犯罪嫌疑人董志国，男，1979年4月6日出生，出生地：河北省唐山市，身份证号：XXX，汉族，初中文化程度，捕前系河北省唐山开平区越河乡郭坨村北街7号。因涉嫌故意伤害罪于2011年9月27日被我局刑事拘留；经北京市人民检察院第二分院批准，于同年11月5日被依法逮捕。
犯罪嫌疑人董志国涉嫌故意伤害一案，由施鸿（男，33岁）于2001年11月29日报案至我局，我局经过审查，于次日立案进行侦查。犯罪嫌疑人董志国于2011年9月29日主动投案。犯罪嫌疑人董志国涉嫌故意伤害一案，现已侦查终结。
经依法侦查查明：2001年11月29日中午11时许，犯罪嫌疑人董志国伙同宋国晨、赵乖明（均已判刑）并纠集他人窜至本市东城区东直门东中街东环广场B座写字楼，对到该写字楼讨要债务的黄英魁（男，殁年36岁）、施鸿等人持棍棒等凶器进行殴打，致黄英魁重度颅脑损伤合并失血性休克死亡；致施鸿轻伤（偏重）。
认定上述犯罪事实的证据如下：报案记录、证人证言、现场勘验材料、被害人的尸体检验报告书、伤情鉴定结论等。犯罪嫌疑人董志国不供述纠集他人和自己对黄英魁伤害的犯罪事实。
上述犯罪事实清楚，证据确实、充分，足以认定。
综上所述，犯罪嫌疑人董志国的行为已触犯了《中华人民共和国刑法》第二百三十四条之规定，涉嫌故意伤害罪。根据《中华人民共和国刑事诉讼法》第一百二十九条之规定，现将此案移送审查起诉。

Criminal suspect Dong Zhiguo, male, born on April 6, 1979, place of birth: Tangshan City, Hebei Province, ID number: XXX, Han nationality, junior high school education, was at North Street 7, Guotuo Village, Yuehe Township, Kaiping District, Tangshan, Hebei Province before his arrest Number. On September 27, 2011, he was criminally detained by our bureau on suspicion of intentional injury; with the approval of the Second Branch of the Beijing Municipal People’s Procuratorate, he was arrested according to law on November 5 of the same year.
The criminal suspect Dong Zhiguo was involved in the case of intentional injury. Shi Hong (male, 33 years old) reported to our bureau on November 29, 2001. After review, our bureau opened the case for investigation the next day. The suspect Dong Zhiguo voluntarily surrendered on September 29, 2011. The criminal suspect Dong Zhiguo was involved in the case of intentional injury, and the investigation has now ended.
According to the lawful investigation, it was found that at around 11:00 noon on November 29, 2001, the criminal suspect Dong Zhiguo, together with Song Guochen and Zhao Guaiming (both already sentenced), and gathered others fled to Block B, Donghuan Plaza, Dongzhimen Dongzhong Street, Dongcheng District, this city. In the office building, Huang Yingkui (male, 36 years old at the time of death), Shi Hong and others who came to the office building to collect debts were beaten with sticks and other weapons, causing Huang Yingkui to die of severe craniocerebral injury combined with hemorrhagic shock; ).
The evidence for ascertaining the above-mentioned criminal facts is as follows: report records, witness testimony, on-site inspection materials, autopsy report of the victim, conclusion of injury appraisal, etc. The criminal suspect Dong Zhiguo did not confess the criminal facts of gathering others and himself to harm Huang Yingkui.The above-mentioned criminal facts are clear, and the evidence is reliable and sufficient, which is sufficient for affirmation.
To sum up, the behavior of the criminal suspect Dong Zhiguo has violated the provisions of Article 234 of the “Criminal Law of the People’s Republic of China”, and he is suspected of the crime of intentional injury. In accordance with the provisions of Article 129 of the “Criminal Procedure Law of the People’s Republic of China”, this case is hereby transferred for review and prosecution.
