延庆犯罪嫌疑人王春仙、王菊仙、白毅勇涉嫌故意杀人案初审报告

一、基本情况

犯罪嫌疑人王春仙，绰号：二根，女，1964年出生，出生地:河北省张家口市，身份证号码：，汉族，高中文化，捕前系河北省张家口市怀来县北辛堡镇甘字堡村农民，住该村。因涉嫌故意杀人罪，2008年12月2日被我局刑事拘留。受案时限：2008年12月2日至2009年1月1日。

犯罪嫌疑人王菊仙，绰号：仙子，女，1961年出生，出生地:河北省张北县，身份证号码：，汉族，初中文化，捕前无业，住北京市延庆县延庆镇。因涉嫌故意杀人罪，2008年12月2日被我局刑事拘留。受案时限：2008年12月2日至2009年1月1日。

犯罪嫌疑人白毅勇，男，1959年5月25日出生，出生地:北京市，身份证号码：，汉族，初中文化，捕前无业，住北京市延庆县延庆镇。因涉嫌故意杀人罪，2008年12月2日被我局刑事拘留。受案时限：2008年12月2日至2009年1月1日。

二、简要案情：

2007年4月底一天，犯罪嫌疑人王春仙伙同王菊仙、白毅勇在河北省怀来县北辛堡镇甘字堡村王春仙家中用木棍将谢宗海殴打致死后焚尸.

三、案件来源侦破过程

2007年8月29日11时许,延庆县延庆镇胜利街村谢金龙(男、21岁)报案称：他父亲谢宗海（男，51岁）于2007年4月中旬出走后至今未归，后报案。接到报告后，延庆县公安局刑侦大队对此案开展调查访问工作。经工作发现，2007年9月10日，13264404559手机号曾以谢宗海的名义给他朋友时文营（男，56岁，13371736359）发过短信。经调取132464404559手机清单发现，该手机与13241616863手机通话一次，13801024667号码短信一次，之外没有与任何其他联系。但该手机与谢宗海妻子手机通话密切，刑侦大队于2007年10月24日立线侦查。

2008年12月1日16时许，刑侦大队依法通知谢宗海妻子王春仙（女，44岁）、王菊仙（女，47岁）、白毅勇（男，49岁）到延庆县公安局刑侦大队接受询问。2008年12月2日13时许，王春仙供述：2007年4月底或5月初的一天，在河北省怀来县北辛堡镇甘字堡村王春仙家中用木棍将丈夫谢宗海打死。当时王春仙姐姐王菊仙在场。

2008年12月2日17时许，王菊仙供述：2007年领到新分的房钥匙后，白毅勇请大家吃饭。后谢宗海与王春仙、王菊仙一同坐车到甘字堡村家中，谢宗海要与王菊仙发生性关系，但因喝多酒未能发生性关系。后王菊仙打电话叫白毅勇来到甘子堡王春仙家中，白毅勇与谢宗海发生争吵，王菊仙一个人回到延庆县家中。第二天听白毅勇说，用木棍把谢宗海打死了还给烧了。同时王春仙也证实白毅勇用木棍打死谢宗海，并烧尸体的情况。

延庆县公安局于2008年12月2日立案进行侦查，并以故意杀人罪对王春仙、王菊仙、白毅勇刑事拘留。

四、审查情况：

（一）、现有证据的情况：

１、２008年12月2日19时许，犯罪嫌疑人王春仙前往河北省怀来县甘子堡村指认出，用木棍打倒谢宗海的地点为她在该村与她前夫居住的家中北房东头屋内。焚烧谢宗海尸体的地点为该院内南房前菜窖内。

2、经现查勘查发现，焚烧谢宗海尸体的菜窖内地面有被烧的人形痕迹，且在菜窖顶部发现油质物质。并在被烧地面内发现一块十多公分长的已被烧得完全碳化的骨头及几片指甲盖大小的骨头碎片。

