延庆“6·09”伤害致死案破案报告
一、案件基本情况
2009年6月9日22时10分许，我局匿名电话报案称：延庆县妫川广场中心有人打架，接报后，刑侦大队副大队长赵琳飞立即带领侦查员赶赴现场对此案开展调查访问工作。
二、现场勘查情况：
现场位于延庆县妫川广场中心。
三、被害人情况：
被害人：李钧，男，19岁，延庆镇八里庄村，身份证号：，他右胸部及右眼鼻侧被人用刀扎伤，2009年6月9 日经抢救无效死亡。
被害人：马国华，男，30岁，吉林省盘石市东宁街道，身份证号：，他右腹部被人扎伤，现正在延庆县医院抢救。
四、嫌疑人情况：
犯罪嫌疑人蔡国庆 ，男，1990年出生，汉族，身份证号码：，户口所在地：北京市延庆县延庆镇莲花苑小区，现住：延庆县延庆镇莲花苑小区。
犯罪嫌疑人秦志军 ，男，1985年出生，汉族，身份证号码：，户口所在地：河北省邯郸市曲周县安寨镇南马店村，现住：延庆县空军家属楼。
犯罪嫌疑人杨得军，男，1974年出生，汉族，身份证号码：，户口所在地：四川省达县管村镇鹰咀村，现住：延庆县空军家属楼。
五、现场访问的基本情况：
据报案人裴水英讲：6月9日22时许，她当时正在延庆县妫川广场中心处西侧呆着时，听见身后有吵架声。她回头看见广场中心处有五个男子正在吵架，其中三个男子当中一人打了另外两个人中的一人。后其中三个男子当中的另一人打了另外两个人中的另外一人。她见后赶紧跑到广场北侧打110报警，在报警后她看见有一名男子从她身边跑过，后有一名男子追赶。后该男子返回，又回到广场中心伙同另外两名男子踢打躺在地上的一名男子，后逃跑。裴水英到案发现场时，见被打倒在地上的男子右眼部流血及红肿，随即打了120急救电话。后警察及120大夫先后到达现场，120大夫对伤者进行抢救。
据汪敏讲：2009年6月9日19时许，他和马国华在妫川广场东侧碰见李燕和另外一名女子，后相互聊天。当晚20时许，马国华走了，他一人和李燕和另外一名女子聊天。大约过来20分钟左右，同事闫歧林、李响及马国华来了就一直和李燕她们聊天。在晚上9时40分左右，一名姓蔡的男子和一名男子来了，来后和李燕她们聊天。他和马国华看他们就不顺眼。后马国华让他叫姓蔡他们两人过来，他叫了一声，姓蔡的他们两人就过来了。马国华和姓蔡的说了几句话后，马国华就打了姓蔡的一个耳光，和姓蔡一起的男子就要动手。这时，李响和闫歧林过来，马国华又给了姓蔡一个的男子一个耳光。后姓蔡的从衣服内拿出一把刀朝李响肚子上就扎，被李响躲开。马国华上前抓住姓蔡的手夺刀，后被姓蔡的用刀扎了肚子一下。扎完后姓蔡的就拿刀追他，他就往广场北侧喷泉边处跑。他听见有人问姓蔡的是不是抓他，姓蔡的说是。后没停就跑回威飒港迪厅找到保安部经理李晗，对他说马国华被扎了，后和李晗去了广场。到后见李响在地上躺着，右眼流血了，见后我们就和120大夫把李响送往延庆县医院进行抢救。
据王秋磊讲：2009年6月9日22时许，他当时正在威飒港迪厅内值班，闫歧林给他打电话说：他们在广场被打了。后见汪敏从外跑回，看见他后和他说：马国华被人在广场处扎伤了。后他和李晗来的广场处见李钧躺着地上，右眼部有血。他叫李钧时，李钧没有反应。后120大夫来对李钧身体进行检查后说，人不行了。但他要求抢救，后和大夫将李钧送到县医院进行抢救，李钧经抢救无效死亡。
据闫歧林讲：2009年6月9日19时许，他和汪敏、马国华李钧等人到广场处玩。大约晚上10时许，马国华给李钧打电话称，有两个喝酒的人，要打我们。后他和李钧找到马国华等人，见马国华正和一个男子说什么，像是要打他的样子。之后李钧就上前打了那名男子一下。他见后就跑到一边。后看见那名男子不知从哪掏出一把刀，就扎了马国华一刀。马国华被扎后跑了，该男子又用刀扎了李响两下。他见马国华被扎后，他就追了过去。回头看见李响捂着肚子倒在地上，同时见该男子持刀又追汪敏。后他给威飒港迪厅王秋磊打电话说，你快来广场去看看李钧，我送马国华去医院了。
据帅晓颖讲：2009年6月9日19时许，她和李燕到广场玩碰到了汪敏等人，他们就在一起聊天。后蔡国庆给她打电话问她在哪，她说在广场和威飒港迪厅的人聊天，并让她过来。后来蔡国庆和一名男子到了广场找到她，他们就一起聊天。过了一会和蔡国庆来的人叫他们，蔡国庆起身就到了汪敏等人身旁。有人打了和蔡国庆一起来的人两个耳光，蔡国庆就往地上扔了一个白色东西。后双方打了起来，她和李燕就到边处去了，后看见李响仰面躺着地上，她就让人打120急救电话。之后见蔡国庆又追和李响一起来的男子，过了一会蔡国庆又回来和另外两个男子对躺在地上的李响拳打脚踢，蔡国庆当时用刀扎了李响的颈部。后打了一会，蔡国庆等三人就跑了。
据李燕讲：2009年6月9日19时许，她和帅晓颖到妫川广场玩，后和汪敏等人在广场中心处聊起。后来蔡国庆和一个男子也来了，我们就一起聊天，聊了一会。蔡国庆站起来就往东走，走到汪敏他们跟前。我看见蔡国庆和汪敏等人互相推了几下，之后他们就打了起来。我和帅晓颖就到一边去了，后来看见李响被人打倒了，蔡国庆他们就跑了。
六、案情分析：
根据上述情况，项目组认为：这是一起故意伤害（致死）案。
七、破案经过：
2009年6月9日22时许，延庆县妫川广场中心处发生一起故意伤害（致死）案。在调查中李燕反映，参与打人的一名男子叫蔡什么庆。侦查员郝六军、赵劲峰立即利用公安网北京信息查询搜库系统进行模糊查询（蔡？庆，男，延庆县）。经查询，延庆县共有两名叫蔡什么庆的人，一名叫蔡国庆，另一名叫蔡德庆。经李燕对网上照片进行指认，李燕称，蔡国庆(男，1990年1月29日出生，延庆镇莲花苑小区8号楼109号)很象参与打架的人。后经汪敏、闫岐林进行辨认，确定蔡国庆系本案的犯罪嫌疑人。2009年6月10日，在迎宾环岛的一辆由北向南行驶的蓝色小客车（车号京N6Z588）上，将蔡国庆及秦志军抓获。经讯问，犯罪嫌疑人蔡国庆交待： 2009年6月9日22时许，蔡国庆和秦志军在延庆县妫川广场中心处与马国华（二哥）、李钧（李响）等人发生口角。后双方互殴，在互殴中蔡国庆用刀将马国华、李钧（李响）扎伤。马国华被扎后逃跑。李钧倒地后，蔡国庆去追赶另外一名男子，未果后返回途中遇见杨得军。在他二人跑到中心广场处后，秦志军、杨得军又用脚踢打被蔡国庆扎倒在地上的李钧。6月10日6时许，蔡国庆在侦查员的带领下指认了“杨子”的暂住地。后侦查员在延庆县湖南小区空军家属楼（没有楼号及门牌号）西门三楼将杨得军抓获。经讯问，犯罪嫌疑人蔡国庆、秦志军、杨得军对上述事实供认不讳。

