北京东城分局第二预审大队关于张楠诈骗案的工作报告
一、基本案情
我局于2009年12月27日受理张楠涉嫌诈骗一案。
犯罪嫌疑人张楠，男，1984年出生，身份证号码：，汉族，大专文化，户口所在地：天津市河东区直沽街金昌西里，在京暂住地：北京市崇文区七天快捷酒店。职业：无业。
犯罪嫌疑人张楠因涉嫌诈骗罪于2009年12月27日被我局刑事拘留，2010年1月27日经北京市崇文区人民检察院批准逮捕。2010年3月27日延长羁押壹个月，2010年4月23日将此案移送北京市崇文区人民检察院审查起诉。
2009年11月至12月间，犯罪嫌疑人张楠在崇文区搜秀商城内，谎称认识天津广大银行分行行长赵萍，能低价购买泰达荷银红利先锋基金为由诈骗。他先后诈骗事主刘杨（男，27岁，北京人）、孙萌（女，29岁，河北廊坊人）、白丽萍（女，36岁，山西高平人）共计人民币24万元。后于2009年12月27日到崇文分局体育馆路派出所投案自首。
二、案件查证情况
我室受理张楠涉嫌诈骗一案后，对张楠加强讯问。在讯问过程中犯罪嫌疑人张楠交代诈骗事主刘杨、孙萌、白丽萍的24万元人民币后，张楠给歌厅小姐王小叶购买了一辆红色本田思域轿车（以王小叶名义购买）。为此我室工作人员先后到王小叶工作的朝阳区6号公馆歌厅、朝阳区缤纷年代娱乐城及在京暂住地怀柔区富乐小区南里，均未找到王小叶及红色本田思域轿车。在讯问犯罪嫌疑人张楠过程中，张楠交待未告诉王小叶给她购买的红色本田思域轿车系用诈骗所得赃款。故王小叶不构成犯罪，无法将王小叶通缉上网抓逃。在对犯罪嫌疑人张楠提请逮捕期间，通过审查发现犯罪嫌疑人张楠在天津涉嫌诈骗，被上网通缉。天津市公安局河东分局经侦支队于2010年1月15日上网对犯罪嫌疑人张楠进行抓逃。经对犯罪嫌疑人张楠讯问，该人交代在天津实施诈骗的违法犯罪的问题。后与天津市公安局河东分局经侦支队侦查员闫建伟、张津华联系后，案件移交我局并案处理。经审查，犯罪嫌疑人张楠于2009年8月至2009年10月间在天津市塘村路家中，以光大银行发行内部高息储蓄存款业务，他可以说明办理为名，骗取事主郭文蔚、郭丽洁人民币十四万元。犯罪嫌疑人张楠交待所骗取事主郭文蔚、郭丽洁均已挥霍。
三、后期工作
1、王小叶的基本情况及查找经过：
王小叶，女，汉族，户口所在地：中国甘肃省武威市凉州区武南镇五村，身份证号码：。职业：北京市京浙会餐饮娱乐管理有限公司，歌厅小姐。
根据2011年2月28日东城区检察院控申处工作要求，（2011年3月8日东城区检察院控申处转交我处）要求查找张楠诈骗案中，嫌疑人张楠用赃款给王小叶购买的红色本田思域轿车，找王小叶核实相关情况。为此我局工作人员于2011年3月10日到北京市公安局治安总队特种行业管理支队查找信息经查，王小叶在北京市京浙会餐饮娱乐管理有限公司做歌厅小姐。后到该歌厅进行查找，歌厅保安部经理阴祖胜、歌厅人力资源管理部经理祝海军，均称见过此人。王小叶在歌厅的化名叫“小叶子”，经查考勤记录王小叶于2011年2月16日以后就没有上班。经查寻北京市公安局暂住人口网，王小叶暂住在朝阳区青年路西里。2011年3月11日经与管界民警王小梅联系后到该处查找家中无人。后到朝阳区平房派出所查询显示，王小叶在朝阳区炫特嘉园，属六里屯派出所管辖。后民警和管界民警田宝心一同到炫特嘉园，现在此居住住户叫张冰，女、23岁，于2011年1月在此租房居住。2011年3月13日，分局民警再次到北京市京浙会餐饮娱乐管理有限公司的歌厅查找王小叶。但王小叶没有来上班，歌厅保安部经理阴祖胜称如王小叶来上班，立即通知分局。2011年3月14日已将王小叶发布到市局涉案查控网，进行全市查找。
2、查找红色本田思域轿车情况。
经查询，嫌疑人张楠用赃款给王小叶购买的红色本田思域轿车于2010年5月给转卖齐海龙（男，黑龙江省哈尔滨道里区新发镇庆丰村人，身份证号码：）。齐海龙暂住朝阳区安贞西里三区XX号楼人防层，分局民警到该处找齐海龙了解相关情况。但该人已不在此地居住。找安贞西里三区XX号楼人防层管理人员吴玉增了解称，齐海龙系倒卖二手车的。因二手车市场不景气，现在已不干倒卖二手车了，去向不明。后查询到红色本田思域轿车现在被田春林（女，四川省绵阳市人，暂住：西城区丰汇园小区）买走。分局民警于2011年12日找到田春林，田春林称红色本田思域轿车是在丰台区花乡二手车市场齐海龙那里花人民币132000元购买，手续齐全。原车主叫王小叶，田春林与王小叶不认识也从来没有见过面。田春林与齐海龙也不认识，只是在买车时打过交道，买车后也没有联系。
目前我局工作人员正在对王小叶积极进行查找，对王小叶卖车款项进行追缴，王小叶查找工作正在进行中。

关于张楠诈骗案件情况汇报
2011年7月15日，我派出所接分局转来的关于张楠诈骗案件追缴涉案物品情况通报。经我所主办该案领导与民警回忆，现将当时该案办理情况汇报如下：
一、接报案件情况
