4、简要案情：

2004年景希友因患癌症不治去世，去世前立下遗嘱将北京的一套房产由景晓堂继承，2008年王亚光、景忠堂、景凯、景兆娟及郭学历（景晓堂的侄女）在北京市昌平区联名起诉景晓堂，要求昌平区法院判决景希友所立遗嘱无效。法院经审理判决，该房产系景希友、王亚光共同所有，景希友所立遗嘱无效，判决北京房产归王亚光所有，景晓堂上诉至北京市中级人民法院，败诉后不服提起申诉至高院，现案件正在审理过程中。王亚光现在扎兰屯市中蒙医院住院治疗，由张才香（景晓堂妻子李瑞的三姨）照顾。

5、侦查情况：

接到举报后，我大队指派侦查员立即开展工作，经工作查明，2008年4月末，王亚光生病，景忠堂将王亚光送回阿荣旗二中校长宫云林办公室，二中工作人员通知景晓堂，景晓堂将母亲王亚光送到医院住院治疗，2008年4月份至今，王亚光一直在阿荣旗景晓堂家生活，由景晓堂、李瑞、及李瑞的三姨张才香照顾，在此期间，景晓堂等人时常带王亚光出来散步，购物，景晓堂的朋友、同事、邻居等人证实老人出入自由，神态安详，不存在非法拘禁行为。在景晓堂家中生活期间，王亚光立下遗嘱：死后北京的房产由景晓堂继承。

通过对景晓堂询问，2008年4月至今，景晓堂拒绝景忠堂等人见其母亲王亚光，景晓堂称：因为他们有出尔反尔的例子，我对他们的承诺根本不相信，房子要是没有最终的归属，我不能让他们见到我母亲，这也是防止他们以欺骗的方法骗我母亲卖掉本应由我继承的房子。

近期，王亚光因消化不良，在扎兰屯市中蒙医院住院治疗，由张才香照顾。11月22日晚工作人员来到扎兰屯市中蒙医院，张才香陈述，景忠堂等人因为北京房产的事与景晓堂关系闹的很僵，景晓堂、李瑞对王亚光非常孝顺，王亚光身体好时经常带着王亚光出来溜达，不存在非法拘禁的行为，从去年开始王亚光的腿脚不好使，神志不清，耳背，说话也说不清楚，现因消化不良，在扎兰屯市中蒙医院住院治疗。工作人员询问王亚光，王亚光的骨瘦如柴、神志不清，无法进行询问。

根据调查情况，王亚光在景晓堂家中生活期间，出入自由，并没有被景晓堂非法拘禁的行为发生，我们认为景忠堂举报景晓堂非法拘禁王亚光的事实不成立，景忠堂与景晓堂等人的矛盾纠纷认定为家庭财产矛盾纠纷更为适宜。

Investigative report on the case of Jing Zhongtang and others accusing Jing Xiaotang of illegally detaining Wang Yaguang

3. Main related parties: Jing Xiyou (died in 2004) and Wang Yaguang jointly raised Jing Zhongtang, Jing Kai, Jing Zhaojuan (female), Jing Wei (deceased), Jing Xiaotang and other children.
4. Brief facts of the case: Jing Xiyou died of cancer in 2004. Before his death, he made a will to inherit a set of real estate in Beijing to Jing Xiaotang. (Jing Xiaotang’s niece) jointly sued Jing Xiaotang in Changping District, Beijing, requesting the Changping District Court to rule that Jing Xiyou’s will is invalid. After the trial, the court ruled that the real estate was jointly owned by Jing Xiyou and Wang Yaguang, Jing Xiyou’s will was invalid, and the Beijing real estate was ruled to belong to Wang Yaguang. Jing Xiaotang appealed to the Beijing Intermediate People’s Court, and after losing the case, appealed to the High Court. The case is currently under trial. Wang Yaguang is currently hospitalized in Zhalantun Zhongmeng Hospital, under the care of Zhang Caixiang (the third aunt of Jing Xiaotang’s wife Li Rui).
5. Investigation situation: After receiving the report, our brigade assigned investigators to start work immediately. After investigation, it was found that Wang Yaguang fell ill at the end of April 2008. Jing Zhongtang sent Wang Yaguang back to the office of Gong Yunlin, the principal of Arong Banner No. The staff informed Jing Xiaotang that Jing Xiaotang sent his mother Wang Yaguang to the hospital for treatment. Since April 2008, Wang Yaguang has been living at Jing Xiaotang’s home in Arong Banner. Jing Xiaotang, Li Rui, and Li Rui’s third aunt Zhang Caixiang During this period, Jing Xiaotang and others often took Wang Yaguang out for walks and shopping. Jing Xiaotang’s friends, colleagues, neighbors and others confirmed that the old man was free to go in and out, his demeanor was peaceful, and there was no illegal detention. While living at Jing Xiaotang’s home, Wang Yaguang made a will: Jing Xiaotang will inherit the real estate in Beijing after his death.

Through questioning Jing Xiaotang, since April 2008, Jing Xiaotang has refused Jing Zhongtang and others to see his mother Wang Yaguang. Jing Xiaotang said: Because they have backed their promises, I don’t believe their promises at all. Without final ownership, I can’t let them see my mother. This is also to prevent them from deceiving my mother to sell the house that should have been inherited by me.

Recently, Wang Yaguang was hospitalized in Zhalantun Zhongmeng Hospital due to indigestion, under the care of Zhang Caixiang. On the evening of November 22, the staff came to the Zhongmeng Hospital in Zhalantun City. Zhang Caixiang stated that Jing Zhongtang and others had a very tense relationship with Jing Xiaotang because of the Beijing real estate matter. Jing Xiaotang and Li Rui were very filial to Wang Yaguang. When Wang Yaguang was in good health, he often took Wang Yaguang out for a walk. There was no illegal detention. Since last year, Wang Yaguang’s legs and feet have been bad, his mind is blurred, his ears are hard of hearing, and he can’t speak clearly. Now he is in Zhalantun because of indigestion. City Zhongmeng Hospital for hospitalization. The staff questioned Wang Yaguang. Wang Yaguang was so skinny and delirious that he could not interrogate him.

According to the investigation, Wang Yaguang was free to come and go while living in Jing Xiaotang’s home, and was not illegally detained by Jing Xiaotang. We believe that the fact that Jing Zhongtang reported Jing Xiaotang’s illegal detention of Wang Yaguang is not valid. It is more appropriate to determine the conflict and dispute between Tang et al. as a family property conflict and dispute.
