河南省监管总队关于对《拘留所法律文书（征求意见稿）》的修改意见
公安部监管局：
河南省监管总队于6月27日下发“关于对《拘留所法律文书（征求意见稿）》征求意见的通知”，全省各个地市组织经验丰富的拘留所领导、民警进行了讨论。经总队汇总审核，提出如下修改意见汇报：
一、建议修改的内容
(一）被拘留人登记表（式样一）
《被拘留人员登记表》建议增加办案单位或送拘单位（二）被拘留人入所健康检查表（式样二）
1、被拘留体表检查栏内容应改为“血压、体温、体表”三项内容。
2、建议在体表检查栏下增加办案单位民警、被拘留人签字栏，以对被拘留人健康情况进行“确认”。
（三）被拘留人违禁品、涉案物品移交清单（式样三）
1、《被拘留人违禁、涉案物品移交清单》表中“拘留所决定机关”应为“拘留决定机关”。
2、被拘留人违禁、涉案物品移交清单中“所长审批”，建议更改为“带班所领导审批”。
（四）被拘留人暂存物品、现金收据（式样四）
被拘留人暂存物品、现金收据中，被拘留人签字一栏，应增加被拘留人出所时领取财务签字和民警签字栏。
（五）收拘回执(式样五)
《收据回执》此法律文书设计跟办案单位《拘留人员执行通知书（回执）》重复，建议使用公安部为办案单位设计的回执。（郑州、开封、洛阳、新乡）
(六) 不予收拘通知书(式样六)
《不予收拘通知书》存根联建议增加“办案单位”。
(七) 建议另行处理通知书(式样七)

（八）被拘留人请假出所审批表（式样九）
1、被拘留人请假出所审批表中“保证金”一栏应注明由“批准机关填写”，按照《拘留所条例实施办法（草案）》规定拘留所不应由拘留所收取保证金。
2、《被拘留人请假出所审批表》中担保人“住所”建议改为“住址”，审批表建议改为表格形式。
（九）使用警械审批表（式样十一）
《使用警械审批表》建议主管民警签字改为值班民警签字。
（十）解除拘留证明书（式样十七）
解除拘留证明书（存根）一览，通知家属或者单位情况应删除，
一是根据《拘留所条例》、《拘留所条例实施办法（草案）》被拘留人员到期应自动解除拘留，不需要通知家属，
二是部分人员不愿意被通知家属或单位，
三是如果保留，部分被拘留人向家畜或单位通知难以到位，一旦产生问题可能承担法律责任。
二、建议增加的法律文书
1、根据《拘留所条例》第九条规定“拘留所应当凭拘留决定机关的拘留决定文书及时收拘被拘留人。需要异地收拘的，拘留决定机关应当出具相关法律文书和需要异地收拘的书面说明，并经异地拘留所主管公安机关批准”，建议增加异地拘留审批表。
2、建议增加被拘留人出所体表检查表，由被拘留人签字确认，转其它处理时同时由办案单位民警签字确认。
3、建议增加被拘留人权利义务告知的法律文书。

Henan Provincial Supervision Corps’ Opinions on Amending the “Legal Documents of Detention Centers (Draft for Comment)”
Ministry of Public Security Supervision Bureau:
On June 27, the Henan Provincial Supervisory Corps issued a “Notice on Soliciting Opinions on the Legal Documents of Detention Centers (Draft for Comments)”, and various prefectures and cities in the province organized discussions among experienced detention center leaders and police officers. After a summary review by the general team, the following amendments were proposed and reported:
- Suggested revisions
(1) Detainee Registration Form (Form 1)
The “Registration Form for Detained Persons” suggests adding a case-handling unit or a detainee unit. (2) Detainees’ health check-up form (style 2)
- The contents of the body surface inspection column for detainees should be changed to three items: “blood pressure, body temperature, and body surface”.
- It is recommended to add a column for the signature of the police and the detainee under the physical examination column to “confirm” the detainee’s health condition.
(3) Handover list of contraband and items involved in the case of the detainee (style 3)
- In the “Detainee’s Handover List of Prohibited and Case-Involved Items”, the “detention institution decision-making authority” should be “detention decision-making authority”.
- It is suggested to change the “Approval by the Director” in the handover list of the prohibited and case-involved items of the detainee to “Approval by the leader of the supervisor”.
(4) Temporarily stored items and cash receipts of detainees (style 4)
In the detainee’s temporarily stored items and cash receipts, the column for the detainee’s signature should be added to the column for the detainee’s financial signature and police signature when he leaves the prison.
(5) Detention Receipt (Form 5)
The design of the legal document “Receipt Receipt” is the same as the case-handling unit’s “Detainee Execution Notice (Receipt)”, and it is recommended to use the receipt designed by the Ministry of Public Security for the case-handling unit. (Zhengzhou, Kaifeng, Luoyang, Xinxiang)
(6) Notification of Non-arrest (Form 6)
The stub of the “Notice of Non-detention” suggested adding “case-handling unit”.
(7) Notification of Proposal for Alternative Handling (Form 7)
The stub of the “Notice of Suggesting Additional Handling” suggests adding “case-handling unit”.
(8) Examination and approval form for detainees to ask for leave (Form 9)
- The column of “guarantee deposit” in the approval form for detainees’ leave and leave should be marked as “completed by the approving authority”.
- It is recommended to change the guarantor’s “residence” to “address” in the “Approval Form for Leave of Absence of Detainees”, and it is recommended to change the approval form to a form.
(9) Approval form for use of police equipment (style 11)
The “Approval Form for Use of Police Equipment” suggests that the signature of the police in charge should be changed to that of the police on duty.
(10) Certificate of Release from Detention (Form 17)
A list of certificates (stubs) of release of detention, notification of family members or units should be deleted. First, according to the “Detention House Regulations” and “Detention House Regulations Implementation Measures (Draft)”, detainees should be automatically released from detention when they expire, and there is no need to notify family members Second, some detainees are unwilling to be notified to their family members or work units. Third, if they are kept, it will be difficult for some detainees to notify livestock or work units in place. Once problems arise, they may bear legal responsibility.
- Suggested additional legal documents
- According to Article 9 of the “Regulations on Detention Houses”, “the detention center shall promptly arrest the detainee based on the detention decision document of the detention decision organ. If it is necessary to detain the detainee in a different place, the detention decision organ shall issue the relevant legal documents and the need for a different place to detain the detainee. written explanation, and it has been approved by the competent public security organ of the detention center in a different place”, and it is suggested to add an approval form for detention in a different place.
- It is recommended to add a detainee physical examination form, which should be signed and confirmed by the detainee, and should be signed and confirmed by the police of the case-handling unit at the same time when it is transferred to other processing.
- It is suggested to add legal documents to inform detainees of their rights and obligations.