2009年12月27日10时许，张楠（男，26岁，汉族，无业，户籍地及现住址：天津市河东区直沽街金昌西里，居民身份证号码：）到原崇文公安分局体育馆路派出所投案自首称：自己在京诈骗他人财物。接报告后，派出所民警立即开展调查访问工作。
二、民警审查情况
经工作查明，2009年11至12月间，犯罪嫌疑人张楠在北京虚构事实，以能够帮助他人低价购买基金的方式，诈骗事主刘杨（男，29岁，丰台区丰台镇新华街四里）、孙萌（女，30岁，河北省廊坊市广阳区管道局）、白丽平（女，38岁，山西省高平市小西沟南铁西南路农业局小区）三人人民币共24万元整。犯罪嫌疑人张楠承认以上诈骗事实。
三、追查涉案人员、物品情况
民警对张楠讯问过程中问其所骗赃款下落，张楠称所骗的24万元均已挥霍。其中部分赃款以在娱乐场所认识的女从业人员王小叶（女，户籍地址：甘肃省武威市凉州区武南镇五村，身份证号：，暂住：北京市朝阳区炫特嘉园）的名义购买了一辆红色思域牌轿车，赠予了王小叶。但由于该车购买时间较短，民警上网查询未查找到该车信息。后派出所民警在犯罪嫌疑人张楠带领下到王小叶在京暂住地朝阳区炫特嘉园查找（经上网查询王小叶在京登记的暂住地址与张楠提供地址一样）。该地址早已换租他人居住，在该地址周边也未找到该车辆。民警多次拨打张楠提供的王小叶电话号码（13910203505），对方始终不接听电话。
鉴于刑事拘传办案时效12小时，派出所民警将以上查找王小叶及思域轿车情况制作工作记录附卷后请示分局法制，将张楠送分局刑事拘留。

- Basic facts
On December 27, 2009, our bureau accepted Zhang Nan’s alleged fraud case.
Criminal suspect Zhang Nan, male, born in 1984, ID number: Han nationality, college education, registered permanent residence: Jinchang Xili, Zhigu Street, Hedong District, Tianjin, temporary residence in Beijing: Seven Days Express Hotel, Chongwen District, Beijing. Occupation: Unemployed.
The criminal suspect Zhang Nan was criminally detained by our bureau on December 27, 2009 on suspicion of fraud, and was arrested on January 27, 2010 with the approval of the People’s Procuratorate of Chongwen District, Beijing. On March 27, 2010, the detention was extended for one month, and on April 23, 2010, the case was transferred to the Beijing Chongwen District People’s Procuratorate for review and prosecution.
From November to December 2009, the criminal suspect Zhang Nan was in the Souxiu Mall in Chongwen District, falsely claiming that he knew Zhao Ping, the branch manager of Tianjin Guangda Bank, and defrauded him on the grounds that he could buy TEDA Amro’s dividend pioneer fund at a low price. He defrauded the victims Liu Yang (male, 27 years old, from Beijing), Sun Meng (female, 29 years old, from Langfang, Hebei), and Bai Liping (female, 36 years old, from Gaoping, Shanxi) for a total of RMB 240,000. Later, on December 27, 2009, he surrendered himself to the Police Station of Tiyongguan Road, Chongwen Sub-bureau.
