▲全天共受理各类报警7,709起。其中:

网络言论自由的边界——评英国少年辱骂戴利被捕事件

新浪体育讯:当地时间7月31日,英国一少年在“推特”上辱骂英国跳水名将戴利,于31日被英国警方逮捕。可能面临“恶意通讯”的指控。新浪体育特约上海纽迈律师事务所方正宇律师,对这一起事件进行评点:

由于涉嫌在推特上侮辱英国跳水运动员戴利,一名年仅17岁的英国少年近日遭到警方拘捕。

根据目前的报道显示,在戴利无缘奖牌之后,这位少年曾以“你令父亲蒙羞”之类的言论,攻击父亲刚在去年不幸去世的戴利。结果非但有数千名网友要求推特封其账号,更是惊动了英国警方凌晨时分在酒店里将其捉拿归案。

仅仅因为在网络上骂了几句,就有可能面临牢狱之灾?这种情况在英国其实并不算新鲜。

还记得今年3月在英超赛场上突然晕倒的姆万巴吗?当时在意外发生之后,有一名大学生先是在推特上冒充姆万巴的主治医生,并且宣布了后者死亡的消息。接下来在揭穿之后,他又在推特上对于姆万巴进行了言语侮辱。结果在接到其他网友举报之后,当地警方迅速拘捕了此人。3月27日,法庭以扰乱公共秩序罪判处他入狱56天。

以上这些案例是在提醒大家,必须为各自的网络言论承担相应责任,而这与“言论自由”的精神之间并不存在矛盾。因为所谓的“言论自由”,必须建立在不侵害他人合法权益的基础上。那又如何确定具体的边界呢?

比如,对于某些问题存在怀疑,提出怀疑并且展示相应依据属“言论自由”,但就此妄加判断甚至制造谣言则可能构成侵权。具体到本次事件中,对于运动员的糟糕表现提出批评属“言论自由”,但侮辱对方乃至家人则可能构成侵权。所以说,“言论自由”绝不意味着可以肆意践踏他人的感情和尊严。倘若将这两者混为一谈,将导致整个社会环境变得混乱不堪。

值得一提的是,随着网络技术的发展,人际之间的交流方式也在发生改变,出现了越来越多的在线交流。与以往那种面对面的冲突相比,网络上似乎更容易出现相互谩骂的情况。在有些网友看来,这只是虚拟世界中的一种生存方式,并不等同于现实生活中那些有悖法律和道德的言行。

但实际上,构建在网络基础上的言语攻击,其杀伤力有时反而大于当面谩骂。因为这些出现在网上的言论,往往存在着很强的辐射效应,会引起广泛人群的围观。尤其在如今最流行的社交网络,相关内容更是有可能在短时间内获得大量转发,从而扩散对于受害者的伤害。包括在本次戴利受辱的事件中,伴随着对于这位少年所述内容的转发,还有无数人跟进对于戴利进行谩骂,甚至有人扬言要当面教训戴利。

由此可见,一些看似只是为了宣泄个人情绪的网络言辞,最后却有可能形成对于某些对象的严重伤害。正因为如此,英国警方才会以采取强制措施的方式,来维护健康的社会秩序和言论环境。未来倘若这位少年在经过审判之后承担刑责,那么需要从中吸取教训的,远远不只是他一个人。
