angry. He tried to push Yang Chaoyuan away several times, but he didn’t let go. The knife slashed at Yang’s head and face several times, and then he saw someone coming from the east of the park, so he ran away and threw the knife on the side of the road. He was later captured by pursuers.