- Case verification
After our office accepted Zhang Nan’s alleged fraud case, we intensified interrogation of Zhang Nan. During the interrogation, the criminal suspect Zhang Nan confessed to defrauding Liu Yang, Sun Meng, and Bai Liping of RMB 240,000, and Zhang Nan bought a red Honda Civic sedan (purchased in Wang Xiaoye’s name) for the karaoke lady Wang Xiaoye. For this reason, the staff of our office successively went to the No. 6 mansion karaoke hall in Chaoyang District where Wang Xiaoye worked, the Fun Times Entertainment City in Chaoyang District, and the south of Fule Community in Huairou District, where he lived temporarily in Beijing. Neither Wang Xiaoye nor the red Honda Civic was found. During the interrogation of the criminal suspect Zhang Nan, Zhang Nan confessed that he did not tell Wang Xiaoye that the red Honda Civic sedan he bought for her was obtained through fraud. Therefore, Wang Xiaoye did not constitute a crime, and Wang Xiaoye could not be arrested online. During the arrest of the criminal suspect Zhang Nan, the investigation found that the criminal suspect Zhang Nan was suspected of fraud in Tianjin and was wanted on the Internet. On January 15, 2010, the Economic Investigation Detachment of the Tianjin Municipal Public Security Bureau’s Hedong Branch went online to arrest the criminal suspect Zhang Nan. After interrogating the criminal suspect Zhang Nan, the person explained the illegal and criminal issues of committing fraud in Tianjin. After contacting Yan Jianwei and Zhang Jinhua, investigators of the Economic Investigation Detachment of the Tianjin Public Security Bureau’s Hedong Branch, the case was transferred to our bureau for processing. After investigation, the criminal suspect Zhang Nan used Everbright Bank to issue internal high-interest savings deposit business at his home in Tangcun Road, Tianjin from August 2009 to October 2009. - Wang Xiaoye’s basic situation and search process:
Wang Xiaoye, female, Han nationality, registered permanent residence: Wucun, Wunan Town, Liangzhou District, Wuwei City, Gansu Province, China, ID number: . Occupation: Beijing Jingzhehui Catering and Entertainment Management Co., Ltd., Miss Karaoke.
According to the work requirements of the Prosecution Office of the Dongcheng District Procuratorate on February 28, 2011 (on March 8, 2011, the Prosecution Office of the Dongcheng District Procuratorate was transferred to our office) to investigate Zhang Nan’s fraud case, the suspect Zhang Nan used stolen money to Wang Xiaoye For the purchased red Honda Civic, please check with Wang Xiaoye. For this reason, the staff of our bureau went to the special industry management detachment of the Public Security Corps of the Beijing Municipal Public Security Bureau on March 10, 2011 to search for information. After investigation, Wang Xiaoye was working as a karaoke lady at Beijing Jingzhehui Catering and Entertainment Management Co., Ltd. Later, they went to the karaoke hall to search. Yin Zusheng, manager of the security department of the karaoke hall, and Zhu Haijun, manager of the human resources management department of the karaoke hall, both claimed to have seen this person. Wang Xiaoye’s alias in the karaoke hall was “Little Yezi”. After checking the attendance record, Wang Xiaoye did not go to work after February 16, 2011. After searching the Beijing Municipal Public Security Bureau’s temporary resident population network, Wang Xiaoye temporarily lives in Xili, Qingnian Road, Chaoyang District. On March 11, 2011, after contacting Wang Xiaomei, a policeman in the administrative area, he went to the place to find that there was no one at home. Later, an inquiry at the Pingfang Police Station in Chaoyang District revealed that Wang Xiaoye was in Xuantejiayuan, Chaoyang District, under the jurisdiction of the Liulitun Police Station. Later, the policeman and Tian Baoxin, a policeman from the management circle, went to Xuante Jiayuan together. The current resident is Zhang Bing, a 23-year-old female, who rented a house here in January 2011. On March 13, 2011, the police from the sub-bureau went to the karaoke hall of Beijing Jingzhehui Catering and Entertainment Management Co., Ltd. again to search for Wang Xiaoye. But Wang Xiaoye did not come to work. Yin Zusheng, the security manager of the karaoke hall, said that if Wang Xiaoye came to work, he would immediately notify the branch office. On March 14, 2011, Wang Xiaoye was posted to the investigation and control network of the Municipal Bureau of Investigation and Control for the city-wide search.
- Find the condition of the red Honda Civic.
After investigation, the suspect Zhang Nan used the stolen money to buy a red Honda Civic sedan for Wang Xiaoye and resold it to Qi Hailong (male, from Qingfeng Village, Xinfa Town, Daoli District, Harbin, Heilongjiang Province, ID number: ) in May 2010. Qi Hailong temporarily lived on the air defense floor of Building XX, No. 3 District, Anzhenxili, Chaoyang District. But the person no longer lives here. Wu Yuzeng, a manager of the civil defense layer of Building XX in Xili District 3, Anzhen, learned that Qi Hailong was a reseller of second-hand cars. Due to the downturn in the second-hand car market, he has stopped reselling second-hand cars now, and his whereabouts are unknown. Later, I found out that the red Honda Civic was bought by Tian Chunlin (female, from Mianyang City, Sichuan Province, temporary residence: Fenghuiyuan Community, Xicheng District). The police from the sub-bureau found Tian Chunlin on December 12, 2011. Tian Chunlin said that the red Honda Civic was bought at Qi Hailong, a second-hand car market in Huaxiang, Fengtai District, for RMB 132,000, and the procedures were complete. The original owner’s name was Wang Xiaoye. Tian Chunlin and Wang Xiaoye did not know each other and had never met each other. Tian Chunlin and Qi Hailong didn’t know each other either, they only had acquaintances when they bought the car, and they didn’t contact each other after buying the car.
At present, the staff of our bureau is actively searching for Wang Xiaoye and recovering the payment for Wang Xiaoye’s car sale. The search for Wang Xiaoye is in progress.