（二）、证人证言情况：

1、王春仙交待：在2007年4月底一天，在她姐夫白毅勇家拿到新分楼房钥匙那天中午，王春仙，王菊仙、白毅勇、丁秀立，和另两个不认识的男子，共五个人一起到东江饭店吃饭。在一层看到谢宗海和他原来妻子的担挑，还有赵老五在吃饭。我们五个人是在二楼吃的饭。后谢宗海上来和我们喝酒后，他说我和我姐都是他的，白毅勇气得脸都红了。后谢宗海要先走，我和我姐姐就和谢宗海一起走了。在饭让门口我打电话叫来一辆黑车，司机叫李安民，我以前经常打他的车我们都认识了。我和我姐，谢宗海都上了车。李安民开车向家里走，在路上我对司机说去甘字堡村。在车里我坐副驾驶，谢宗海和我姐姐坐后边。在车里他就抱我姐姐，亲我姐姐，还摸我姐的胸部。大约到了下午三点左右，车到了甘字堡我家里。我们三个人进了北屋谢宗海对我姐说：“姐姐，我要跟你”。我姐说：“我是你姐姐”不同意。谢宗海还是要和我姐发生性关系，把我姐的裤子脱下。谢宗海把自己的裤子脱到膝盖，他们俩脸对脸在炕上搂着。谢宗海说：“我喝酒了不成”，之后他说我给他买性药去，我没去也没理他。之后他抱着我姐姐睡着了。我姐夫在谢宗海搂着我姐睡觉时来的。我站在地上看他闭眼睛睡觉，我就拿着棍子打他两棍子。白毅勇也跟着用棍子打了谢宗海脑门两棍子。我们三人把谢宗海尸体拖到地窖里。我和白毅勇下了地窖架起木材。我把汽油倒在谢宗海的身上之后，在地窖上面点着一根玉米桔扔了下去，把汽油点着了。当天晚上，我们三个人一起在甘子堡家里睡的觉。第二天我们三个人回到延庆县。过了十几天我一个人回到甘子堡村家中地窖内，又将未烧干净的谢宗海的尸体再次倒上汽油烧了。又过了十几天，我和白毅勇二人又来到地窖里，把谢宗海的尸骨收拾到编织袋里。二人拿着袋子出了家向北走了五、六分钟后把袋子埋在村子外面的地的坑里，之后我们就回延庆了。

2、王菊仙供述：在2007年4月底我和丈夫白毅勇拿到新分的楼房钥匙后，我们商量去东江饭店吃饭。叫上王春仙，还有一个给我家装修过房子的男子和白毅勇以前的同事，五个人到东江饭店吃饭。在一层看到谢宗海和四、五个人在一层吃饭。我还叫谢宗海过来一起吃饭。我们五个人在二楼吃饭时，谢宗海上到二楼和我们喝酒时，说我是他的，我妹妹是他的。我听了之后很不高兴就回家了。一会儿王春仙给我打电话叫我回去，我来到东江饭店门口看到谢宗海坐在一辆车里。王春仙在车外等我叫我进车里，是一个男子开的车。我们上车后，王春仙说去甘子堡村，在车上谢宗海还亲我。在甘子堡村家里时，谢宗海要我和发生性关系，我妹妹也求我让我应付谢宗海。但谢宗海因为喝多酒没能力和我发生性关系，就和我在床上躺着，我打电话把白毅勇叫来。一个小时后白毅勇来到甘子堡，到屋子里看到这种情况和谢宗海争吵起来。之后我一个人回到延庆县。第二天，白毅勇回到家中说他用木棍一棍子把谢宗海打死了，之后给烧了。后王春仙也跟我说白毅勇用一根木棍把谢宗海打死了，后二人把谢宗海的尸体抬进家里地窖里烧了。

3、白毅勇供述：2007年4、5月份在我拿到新分楼房的钥匙后，想在上午和我妻子王菊仙说，请大家一起吃饭高兴一下。后叫上王春仙，给我家做活的“小孙”，还有我的一个朋友“老有”五个人到东江饭店吃饭。在一层看到谢宗海和赵老五，还有一个女子在吃饭，我叫谢宗海来二楼一起吃饭。我们五个人到二楼吃饭时谢宗海上来和我们一起喝酒后说王春仙是他们，纪秀清是他的，还说楼是他的，钱也是他的。谢宗海喝多了，王春仙、王菊仙和赵老五三个人扶着谢宗海下楼把他送回家。过了一会我下楼在饭店门口看到王春仙，王菊仙、赵老王打了一辆面包车要送谢宗海走。我结完帐后在离开饭店时，王春仙他们还没走呢，我回到家之后就睡了。之后我就没有再见过谢宗海。

（三）证人证言：

1、谢金龙证实：2007年 8月9日，谢金龙到公安局报案称他父亲谢宗海2007年4月份失踪。并多次找王春仙查找他父亲下落，但王春仙以谢宗海不在家出去玩去了，或是去找别的女人了等多种借口推脱。

2、赵庆来（别名：赵老五）证实：在2007年5月份左右一天，在东江饭店一层见到谢宗海和谢宗海前妻的姐夫，还有另外一男一女在一起吃饭。赵庆来和谢宗海喝了一杯酒后，看到谢宗海到二楼吃饭。在当天下午二点左右，赵庆来在饭店门口看到谢宗海的妻子打了一辆黑色小轿车。谢宗海坐在后排座上，加上司机这三人开着车向东走了，之后没再见到谢宗海。