Victim: Ma Guohua, male, 30 years old, Dongning Street, Panshi City, Jilin Province, ID number: , he was stabbed in the right abdomen, and is currently being rescued at the Yanqing County Hospital.
- Situation of the suspect:
Criminal suspect Cai Guoqing, male, born in 1990, Han nationality, ID number:, registered permanent residence: Lianhuayuan Community, Yanqing Town, Yanqing County, Beijing, current residence: Lianhuayuan Community, Yanqing Town, Yanqing County.
Criminal suspect Qin Zhijun, male, born in 1985, Han nationality, ID number:, registered residence: Nanmadian Village, Anzhai Town, Quzhou County, Handan City, Hebei Province, current residence: Air Force Family Building, Yanqing County.

- Basic situation of on-site visit:
According to Pei Shuiying, who reported the case, at about 22:00 on June 9, when she was staying on the west side of the center of Guichuan Square in Yanqing County, she heard arguing behind her. She looked back and saw five men arguing in the center of the square, one of the three beating one of the other two. Another of the three men then hit the other of the other two. When she saw it, she ran to the north side of the square and called 110 to call the police. After calling the police, she saw a man running past her, and a man chased after her. Afterwards, the man returned, returned to the center of the square together with two other men, kicked and beat a man lying on the ground, and then fled. When Pei Shuiying arrived at the scene of the crime, she saw that the right eye of the man knocked down on the ground was bleeding and red and swollen, so she immediately called 120 for emergency services. Later, the police and 120 doctors arrived at the scene one after another, and 120 doctors rescued the injured.
According to Wang Min: at about 19:00 on June 9, 2009, he and Ma Guohua met Li Yan and another woman on the east side of Guichuan Square, and chatted with each other. At about 20 o’clock that night, Ma Guohua left, and he chatted with Li Yan and another woman by himself. About 20 minutes later, colleagues Yan Qilin, Li Xiang and Ma Guohua came and chatted with Li Yan and the others. At around 9:40 p.m., a man surnamed Cai and another man came and chatted with Li Yan and the others. He and Ma Guohua disliked them. Later, Ma Guohua asked him to call Cai and the others to come over, and he called, and the two of them surnamed Cai came over. When we arrived, we saw Li Xiang lying on the ground with bleeding from his right eye. After seeing him, we and the 120th doctor sent Li Xiang to Yanqing County Hospital for emergency treatment.