 3、房信证实：他是谢宗海前妻的姐夫，在2007年4月底的一天，房信到物业处代替张桂先签字，领新分房的钥匙时，见到谢宗海。后二人走着到东江饭店内一层吃饭，之后有一个叫“老五”的老头来和我们喝了一杯酒后就走了。在我们快吃完饭时，谢宗海说他媳妇来了，得去二楼吃饭。我们就散了，我看到谢宗海上了二楼后就走了，之后再没有见到谢宗海。

4、郭元启（男，别名“老有”）证实：在2007年格兰山水小区分房时间的一天中午，老白叫我去陪他喝酒。我坐车去老白家，我、老白、菊仙，老白小姨子等人去东江饭店二楼吃的饭。过程中老海进来和我们喝酒，老海喝多了，老白的小姨子扶老海下去了。老白和菊仙也下去，一会老白和菊仙又回来了。我们又喝了一个小时就散了，老白媳妇走了。我到老白家喝了两杯水就回家了，之后没再见过老海。

5、时文营证实：在2007年3、4月份之后就没再见过谢宗海。他找谢宗海找不到，谢宗海手机也关机了。他去找王春仙，王春仙以谢宗海出去玩，或去他哥家了为借口推脱。后在2007年8月份谢金龙报案二、三天后，我的手机收到一条短信。是以13264404559手机号发来的短信，是以谢宗海的名义发的短信内容为：我是海哥，我在外面租房住，你帮助照顾好你嫂子。我接到这个情况向警察反映。

6、鲁志文证实：2007年我听说谢金龙报案谢宗海失踪，才知道谢宗海出事了。2007年9、10月份一天，我收到谢宗海给我发的短信内容是：让我帮他把他媳妇的户口办一办，我当时没注意这事。短信是老海以前用的手机号码，但具体号码我想不起来了。

7、李安民证实：在2007年“五一”左右一天下午1、2点钟，王春仙打电话叫我走东江饭店门口接她。我到后谢老海和王春仙上车了，另外还有另一个女子坐在副驾驶上。在回场站那边路上我不知道是谁说去甘子堡，我就开车去了河北省甘子堡村内。他们三个人下了车，给我了一百元钱后，我开车回延庆县了。

五、下一步工作意见

1、需继续对嫌疑人王春仙、王菊仙、白毅勇进行审讯搞清全案。

2、需继续配合刑侦总队、延庆公安分局进行大量的调查取证。

3、鉴于该案主要实施杀人、焚尸的犯罪地在河北省怀来县，故需将此案移交河北省公安局审查处理。

Criminal suspect Bai Yiyong, male, born on May 25, 1959, place of birth: Beijing, ID number: Han nationality, junior high school education, unemployed before arrest, living in Yanqing Town, Yanqing County, Beijing. On December 2, 2008, he was criminally detained by our bureau on suspicion of intentional homicide. Time limit for accepting the case: December 2, 2008 to January 1, 2009.

2. Brief case:
   One day at the end of April 2007, criminal suspect Wang Chunxian, together with Wang Juxian and Bai Yiyong, beat Xie Zonghai to death with wooden sticks at Wang Chunxian’s home in Ganzibao Village, Beixinbao Town, Huailai County, Hebei Province, and then cremated his body.
3. The process of detecting the source of the case
   At about 11:00 on August 29, 2007, Xie Jinlong (male, 21 years old) from Shengli Street Village, Yanqing Town, Yanqing County reported to the police that his father Xie Zonghai (male, 51 years old) had left in mid-April 2007 and has not returned. Report the crime. After receiving the report, the Criminal Investigation Brigade of Yanqing County Public Security Bureau launched an investigation and visit to the case. It was discovered through work that on September 10, 2007, the mobile phone number 13264404559 sent a text message to his friend Shi Wenying (male, 56 years old, 13371736359) in the name of Xie Zonghai. After retrieving the mobile phone list of 132464404559, it was found that the mobile phone had one call with 13241616863, one text message with 13801024667, and no other contact. However, the mobile phone was in close contact with Xie Zonghai’s wife’s mobile phone, and the Criminal Investigation Brigade set up an investigation on October 24, 2007.

At around 16:00 on December 1, 2008, the Criminal Investigation Brigade notified Xie Zonghai’s wife Wang Chunxian (female, 44 years old), Wang Juxian (female, 47 years old), and Bai Yiyong (male, 49 years old) to the Criminal Investigation Brigade of Yanqing County Public Security Bureau for questioning. At around 13:00 on December 2, 2008, Wang Chunxian confessed: One day in late April or early May 2007, at Wang Chunxian’s home in Ganzibao Village, Beixinbao Town, Huailai County, Hebei Province, he beat her husband Xie Zonghai to death with a wooden stick. At that time, Wang Chunxian’s sister Wang Juxian was present.

At about 17:00 on December 2, 2008, Wang Juxian confessed: After receiving the house key of Xinfen in 2007, Bai Yiyong invited everyone to dinner. Later, Xie Zonghai, Wang Chunxian and Wang Juxian drove to the home of Ganzibao Village. Xie Zonghai wanted to have sex with Wang Juxian, but he was unable to have sex because he drank too much alcohol. Later, Wang Juxian called Bai Yiyong to come to Wang Chunxian’s home in Ganzibao. Bai Yiyong had a quarrel with Xie Zonghai, and Wang Juxian returned to his home in Yanqing County alone. The next day, Bai Yiyong said that Xie Zonghai was beaten to death with a wooden stick and then burned. At the same time, Wang Chunxian also confirmed that Bai Yiyong beat Xie Zonghai to death with a wooden stick and burned his body.

The Yanqing County Public Security Bureau opened a case for investigation on December 2, 2008, and criminally detained Wang Chunxian, Wang Juxian, and Bai Yiyong for intentional homicide.

4. Review situation:

(2) Witness testimony:

1. Wang Chunxian confessed: One day at the end of April 2007, at noon on the day when her brother-in-law Bai Yiyong got the keys to the new building, Wang Chunxian, Wang Juxian, Bai Yiyong, Ding Xiuli, and two other men whom she did not know, a total of five people went to the Dinner at Dongjiang Hotel. On the first floor, I saw Xie Zonghai and his former wife, and Zhao Laowu eating. The five of us ate on the second floor. After Xie Zonghai came to drink with us, he said that my sister and I belonged to him, and Bai Yi blushed with courage. Later, Xie Zonghai wanted to leave first, so my sister and I left with Xie Zonghai. At the gate of Fanrang, I called a black car. The driver was Li Anmin. I used to call his car and we all knew each other. My sister, Xie Zonghai and I got into the car. Li Anmin drove home, and on the way I told the driver to go to Ganzibao Village. I was the co-pilot in the car, and Xie Zonghai and my sister sat in the back. In the car, he hugged my sister, kissed my sister, and touched my sister’s chest. At about three o’clock in the afternoon, the car arrived at my house in Ganzibao. The three of us entered the North Room and Xie Zonghai said to my sister, “Sister, I want to follow you”. My sister said: “I am your sister” and disagreed. Xie Zonghai still wants to have sex with my sister and take off my sister’s pants. Xie Zonghai took off his trousers to his knees, and they hugged each other face to face on the kang. After I poured gasoline on Xie Zonghai’s body, I lit a corn orange on the top of the cellar and threw it down, setting the gasoline on fire. That night, the three of us slept together at Ganzibao’s house. The three of us returned to Yanqing County the next day. After more than ten days, I went back to the cellar of my home in Ganzibao Village alone, poured gasoline on Xie Zonghai’s unburnt body and burned it again. More than ten days later, Bai Yiyong and I came to the cellar again and packed Xie Zonghai’s bones into woven bags. The two left the house with the bag and walked northward for five or six minutes, then buried the bag in a pit outside the village, and then we returned to Yanqing.
2. Confession by Wang Juxian: At the end of April 2007, after my husband Bai Yiyong and I got the keys to the new building, we discussed going to the Dongjiang Hotel for dinner. I called Wang Chunxian, a man who renovated our house, and Bai Yiyong’s former colleague, and the five went to Dongjiang Restaurant for dinner. On the first floor, I saw Xie Zonghai eating with four or five people on the first floor. I also asked Xie Zonghai to come over for dinner. When the five of us had dinner on the second floor, Xie Zonghai went to the second floor to drink with us and said that I belonged to him and my sister belonged to him. After hearing this, I was very unhappy and went home. After a while, Wang Chunxian called me and asked me to go back. I came to the gate of Dongjiang Hotel and saw Xie Zonghai sitting in a car. Wang Chunxian was waiting for me outside the car to tell me to get in the car, which was driven by a man. After we got in the car, Wang Chunxian said to go to Ganzibao Village, and Xie Zonghai kissed me back in the car. At home in Ganzibao Village, Xie Zonghai wanted me to have sex with her, and my sister begged me to let me deal with Xie Zonghai. But Xie Zonghai was unable to have sex with me because he drank too much alcohol, so he lay on the bed with me, and I called Bai Yiyong. An hour later, Bai Yiyong came to Ganzibao, went to the house and saw this situation and quarreled with Xie Zonghai. Afterwards, I returned to Yanqing County alone. The next day, Bai Yiyong returned home and said that he beat Xie Zonghai to death with a wooden stick and then burned him. Later Wang Chunxian also told me that Bai Yiyong beat Xie Zonghai to death with a wooden stick, and the latter two carried Xie Zonghai’s body into the cellar of their home and burned it.
3. Bai Yiyong’s confession: In April and May 2007, after I got the keys to the new building, I wanted to tell my wife Wang Juxian in the morning, please have dinner together and be happy. After that, I called Wang Chunxian, “Xiao Sun” who worked for my family, and a friend of mine who “always” five people went to Dongjiang Restaurant for dinner. I saw Xie Zonghai and Zhao Laowu on the first floor, and a woman was eating. I asked Xie Zonghai to come to the second floor to have dinner together. When the five of us went to the second floor for dinner, Xie Zonghai came to drink with us and said that Wang Chunxian belonged to them and Ji Xiuqing belonged to him. He also said that the building belonged to him and the money belonged to him. Xie Zonghai drank too much, Wang Chunxian, Wang Juxian and Zhao Laowu helped Xie Zonghai go downstairs and sent him home. After a while, I went downstairs and saw Wang Chunxian at the entrance of the hotel. Wang Juxian and Zhao Laowang took a van to take Xie Zonghai away. When I left the hotel after paying the bill, Wang Chunxian and the others hadn’t left yet, and I fell asleep when I got home. After that, I never saw Xie Zonghai again.