According to Wang Qiulei: At about 22:00 on June 9, 2009, he was on duty in the Venetian Harbor Disco. Yan Qilin called him and said: They were beaten in the square. Later, I saw Wang Min running back from the outside, and told him after seeing him: Ma Guohua was stabbed in the square. Later, at the square where he and Li Han came, they saw Li Jun lying on the ground with blood on his right eye. When he called Li Jun, Li Jun did not respond. After 120 doctors came to examine Li Jun’s body, he said that he was dying. But he asked for rescue, and he and the doctor sent Li Jun to the county hospital for rescue. Li Jun died after rescue failed.
According to Yan Qilin: at around 19:00 on June 9, 2009, he, Wang Min, Ma Guohua, Li Jun and others went to the square to play. At about 10 o’clock in the evening, Ma Guohua called Li Jun and said that there were two drinking people who wanted to beat us. Later, he and Li Jun found Ma Guohua and others, and saw that Ma Guohua was talking to a man, as if he wanted to beat him. Li Jun then stepped forward and hit the man. He ran aside when he saw it. Later, seeing the man take out a knife from nowhere, he stabbed Ma Guohua. Ma Guohua ran away after being stabbed, and the man stabbed Li Xiang twice with a knife. After seeing Ma Guohua being stabbed, he chased after him. Looking back, he saw Li Xiang lying on the ground clutching his stomach, and at the same time saw the man chasing Wang Min with a knife. After that, he called Wang Qiulei of the Versa Harbor Disco and said, come to the square to see Li Jun, and I will send Ma Guohua to the hospital.
According to Shuai Xiaoying: at about 19:00 on June 9, 2009, she and Li Yan went to the square to play and met Wang Min and others, and they chatted together. Later, Cai Guoqing called her and asked where she was. She said that she was chatting with people from the Versa Port Disco in the square and asked her to come over. Later, Cai Guoqing and a man went to the square to find her, and they chatted together. Later, when she saw Li Xiang lying on the ground on his back, she asked someone to call 120 for emergency services. Later, Cai Guoqing chased the man who came with Li Xiang again. After a while, Cai Guoqing came back and beat and kicked Li Xiang who was lying on the ground with two other men. Cai Guoqing stabbed Li Xiang in the neck with a knife. After fighting for a while, Cai Guoqing and the other three ran away.
According to Li Yan: at around 19:00 on June 9, 2009, she and Shuai Xiaoying went to play in Guichuan Square, and then chatted with Wang Min and others in the center of the square. Later Cai Guoqing and a man also came, and we chatted together for a while. Cai Guoqing stood up and walked eastward, and walked in front of Wang Min and the others. I saw Cai Guoqing, Wang Min and others pushed each other a few times, and then they started fighting. Shuai Xiaoying and I went to the side. Later, when we saw Li Xiang being knocked down, Cai Guoqing and the others ran away.
- Case analysis:
Based on the above situation, the project team believes that this is a case of intentional injury (death). - The process of solving the case:
At about 22:00 on June 9, 2009, a case of intentional injury (death) occurred in the center of Guichuan Square in Yanqing County. During the investigation, Li Yan reported that a man who participated in the beating was named Cai Heqing. Investigators Hao Liujun and Zhao Jinfeng immediately used the public security network’s Beijing information query database system to conduct fuzzy searches (Cai Qing, male, Yanqing County). After investigation, there are two people named Cai Heqing in Yanqing County, one named Cai Guoqing and the other named Cai Deqing. After Li Yan identified the online photos, Li Yan said that Cai Guoqing (male, born on January 29, 1990, No. 109, Building 8, Lianhuayuan Community, Yanqing Town) looked like the person who participated in the fight. After identification by Wang Min and Yan Qilin, it was confirmed that Cai Guoqing was the criminal suspect in this case. On June 10, 2009, Cai Guoqing and Qin Zhijun were arrested in a blue passenger car (number Beijing N6Z588) driving from north to south at Yingbin Roundabout. After interrogation, the criminal suspect Cai Guoqing confessed: At about 22:00 on June 9, 2009, Cai Guoqing and Qin Zhijun had an argument with Ma Guohua (second brother), Li Jun (Li Xiang) and others at the center of Guichuan Square in Yanqing County. Afterwards, the two sides fought each other. During the fight, Cai Guoqing stabbed Ma Guohua and Li Jun (Li Xiang) with a knife. Ma Guohua fled after being stabbed. After Li Jun fell to the ground, Cai Guoqing went to chase another man, but met Yang Dejun on the way back after failing. After the two of them ran to the central square, Qin Zhijun and Yang Dejun kicked and beat Li Jun who was pinned to the ground by Cai Guoqing. At around 6 o’clock on June 10, Cai Guoqing, led by investigators, identified the temporary residence of “Yang Zi”. Investigators later arrested Yang Dejun on the third floor of the West Gate of the Air Force Family Building (no building number or house number) in Hunan Community, Yanqing County. After interrogation, the suspects Cai Guoqing, Qin Zhijun, and Yang Dejun confessed to the above facts.