(3) Witness testimony:

1. Xie Jinlong confirmed: On August 9, 2007, Xie Jinlong reported to the Public Security Bureau that his father Xie Zonghai disappeared in April 2007. He also asked Wang Chunxian many times to find out the whereabouts of his father, but Wang Chunxian evaded it with various excuses, such as Xie Zonghai went out to play when Xie Zonghai was not at home, or went to find another woman.
2. Zhao Qinglai (alias: Zhao Laowu) confirmed that one day around May 2007, he saw Xie Zonghai, Xie Zonghai’s ex-wife’s brother-in-law, and another man and woman eating together on the first floor of the Dongjiang Hotel. After Zhao Qinglai had a glass of wine with Xie Zonghai, he saw Xie Zonghai go to the second floor for dinner. At around 2 o’clock in the afternoon that day, Zhao Qinglai saw Xie Zonghai’s wife driving a black car at the entrance of the hotel. Xie Zonghai sat in the back seat, and the three of them, including the driver, drove eastward and did not see Xie Zonghai again.
3. Fang Xin confirmed that he was the brother-in-law of Xie Zonghai’s ex-wife. One day at the end of April 2007, Fang Xin went to the property office to sign on Zhang Guixian’s behalf and received the key to the new apartment, and met Xie Zonghai. The latter two walked to the first floor of the Dongjiang Hotel for dinner, and then an old man named “Old Five” came and had a drink with us and then left. When we were about to finish eating, Xie Zonghai said that his wife had come and had to go to the second floor for dinner. We broke up. I saw Xie Zonghai go up to the second floor and left. I never saw Xie Zonghai again.
4. Guo Yuanqi (male, alias “Old You”) confirmed: In 2007, at noon one day when the rooms of the Gelan Shanshui District were divided, Lao Bai asked me to drink with him. I went to Laobai’s house by car, and Laobai, Juxian, Laobai’s sister-in-law and I went to eat on the second floor of Dongjiang Hotel. During the process, Lao Hai came in to drink with us. When Lao Hai drank too much, Lao Bai’s sister-in-law helped Lao Hai go down. Laobai and Juxian also went down, and Laobai and Juxian came back after a while. After another hour of drinking, we broke up, and the old white daughter-in-law left. I went to Lao Bai’s house and drank two glasses of water before returning home. I haven’t seen Lao Hai since then.
5. Shi Wenying confirmed that he has not seen Xie Zonghai since March and April 2007. He couldn’t find Xie Zonghai, and Xie Zonghai’s phone was turned off. He went to find Wang Chunxian, but Wang Chunxian excused him by using the excuse that Xie Zonghai had gone out to play or went to his brother’s house. Then, two or three days after Xie Jinlong reported the case in August 2007, I received a text message on my mobile phone. It was a text message sent from mobile phone number 13264404559, in the name of Xie Zonghai. The content of the text message was: I am Brother Hai, and I rent a house outside.
